Hi All,

I don't know whether I am doing this one correctly, but Scott gave me this link and here is my urgent problem:

I bought a new Acer in January 2007. It worked fine up to April, when it started to freeze and slowed down considerably. I checked the HD, cleaned it but to no avail. So we suspected a virus but all checks were o.k. Eventually I took the Acer to a computer specialist, who detected a memory problem. I went to Comet where I bought it from, they referred me to Acer. By then I had ost all data and it cost me £100 to get most of it back. The Acer was returned to the Acer repair centre. They put a new motherboard in.

Now the Acer itself worked fine but whenever we connected an external device to any of the USB ports, it froze. Acer always tries to fopp you off by asumung it is a software problem. Therefore it was again tested by the specialist who also concluded that all USB ports had a problem. The Acer was returned to the company. They put new USB ports in. The Acer came back, the USB ports and motherboard worked fine, but the CD drive did not work at all.

The Acer went back to the company, was repaired again, also got a new HD and worked for a few days, but the machine started freezing again. I rang Acer a few times, each time I had to restore it totally, so that it could start as from new and of course each time I lost all my programmes, etc.

But it still freezes frequently, even when working with only the basic programmes which were installed when I bought it.

Acer would now take it back a fourth time, but I am going insane. I spent about £200 on it already. It is not a working computer and I have wasted not only money but also valuable time, days, if not a whole week on restoring, rescuing data etc.

Luckily, I have an old cheap Targa, 7 years old, which still works fine without any problems.

Comet refuses to deal with it, Acer will take it back for yet another reapir session but not supply another computer.

The situation is not tenable.

WHAT CAN I DO?????

HELP!!!!!!

I want my money back or a new computer!!

Moved to its own thread.

You have made a BIG mistake. You listened to Comet when they referred you to Acer direct, neatly passing the buck and denying their responsabilities under SOGA.

Your contract is with Comet. Not Acer, Comet. You need to go back to Comet with your receipt, a log of all the problems you have had with all the dates, and say: "Stop fobbing me off to Acer, I know this is YOUR responsability, now what are you going to do about it?"

PCW have a policy where if a PC/laptop less than 1 year old has to go back more than 3 times for repairs, they'll exchange it, so it might be worth making enquiries discreetly to see if Comet might have the same kind of policy. Either way, you need to familiarise yourself with SOGA and what are your rights under it, so Comet stops giving you the runaround.

Print this:

Trading Standards Central - Trading Standards and Consumer Protection information for the UK

and familiarise yourself with it. Carry it with you if need be. But don't let them send you back to Acer again. How Comet deals with it is their problem, not Acer's, not yours. Don't let them tell you otherwise.

Comet are liable for this as your purchase contract was with them, not Acer. Under the Sale of Goods Act 1979 they are liable for the goods for up to six years (due to the cost of the item - it should be expected to last for a reasonable amount of time) and should pay for any repairs or offer a refund.

I had a similar problem with a 2 yr old Amilo laptop that I purchased from PC World, at first they didn't want to know but after I saw an item on 'Don't get done get Dom' I wrote into them and they are now paying for the repairs on my computer.

Hope this helps.
