  1. I left talk talk after several years up to 2017 and had no yearly contract to honour due to it expiring. Quite simply they didnt provide me a working internet, blaming some issues with their line management software. I finished with them and didnt pay them for the time the line was not working. They sent me bills but I just could not pay them due to the principle of it. I tried to call their staff to explain that I am not going to pay when I didnt receive service, but wasted effort of course. Now talk talk are threatening credit score points against me if I dont pay. Is there anything I can do after they put this on my credit file. Its the principle of it that gets me, I just dont want to pay them after all the hassle and expense they put me through. As I was having to buy mobile broadband until I had a BT line put in. I have lots of credit I hardly use so its not the end of the world anyway but surely there must be a way to challenge them ?

  3. Hello all. I submitted a claim using MCOL a few weeks ago for a Deposit I gave to a Landlord (LL) when I lodged with them for 6 months, a total of £600. I am claiming that amount, including interest and court fees totalling just over £700. I took all reasonable steps to get the deposit back but the LL started blanking me and made promises to pay but never did. I started the MCOL process and they submitted an acknowledgment of service, stating they are going to defend the entire claim. Fair enough, thats their right. However herein the problem lies. I had been using the LLs current address to send all my formal letters and put it into MCOL with served the particulars of claim to them at that address (thus enabling them to submit an acknowledgement of service). However in their acknowledgement of service they put changed their address to their old address where they no longer live and havent done so for a year. This now means further documentation from the court will go to their old address - and my best guess is that when it comes to it they will try and get the claim set aside because they haven't received further court correspondence (because they've intentionally put an old/false address). Does anyone have any advice on how to deal with this? Thank you!

  6. Hello, I am looking for some advice please. I have a standing order weekly to Fedex Europe paying off some outstanding import tax, however today I have received a Notice of Enforcement asking for £958 - includes a number of charges! I can happily print off the invoices for these payments and get these off to them, but I need to know what I can do re the letter? I have emailed them today asking for confirmation of whether any payments have been added to this account. I have until 31st March to get this sorted. Please advise. Thanks

