I took a Payday Advance with Quick Quid online and never actually signed any paperwork but had to type in my surname and tick a box to say I agree to the T&C's. Every month I had to re-new the loan, again by signing online.

 

Below is the Credit Agreement from them. Is it enforceable?

3. OTHER FINANCIAL INFORMATION

 

Total charges for credit (i) The total charge for credit is £112,50. The total charge is made up of the following Finance Charge:

 

(a) £112,50 due on 30 October 2008 Payment Date 1

 

(ii) Interest Rate: 25%

 

(iii) The amount of the Finance Charge is fixed by us at the beginning of the Loan Agreement. The rate of interest in (ii) is determined by dividing the Finance Charge by the Loan Amount and multiplying the result by 100. The finance charge is applied on each Payment Date.

 

4. KEY INFORMATION

 

(a) Charges on Default

The Lender has the right to amend the amounts of the default charges detailed below to reflect any change in the cost incurred by the Lender in dealing with the default.

 

You may be charged:

 

(i) £ 12,00 each time a repayment is dishonoured on a Payment Date ("Dishonour Fee");

 

(ii) £ 20,00 if you cancel your direct debit authorizaton or debit card, as the case may be, before a Payment Date and fail to pay the Total Amount Payable because you do not make alternative repayment arrangements with us ("Late Fee");

 

and (iii) for the Lender's reasonable expenses in enforcing this Loan Agreement. These expenses will include (but are not limited to) (i) taking steps, including court action, to obtain payment, including reasonable legal costs that the Lender incurs (ii) tracing you if you change address without notice and (iii) communicating with you if you break the terms of this Loan Agreement;

 

(b) Right to settle early

You have the right to repay the Loan before the end of the Term by making a single payment calculated under a formula which limits the amount of the Finance Charge you pay. If you wanted to settle when a quarter of the Term had passed the amount you would have to pay would be £28,12; if half of the Term had passed the amount would be £56,25; and if three quarters of the Term had passed the amount would be £84,38.

 

In calculating the amounts shown, no account has been taken of any variation which might occur under the Loan Agreement, and that the amounts are accordingly only illustrative.

Missing payments could have severe consequences and make obtaining credit more difficult.

The Consumer Credit Act 1974 lays down certain requirements for your protection which should have been complied with when this agreement was made. If they were not, the lender cannot enforce this agreement without getting a court order.

 

The Act also gives you a number of rights. You can settle this agreement at any time by giving notice in writing and paying off the amount you owe under the agreement which may be reduced by rebate. Examples indicating the amount you might have to pay appear in the agreement.

INTERPRETATION: In these Payday Loan Terms and Conditions, the words "you" and "your" mean the borrower who has signed the Fixed-Sum Loan Agreement (hereinafter the "Loan Details"). A reference to "Loan Agreement" is to be taken as meaning the Loan Details and the Payday Loan Terms and Conditions together. The words "we", "us" and "our" mean CashEuroNet UK, LLC, a credit provider licensed under the Consumer Credit Act 1974. "Business Day" means any day on which banks are open for business in England and Wales, excluding Saturday and Sunday.

 

CONCLUSION: In order to complete your transaction with us, you must electronically sign this Loan Agreement by clicking the "I Agree" button in the Signature Box, as well as all other tick boxes that appear within the Loan Details. By clicking the "I Agree" button in the Signature Box, you agree to be bound by this Loan Agreement. We will then approve or deny the Loan Agreement. PAYMENT OF THE LOAN AMOUNT TO YOU: The Total Amount Payable in section 2© of the Loan Details and the Finance Charge in section 3(i) of the Loan Details have been calculated on the assumption that the Loan Amount will be credited to Your Bank Account on the Disbursement Date.

 

We will use commercially reasonable efforts to effect a CHAPS credit entry by depositing the Loan Amount into the bank account nominated by you in your loan application ("Your Bank Account") on the Disbursement Date. Unavoidable delays as a result of bank holidays, the processing schedule of your individual bank, the untimely receipt of pay slips, if such pay slips are required, inadvertent processing errors, "acts of God", and/or "acts of terror" may extend the time for the deposit.

