what do you mean about entering today on the dates do you mean 09/09/2006 or the actual word today.Also i filed my claim yesterday does it matter that i just put down charges total and not interest or 8%

Where the dates should be, enter 08/08/06 for the Date of Service (as that is the date you filed your claim and now remains fixed). Enter '=TODAY()' exactly as shown, but without the quotes for the Date of Payment. This can be changed to the actual date that the claim is settled as and when that happens.

 

If you've filed your moneyclaim without showing the charges interest or s69 interest they are not part of your claim and this can only be changed now by paying a non-reclaimable £35 You might be OK for the 8% if you ticked the box for it - I'm not sure as I didn't file online. You will need to fix the spreadsheet as suggested earlier to get the right figures for charges interest and 8% interest before you try to amend the claim.

Has the MC been submitted ?

 

There is only one course of action if you want to claim the interest.

You will need to do an ammendment of claim particulars to incluse interest.

There is a charge of 35 quid.

It involves downloading some forms and sending to the court.

They then issue an amended form which you send to the defendant with a response pack (also downloadable )

 

first port of call is to call the court and ask them to e mail you the info

they can talk you through it by phone/

You should do this asap

 

quote the claim number.

I rang up the money claim helpline but they said as my charges £4555 + interest is more than £5 thousand that I'd have to pay £35 to amend it and pay more money for my claim as its over 5 thousand??????!I thought the charges had to be under the 5 thou mark.I ticked the box on my online claim for interest but am in a muddle please help:confused:

Although they use the total including 8% to work out the fee, they don't take the 8% into account when working out the track.

That's what I said - the extra 8% IS used to calculate how much the claim will cost, so adding it may take the claim over £5K, increasing the court fee. However, the 8% IS NOT taken into account when working out which track to put it in (small claims or fast track), so it will remain below £5K as far as that is concerned.

Please stop and read through what I explained above. Your court fee WILL go up, but IT REMAINS BELOW £5K as far as the small claims limit is concerned, so doesn't open you up any risks of paying the other side's costs.

I find that deeply offensive.

 

All the mods and site helpers on here give their time voluntarily.

 

We have lives too, you know, and are not here 24hrs a day, 7 days a week to answer just your particular questions. There are over 55,000 registered users whose questions we have to answer and advice to give. You made a post just over 4 HOURS ago. You are NOT being ignored and I am really annoyed that you said that.

The claimant claims interest under section

69 of the County Courts Act 1984 at the

rate of 8% a year from 31/08/2000 to 08/08/2006 of (1)£5333.60 and also

interest at the same rate up to the date of

judgment or earlier payment at a daily rate of (2)£1.17.

 

1.This figure should be just the 8% interest not, as I assume your charges + 8% interest

 

2. This figure should be your charges X 0.00022. The maximum daily rate is £1.09 which would be for a claim where your charges were £5000
