      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Nellie still has a slight hangover from Wales... elephant hangovers last about 6 months... might be why they have such long pregnancies!

 

I haven't booked a hotel yet but hope to share a room with someone, the coach to Birmingham leaves London Victoria at 4.30pm Friday afternoon and gets to Birmingham about 7.30, there is a 20 minute stop somewhere on the journey. I'll PM my mobile no to people so if they change venue or something I can be contacted. I'll have a small suitcase with me with the puppets in and a sleeping bag (and a bottle of voddy....)

Reading back 2 pages the old bank is indeed now called the Old Joint Stock and I had a half in there nearly 2 weeks ago. The beer is good and the decor is fabulous but one of the barmaids told me that she considers the Wellington (it's in Bennetts Hill but next door to the Joint Stock via a passageway) has real beers on tap. It was just a suggestion anyway but I did find out that there is a theatre with real productions on regular occasions which only seats 80 upstairs. Will have to visit at some point in time - just throwing this in for interest. I have been told by a friend that the food at the Joint is good.

 

Really looking forward to Friday night and seeing old faces and new. SSL what are you doing with the car this time? At least you won't be going all round the city centre - can't help thinking it was my fault last time.

I think I will be wearing my white coat with hood so I should be easily spotted again for those that don't know me - unless we have a heatwave that is......

 

Broad Street on a Friday night - not done this for some Christmases.........

Not sure yet. It is still poorly so the RAC might be looking after it. :p

At least you won't be going all round the city centre - can't help thinking it was my fault last time. Oh don't remind me. :eek: Getting to see the city while lugging huge suitcases and it raining heavy was an experience i don't ever want to repeat. But there was no way it was your fault. It was the stupid woman who thought Brair rose pub was over the the other end of town. Not 10 paces from where we started. :-x

Not sure what I will be wearing, possibly a short white mac, as I am travelling up from London in the afternoon (booking on 4.30 coach from Victoria) I will have a case with me with a change of clothes and my puppets, and sleeping bag if I can find it (think my nephew has pinched it for his travelling van).

 

I suppose I ought to PM people my new mobile phone no - changed it a couple of weeks ago as there was a blinding offer on via work - SSL and Thai come to mind, anyone else I should send it to - 'just in case the coach is delayed or you change venue before I get there - due into Brum about 7.30ish at Digbeth bus station - don't know how far that is from Broad Street.

Here's a map with New Street Station, Travelodge Birmingham Central and O'Neills. Seems Digbeth Bus Station has been demolished so may be worth checking with coach company exactly where you'll be dropped off SG. I've a feeling you may have a bit of a trek.:|

Does anyone have a corner for me on Friday night in their room? I''ve checked the City Inn and they are very pricey, cheapest room seemed to be £65... coach is booked and I should arrive opposite the old Digbeth Bus Station about 7.30 on Friday evening....

It's called not having any dosh - something I'm used to now. I've tried to tap Mr Bo up, but he's skint too :(

 

Oh well, I think I can run to a bottle of white for tomorrow night and don my "Roving Reporter" hat on in readiness for the usual antics :lol:

Oh no Bo!!:eek:

 

Well hotel room booked and no refund if I cancel so I'm committed (or should be, I know), bag nearly packed, plans all sorted so I guess I'll see the rest of you tomorrow at 8.00. Has everyone got someone's phone number? I think most of us have met someone attending so hopefully we'll recognise each other.

 

If not the guy at the bar with moths coming out of his wallet is Barra. Just tell him what you're drinking and he'll answer appropriately.:p

Ahhhhhhh!!!!!!!!!!!!! Silly girl 1 - this is probably too late to reach you but I could meet you outside coach station tonight and we could get up to Broad Street together. If not ask anyone how to get to Corporation Street and jump on a number 128 or 129 asking the bus driver to put you off near O'neills. It's not too far really but might save you some time. I would estimate walking it from Digbeth will take 20 - 30 minutes (depends how long your legs are). I will pm you my mobile or call ssl as she has my number.