 

In the event that the payment of the Loan Amount is delayed, we will automatically adjust the Disbursement Date to reflect the date when proceeds entered Your Bank Account. If there is a delay in payment of the Loan Amount, we will e-mail you a confidential written notice to the e-mail address provided in your application advising you of the delay and of the adjusted Annual Percentage Rate, as well as any other changes to the information disclosed in the Loan Details. After the notice is sent to you, you will have the option of cancelling this Loan Agreement, without incurring any Finance Charges or other costs, in accordance with the "CANCELLATION WITHOUT CHARGE" provision below. Failure to give such notice as and when set out in the "CANCELLATION WITHOUT CHARGE" provision will be deemed to constitute acceptance by you of the delayed Disbursement Date and the revised terms of the Loan Agreement will take effect 7 days after you receive the notice.

 

CANCELLATION WITHOUT CHARGE: You may cancel this Loan Agreement, without incurring any costs or Finance Charges, no later than 5:00 pm Greenwich Mean Time on the next Business Day immediately following the Disbursement Date ("Rescission Deadline"). If you wish to exercise this right, you must inform us in writing, before the Rescission Deadline, either by e-mail to support@quickquid.co.uk or by fax to 0808 101 1380 that you want to cancel this Loan Agreement.

 

In the event that we receive your notice under this provision before the Rescission Deadline but before the Loan Amount has been credited to Your Bank Account, we will not debit Your Bank Account or Debit Card and both our and your obligations under this Loan Agreement will be terminated.

 

In the event that we receive your notice before the Rescission Deadline but after the Loan Amount has been credited to Your Bank Account, we will debit Your Bank Account or Debit Card for the Loan Amount in accordance with your Payment Selection. If we receive payment of the Loan Amount when we debit Your Bank Account or Debit Card our and your obligations under this Loan Agreement will be terminated. If we do not receive payment of the Loan Amount when we debit Your Bank Account or Debit Card, then this Loan Agreement will remain in full force and effect.

 

RIGHT TO CANCEL WITHIN 14 DAYS: Your rights to cancel this Loan Agreement under this provision arises under the Financial Services (Distance Marketing) Regulations 2002. Your rights under this provision are in addition to your rights under "CANCELLATION WITHOUT CHARGE". You may also cancel this Loan Agreement during the "Cancellation Period". The Cancellation Period ends on the expiry of FOURTEEN DAYS beginning on the day after the day that the Loan Agreement is concluded. Unless we receive your notice before the Rescission Deadline, if you cancel this Loan Agreement under this clause you will be liable to pay Finance Charges as calculated below.

 

To cancel this Loan Agreement, you must inform us in writing by sending us a notice of cancellation before the end of the Cancellation Period stating that you want to cancel this Loan Agreement ("Notice of Cancellation"). The Notice of Cancellation should either be (a) left at our address, addressed to us at Communications House, 26 York Street, London W1U 6PZ ; (b) sent to us by post to Communications House, 26 York Street, London W1U 6PZ; © sent to us by e-mail to support@quickquid.co.uk; or (d) sent to us by fax to 0808 101 1380.

 

In the event that we receive your Notice of Cancellation during the Cancellation Period but before the Loan Amount has been credited to Your Bank Account, we will not debit Your Bank Account or Debit Card and both our and your obligations under this Loan Agreement will be terminated.

 

In the event that we receive your Notice of Cancellation during the Cancellation Period but after the Loan Amount has been credited to Your Bank Account, we will effect a debit to Your Bank Account or Debit Card for the Loan Amount together with the Finance Charge calculated by applying the Annual Percentage Rate to the Loan Amount for the period from the Disbursement Date to the date the Loan Amount is debited by us. If we receive payment of the Loan Amount when we debit Your Bank Account or Debit Card our and your obligations under this Loan Agreement will be terminated. If we do not receive payment of the Loan Amount when we debit Your Bank Account or Debit Card, then this Loan Agreement will remain in full force and effect.

 

YOUR OBLIGATIONS: You promise to pay us the Total Amount Payable set forth above under section 2© of the Loan Details by making the repayments specified in section 2(d) of the Loan Details.

 

The Finance Charges payable by you under this Loan Agreement are calculated and applied as set out in section 3(ii-iii) of the Loan Details. Unless your loan is extended, no interest or Finance Charge is applied to your debt after the Payment Date. Unless otherwise provided in this Loan Agreement, all payments will be applied first to the Finance Charge and then to the Loan Amount.

