They said they do not need to provide me with a copy of my 'true agreement' in the covering letter.

Hey Womble,

 

Yes, I did cpr 31.14 them and all I got were my 83 pages of bank statements from my current account. Then I got 2/3 pages of bank statements from the 'loan' account. That's been about it really other than what came a couple of days ago which were the agreements I have just attached.

 

I do have in my possession the default notices they issued but definitely no signed agreements.

 

I'm being, surprisingly, hesitant about it being good news! (sorry) :| I hope it is but shall wait and see.

It is not enforcable !

 

Basically the Ratwest have just created a agreement.

 

This is really good. Did you cpr 31.14 them?

The defence your need will probably be a copy of mine.

 

(1)No orginal agreement on the loan. You have ask the Ratwest to provide a true copy and have failed to do so.

 

(2)The overdraft - it has over £1,800 of unfair charges on.

 

Please highlight the charges on your statements and put them in a folder.

(you will need to show the judge)

 

You might not even reach court because you have a strong defence concerning the loan agreement and ok the overdraft can be difficult to defend but you have unfair charges.

 

See when the date is set for court then we can put together the skelleton defence before the due date with the help of the other great caggers on here.

 

So dont worry.

I would agree that it has been reconstructed - or if it hasn't they have never managed to get a signed agreement from you, which is just as good.

Good morning everyone,

 

Another update, on Saturday, I received the AQ from the courts. I will look through Womble's and see what I need to complete. The deadline date is set for 25th March 2009.

 

Starting to feel nervous now!

Hi Texanbar,

 

Now i have got my judgement set aside i will now try to help you with yours.

 

Can you scan your default letter from them and see if they have correctly done this by the book. It could be a dodgy default.

 

We will re edit my defence to suit yours and then get a experianced cagger to double check it before being in on the 25th March.

I am just waiting for my AQ as well to come through. i expect I will get the same letter as you that they wish to proceed. They still haven't sent me any details through from my cpr request.

Hi everyone

 

I'm sorry I've not been back on for a while, I've had tonsillitis, and Uni work is piling up! Anyway, here's the Default Notices I have in my possession Womble, I've scanned them through. Any help regarding filling out the AQ would be very much appreciated. I shall hand deliver again - deadline is next Wednesday, 25th March 2009.

 

Thanks everybody - it's reassuring to know I am not alone. I may even ask for a court buddy once I have my date. (My confidence is slipping fast, feel like a bag of nerves!):(
