If they tow your car then this is a criminal act of TWOC (Taking Without Owners Consent) of which they can expect the same punishment as any car thief. Even threatening it is criminal - show it to your local Police.

The cops won't be interested, same for threatening behaviour, you'll get no joy from the cops don't waste your time.

Sadly, without a valid appeal the enforcement officer has no choice but to continue to pursue the ticket. Your best bet is to contact the company and attempt to resolve the situation.

 

Sadly, the enforcement officer nor his employer has no legal right to pursue an unlawful charging of a penalty. Your best bet is absolutely not to contact the company as the appeals process is non existent - these companies make the Police/LA's look like Saints by comparison.

 

P.S. Mr Woodwhistler, I think you should advise that the person that decides whether an appeal is valid or not is the person that profits from it or am I wrong??????

Thanks Leedsman. can I just say I have now received a second reminder notice now demanding £123.00 following the initial £99.00 demand. I did ask them for evidence as I never have received the initial parking notice. They have sent me no evidence and Instead they have sent me a further demand increasing the fine.

It has been well documented that I have been going through County Court Proceedings, brought by UKCPS. It is fair to say that throughout the process UKCPS have acted fairly, responsible and professional at all times.

 

It is also fair for me to acknowledge at this time, having reached an amicable settlement with UKCPS that Car Park Charging Companies such as UKCPS, have a right to charge a fee for parking on private land, when authorised to do by the land owner.

 

Having gone through the process of mediation as a result of the proceedings brought against me, I would also advise other people in a similar position to avoid ignoring letters received from UKCPS as it is highly likely that court action will be the result of doing so.

I have yet to see how they can nail fog.

Lamma I must point out YET AGAIN that UKCPS and CPS are two completely separate unrelated companies. Site mods might wish to confirm this as the issue has been raised many times previously.

Well as Simon has deleted all his previous posts in this thread, I will take it that the post above was a condition of whatever agreement he has reached with UKCPS. As such, I will treat it with the contempt it deserves and completely ignore it (after I have finished been sick after even reading it!)

 

I am sure Simon has now taken himself off to a darkened corner and is presently removing his own eyes with a hot poker in self disgust.

You contact them, you show your hand, you flag yourself up as a victim (and mug).

 

If you'd never contacted them from the start, you would have saved yourself a great deal of grief.

UKCPS have asked me to say that.......

 

Simon, forgive me my confusion - and I fully understand that you're probably unable to answer my concerns here - but:

 

You stuck to your guns over this for about 18 months, including having a Court decline to deal with it.

 

You've now come back, after mediation, and made a final post effectively saying that you've reached an "amicable settlement" with these "fair, responsible and professional" people and that "everyone should pay up on these tickets" - effectively discouraging other users of this forum from challenging tickets they receive.

 

10 days before posting this you go through this thread and meticulously delete every one of your posts.

 

Now, maybe I'm cynical, but that smacks to me of "we'll drop your charge if you remove all details from consumer forums and post to the effect that we're good guys really. Go delete the posts and we'll confirm no further action within 10 days."

 

If that's the case, then one question should be ringing in everyone's ears - why would anyone want posts deleted unless the arguments put on here were sound?

No offence meant to Simon but this little statement is clearly scripted - it's too obvious. I am affraid that if you caved in it is a sad sad day. You should stand by your actions and your principles my friend - people will think a great deal more of you.

 

I would encourage all victims of private parking company's to maintain the approach of ignoring their requests for your money!