 

If you have elected to make your repayments by debit card, we will debit the repayments specified in section 2(d) by debiting the payments due under the Loan Agreement to the debit card nominated by you in your loan application ("Debit Card"). We may, in our sole discretion, present two separate debits for the amount that is payable by debit to your Debit Card. If we do, the amount of each debit will represent the amount that is due under the Loan Agreement in respect of that payment. Such payments will include the repayments due on each Payment Date or thereafter and any fees that become payable by you under this Loan Agreement.

 

If you have elected to make your repayments by direct debit, then pursuant to the Debit Authority given by you below under " DEBIT AUTHORISATION", we will debit the payments due under the Loan Agreement from Your Bank Account, including the repayments due on each Payment Date or thereafter and for any fees that become payable by you under this Loan Agreement.

 

CONSENT TO ELECTRONIC COMMUNICATIONS: By signing this Loan Agreement, you agree that, subject to any applicable law or regulation, any disclosure, notice, record or other type of information that is provided to you in connection with this Loan Agreement ("Communications") may be sent to you electronically by sending it to you by e-mail to the address you have provided to us in your loan application. We may also post information in connection with this Loan Agreement at our website, Payday Loans: Quick Payday loans @ www.QuickQuid.co.uk, but we will notify you by e-mail when we have posted such information. We will not be obliged to provide any Communication to you in paper form unless required by an applicable law or regulation, or if you specifically request us to do so.

 

You must ensure that you notify us of any changes to your e-mail address by writing to us or sending us an e-mail, using secure messaging, at least five (5) days before the change.

 

DEBIT AUTHORISATION: You hereby voluntarily authorise us to debit your nominated bank or building society account ("your Bank Account") or Debit Card for any amount that is payable by you under this Loan Agreement, including the Loan Amount, Finance Charges and any other fees that you incur ("Debit Authority").

 

We will debit repayments on each Payment Date to your Bank Account or Direct Card in accordance with the Debit Authority given by you above. If a payment is dishonoured for any reason, you agree to pay us the Dishonour Fee, which we may collect by Direct Debit to Your Bank Account or debit to your Debit Card in accordance with your Payment Selection.

 

You authorise us to verify all of the information that you have provided, including past and/or current information. If there is any missing or erroneous information in or with your loan application regarding Your Bank Account or Debit Card details then you authorise us to verify and correct such information.

 

If we are unable to correct the information, you acknowledge that this may delay the payment of the Loan Amount to you. You agree to assist us to correct information by providing us with such information as we may reasonably require.

 

We will give you a notice if you or we make any changes to the debit arrangements under this Loan Agreement ("Advance Notice"). If you have elected to pay by Direct Debit, you and we agree that the period of Advance Notice that we will provide to you is 3 Business Days.

 

The Debit Authority given by you for the purposes of this Loan Agreement is to remain in full force and effect until your obligations to us under this Loan Agreement are fully satisfied.

 

If a debit is returned unpaid or dishonoured for any reason when it is first presented by us for payment, we may re-present the debit for payment to Your Bank Account or your Debit Card by presenting two separate debits for the total amount that is payable by you. We may do this on more than one occasion. If we are required to do so under any applicable law or other legal requirement, we will provide you with advance notice before we re-present for payment a previously returned or dishonoured debit.

 

LATE FEE: If, prior to your Payment Date, you cancel your Debit Authority by cancelling your Debit Card or your direct debit authorisation under the terms of the direct debit guarantee below, you agree that, immediately upon cancelling your Debit Authority or Debit Card you will contact our Customer Service Centre at 0808 234 4558 to make alternative arrangements to repay your loan by the Payment Date. If you fail to make alternative repayment arrangements with us, and you fail to pay the Total Amount Payable by the Payment Date, you will be charged an additional late fee of £20,00

The Direct Debit Guarantee

  • This Guarantee is offered by all Banks and Building Societies that take part in the Direct Debit Scheme. The efficiency and security of the Scheme is monitored and protected by your own Bank or Building Society.
  • If the amounts to be paid or the payment dates change CashEuroNet UK will notify you 3 working days in advance of your account being debited or as otherwise agreed.
  • If an error is made by CashEuroNet UK or your Bank or Building Society, you are guaranteed a full and immediate refund from your branch of the amount paid.
  • You can cancel a Direct Debit at any time by writing to your Bank or Building Society. Please also send a copy of the letter to us.

REPAYMENT AT PAYMENT DATE 1: In addition to your rights at 4(b) of the Loan Details, you may repay the Loan Amount on Payment Date 1. You may do this by selecting 30 October 2008 as your "Loan Due Date", by calling our Customer Service Centre at 0808 234 4558 before 27 October 2008. If you make this selection, then on 30 October 2008 we will debit the total of (i) the Loan Amount and (ii) the finance charge that is due on this date as listed in the Fixed Sum Loan Agreement.

