What next

My son received a ticket from a company called CPS .Although he is the shown keeper of the vehicle he was not the driver at the time the vehicle was parked on a private estate (where our daughter lives).The driver was in fact getting the relivant parking permit at the time the ticket was issued.

My question is...my son will send back the template letter shown relating to the fact he was not the driver.......What should be his response should and if they right back asking for the drivers details :confused:

Also on the ticket the start of the vrm looks like CF where as its LF ...Are these companies allowed to have two go's checking this with DVLA ?

PCNs issued by Councils and FPNs issued by the old bill have the backing of statute law which make the registered keeper liable for the ticket. Tickets, or more correctly invoices, issued by Private Parking Companies have no such backing.

 

Your son's response should be to tell them very politely to FOAD. (FO and Die). :D

 

Seriously he is under no legal obligation to tell them anything. This is a Civil matter and the onus of proof is with the complainant, in this case CPS. Your son does not have to provide them with information or incriminate himself. They may spout drivel saying he does but if you read through the template letters you'll see the responses to this.

 

If you haven't done so already have a read of the guide to private parking companies/charges as it sets out the legal side nicely.

 

The PPC can have as many goes with the DVLA as they are prepared to pay for. Unlike for PCNs or FPN's the process is not tightly regulated. What will happen if they get the wrong VRM is some other person will receive their demand for money or they will get a no such VRM return if the VRM they enter doesn't exist. In either situation your son will be in the clear.

Firstly, I would advise you not to post again any specific information here re your case. CPS frequently troll these boards and are known to use posted information against the posters. Secondly, do nothing unless and until you receive any court papers. If this happens (and no-one can say with certainty if it will) my advice is go over to Pepipoo where PPC trolls are not tolerated and you will have access to a defence which will blow Perky out of the water. I am not meaning to disparage CAG but with the level of PPC trollers these boards get it is sometimes difficult to tell the good guys from the bad guys.

I dont think theres any advice here that CPS have not seen before (if indeed they are here in such force )...

Of course Cag gets its share of trolls....they are on every site on the internet but it should not deterre users here from posting...

If CPS get any advantages from seeing advice here,then its not stopped the countless users who have challenged and had a good result to their issues.

The aim of the forums is to get results to share info and experiences and to create a level playing field using the laws.We cannot continue to be a success with that if users are advised here to go elsewhere.