 

If you do not select 30 October 2008 as your "End Loan Action" before 27 October 2008, this Loan Agreement will continue for the full Term and, subject to the "EXTENSIONS" provision below, we will debit the second repayment to Your Bank Account on 28 November 2008.

 

EXTENSIONS: You may, at any time up to 25 November 2008, request an extension of your loan for a further Term. You may do this by calling our Customer Service Centre at 0808 234 4558. If we agree to your request, we will send you an e-mail with a new loan agreement ("New Agreement") 1 day before 28 November 2008.

 

You must sign the New Agreement by following the instructions in the e-mail. If you do not, we cannot extend your loan and we will debit the second repayment due under this Loan Agreement on 28 November 2008 to Your Bank Account. You may at any time before 25 November 2008 change your selection by by calling our Customer Service Centre at 0808 234 4558.

 

When we extend your loan we will only debit the Finance Charge from Your Bank Account on 28 November 2008. Please note that if this debit is dishonoured, you will remain liable to us under this Loan Agreement until your obligations to us have been met.

 

At the time that we extend your loan the Loan Amount will be rolled over for a further Term under the New Agreement for which you will be charged an additional Finance Charge. You may make a payment towards the Loan Amount which will result in a smaller Finance Charge for the extended loan. Please contact us if you would like to make such a payment before 5:00pm GMT on 25 November 2008 and we will adjust the amount that we debit to your Bank Account on 28 November 2008 to take account of this payment.

Loan extensions are not guaranteed and we reserve the right to deny your request for an extension for any reason.

 

PREPAYMENT: You can prepay your obligations partially or in full before the Payment Dates by sending us an e-mail or fax to the address and number referenced above informing us that you want to make a prepayment and giving us written authorisation to debit Your Bank Account by direct debit or your Debit Card for the prepayment. If we receive the prepayment it will be applied first to the Finance Charge, second to any default fees and other charges you may have incurred under this Loan Agreement and then to the Loan Amount. Please be advised that paying your loan off early will reduce the amount of your Finance Charge, which will be calculated in accordance with section 4(b) of the Loan Details.

 

DEFAULT AND LEGAL FEES. Unless otherwise agreed, you will be in default under this Loan Agreement if you do not pay us what you owe us on a Payment Date.

 

Subject to our obligations under the Consumer Credit Act 1974, if you are in default under this Loan Agreement we may exercise our rights to enforce this Loan Agreement, including by commencing court proceedings in which case you may be liable for our reasonable costs as described in 4(a)(iii) of the Loan Details.

 

COMPLAINTS: If you have a complaint please contact us support@quickquid.co.uk or by phone at 0808 234 4558 and we will investigate and try to resolve your complaint in accordance with our internal complaints handling procedure. Please refer to our website for further information about your rights and our complaints handling procedure.

 

GOVERNING LAW, ASSIGNMENT and EXECUTION. This Loan Agreement will be governed by the laws of England and Wales. Each party agrees to submit to the exclusive jurisdiction of the courts of England over any claim or matter arising under or in connection with this Loan Agreement. We may assign or transfer this Loan Agreement or any of our rights hereunder without your consent.

I only got a payday loan from them when I was in dire-straights finance-wise.

 

They are doing my flamin nut in as they send me the following email nearly every day:

I am not going to send them the CCA letter, as they will produce the online CCA and screen-shot of account details (according to other posts I have read in CAGS).

 

Then when they pass the debt to a DCA (which is usually 1st Credit), I will CCA them and let the fun begin! :D

Now I may be right out of order here and I hope I'm not.

 

For the first time in ages, I needed to borrow money and mum wasn't around.

 

I signed up for a loan, received the money and paid it back on payday. The service I received was fantastic, they paid me money into my account when they said they would, I knew what I was paying back and it was paid back on the date I said it would.

 

I knew what the risks were and was happy to pay the £40 on the £200 borrowed. The service was superb and I was very happy.

 

DON'T for once think I am one of them, but you can't complain when you know what you signed up for.

I for one would be very grateful if xsarahz's advertising post could be removed from this site. The company referred to has plenty of opportunities to advertise and this site is read by a lot of very vunerable and desparate people who do not need to see yet another false financial solution placed in front of them. People are here to find help to get out of debt, not deeper into it.

Successfully claimed back mis-sold PPI (Barclays Bank) 2009-10 (£8500)

Ran a paid-for DMP. Deeply respect those who self-manage a DMP; it is possible to do with the help of fellow CAGGERS

Offered F&F to all my creditors. All closed out including a particularly intransigent and stubborn one - who eventually saw sense after 10 months of nonsense!

Does not condone debt avoidance but violently disagrees with the antics of debt collectors and their behavior towards the ones trying to pay. I am a great believer in what goes around, comes around. Keep up the good fight!

What may be interesting to see is the paperwork after the initial loan was taken out. You renewed the loan by paying off the interest and signing a new document for the loan.

 

This meaning the origional loan was terminated and a new loan started. Now if you never recieved another £450 each time you started a new loan then how can the loan be properly executed? Depending on the paperwork of course, it could be possible that you have nothing to pay

Can someone help me re quick quid. I like many others, have been continuously taking out loans with them, but have always paid on time and never deferred. I took out another loan this week and when i went today to repay, it says that my loan is in default and that i don't owe them anything and i must write to an office in Leeds. I am very worried and very scared.

I've had a similar problem. They did not take the money I owed out on the due date, so I phoned them. They told me that I shouldn't worry, but couldn't provide any more details. When I try to log into the site, it no longer recognises me. Does anyone know what's going on at Quick Quid?

One thing i noticed by the agreement above is the following:

 

(ii) £ 20,00 if you cancel your direct debitlink3.gif authorizaton or debit card, as the case may be, before a Payment Date and fail to pay the Total Amount Payable because you do not make alternative repayment arrangements with us ("Late Fee");

 

Now to me that £20 for cancelling your direct debit or Debit card is a penalty fee, as you have a legal right to do so under the direct debit guarantee and under your debit card terms. So they are penalizing you for inacting your legal right, that would make such a term unlawful in my opinion.

 

Also as others have potined out, if they have extended the loan via creating a new agreement (which they then add your name too, not you signing too) then the original agreement is terminated, yet that original agreement is the loan as you have not received any monies via the new agreement making the new agreement invalid and the original agreements termination Unlawful.

hi this ismy experience from 2 months ago with quick quid.i had been using them for over a year with no problems ,i used the extensions id built up in place on occassions and paid them off in full lots of times with no hassles until 2 months ago. i applied for one of the 5 extensions i had with them and recieved an email confirmng an agreed extension was in place for the last working day of the month my pay day but on my pay day i checked my bank account to find they had taken seven hundred pounds instead of the agreed roll over amount thusleaving me with zero in my bank account and no money for food etc.when i phoned qq up for an explanation alls i got was americans who did not understand plain english ,it took me several more calls to make to them before one person actually understood what qq had done to me and i had to agree to a payment plan for 3 months to pay it off but mean while they put my account in default with them .they dont understand or maybe i should say do not want to know you when you roll over and reduce your loan like i was doing as it appears they lose out on gaining more interest from you so deliberatly default you and deliberatly raid your account fraudulently breaking there terms of agreement.i reported them to my ban for fraudulant activity and told them they were being investigated but they couldnt of cared less ,so my experience should be a big warning to any one using quick quid for a loan ,dont do it again .i for one will never ever touch a payday loan ever in my whole life again as these are just pure and utter **** and one more payment finishes me with them thank god as the stress has nearly killed me ie suffering panic attacks which iv never in my life experienced before and its just not worth the health of anyone taking out a payday loan with any one of them .good luck to all of you who are trying your utmost to be free of these sharks i wish you all the very best and in one and a half weeks time il be completely free of these **** .take care :whoo::violin:

Just an update on my last message. To recap: QuickQuid's site told me that I was in default, I phoned their number and they told me "not to worry". Another visit to their website, and my profile had been wiped ("There is no account associated with that email address"). Three months later, and I haven't heard a thing from them. There's nothing showing on my credit record, and they haven't claimed my payment from the bank. I've cancelled my Direct Debit following the post above, and wait to see if they'll bother getting back in touch with me.

brilliant you cancelled ur dd thats good now carry on with your life and if they get in touch offer payment and if they refuse tell them you have recorded the call and will take it to the fos ,fingers crossed they may have cancelled all contact with you but they may have passed it over to adebt collection agency but no worries your free from quick quid ,good luck :mad2::-(