  9. Hello, I owe service charge backpayment to my management agent for my leasehold property. They took it to county court, then fast tracked to high court without informing me. I only knew when I received a demand for £2100 from the Sheriff's office. I offered to pay in instalments but they said their client wanted full payment, which I could not do. I sent them a copy of my Debt and Mental Health Evidence Form, they said their client rejected it. A Baliff visited my property when I was not in. I submitted an income and expenditure form (both mine and my wife's)to the sheriff's office, which clearly shows a minus. Even so I offered to pay £50 a month. I have now had an email saying they will forward this to their client and if it is rejected I will receive a visit from the Baliff without any prior notice. The amount has risen from £2100 to £3700 in just over 6 weeks, with interest at 41p a day. There is also a charge for a Baliff visit that never happened. I am worried sick. Please, if you can, please advise. I feel due process was not followed regarding the secrecy in taking this to court. I suffer from depression due to my debt issues and this is really affecting me
  10. Hi, I bought a voltage converter from Amazon to use for an American TV. While using it the converter started buzzing really loudly, suddenly overheated, and killed my flatscreen Samsung TV. Since I bought the product there are some very bad reviews on the product that include a person whose item exploded as a result of the item being faulty, so its not just me. I've been trying to get in touch with Amazon complaints department as I wanted to log a formal complaint about the converter and the TV, and I did this over a chat with Amazon's complaints department (- apparently). Amazon wouldn't allow me to log a complaint or do anything. Here's a snippet of how the conversation with Amazon Complaints team went: 11:45 PM GMT M: Based on our conversation, I understand I am not allowed to make a formal complaint. I am not allowed to get a link to your compensation policy. And I am not allowed to get compensation for the items damaged in my property by your dangerous faulty product. Based on this conversation I understand amazon takes no responsibility for items that are dangerous to people and private property. And I am also not allowed to contact the Amazon’s legal department. Is that right? 11:48 PM GMT Parthasarathy: I will forward this issue to our internal team and will make sure that you will not face this problem again. 11:50 PM GMT Me: Yes, you can forward this to the internal team. In the mean time I would like Amazon to register a formal complaint on the following grounds: 11:52 PM GMT Me: 1) I am being blocked from logging a formal complaint. 2) I am not allowed to get a link to your compensation policy. 3) I am not allowed to get compensation for the items damaged in my property by your dangerous faulty product. 4) Amazon takes no responsibility for items that are dangerous to people and private property. 5) I am being blocked from contacting the Amazon’s legal department. 11:52 PM GMT Parthasarathy: Okay. Also, ever formal complaint has to have a written response. Again, it's got nothing to do with internal contacts, disclosure or outputs. Are you saying that you refuse to register a formal complaint? 11:58 PM GMT Parthasarathy: We understand how you feel, we’re very sorry. We’re going to take care of this and you can trust us that it will not happen again in future How can I file a formal complaint with Amazon if Amazon does not want it? What should I do? Thank you.
  11. I really need some help with a problem I have. I was on a 4 day touring holidayicon last week in Scotland in my second hand motorhome which I only purchased around 4 months that I have been saving up for years to buy. On the second day in Scotland the service light came on. With only just purchasing it I wanted to get it seen to quickly I booked it into Arnold Clark, Falkirk Road Grangemouth. I told them exactly what type the motorhome was and they said it wasn't a problem they could sort it out for me the following day which was the Wednesday. I took it into them and waited from 10:30am until around 3:30pm then went to the service desk and asked how the service was doing. I was informed the service had been done but they were having an issue resetting the service light and they would have to take the motorhome to another garage up the road for the light to be turned off. I agreed to wait so they took the motorhome. Over an hour later I returned to the service desk again for another update. They said they still were having an issue turning the service light off and it must be a problem with my motorhomes body computer. they said they couldn't do it. I immediately called the dealership where I purchased the motorhome from in Lancashire and they said they could turn the light off for me if I bought it into them on the Saturday. I paid Arnold Clark for the service as I wanted to get away as by this time it was about 5pm and going dark because its winter and I was booked into a campsite in Edingburgh. I got into the motorhome and drove off. I got about half a mile down the road when I noticed that now not only was the service light illuminated but the airbag fault light was also illuminated all the time, which Arnold Clark hadn't mentioned anything about. I returned to Arnold Clark immediately. They initially denied all knowledge of the airbag light and said it must of been on when I brought the motorhome in as it was impossible for them to of caused it. after a lot of heated talk they finally ask me to return the following day so they could attempt to rectify the issue. However, knowing the garage in Lancashire could turn the lights off I didn't return the Arnold Clark the following day and instead had a days holiday driving around sight seeing, which is why I was in Scotland in the first place. Plus as Arnold Clark were unable to turn the light off on the service day, it was logical to assume they wouldn't be able to turn it off the next day either and I would waste another day of my 4 day holiday for nothing. The weather from Tuesday through to Friday was mostly terrible with torrential rain and high winds, plus I was smothered in a cold. on the Friday morning I decided to drive down to my parents house in Lancashire which was mid point on my way home to Hampshire and also only 10 miles from the garage in Lancashire where I bought the motorhome from. I arrived at my parents early on Friday, it was still raining and windy I decided to immediately take the motorhome into the dealership. However, on the way from my parents house to the dealership the motorhome started to make a strange engine noise. on arriving at the dealership I popped the bonnet with the service guy standing there. We found the oil filler cap was missing from the engine and the engine bay was coated and dripping with oil from the engine. The oil filler cap was found in the window screen wiper well above the engine. I had driven in excess of 600 miles with no oil filler cap in place and oil squirting all over the place. I was smothered in a cold and with the rain and wind I hadn't noticed or smelt anything wrong. I immediately called the Arnold Clark dealership to complain. The head service guy there spoke to me and informed me it was impossible for it to be their error has after servicing all vehicles are inspected by someone else prior to returning the vehicle to the customer. Yet from the point the motorhome was returned to me after the service, I had either been driving, cooking or sleeping in it until it being parked outside the front window of my parents house for 10 minutes before driving it down to the dealership and finding oil everywhere. Arnold Clark as informed me they will investigate the issue but they seriously doubt its anything to do with them. The investigation will take several days and I must not have the motorhome worked on by anyone else in that time. they expect me to stay at my parents house 250 miles away from home and miss work until they finish their investigation. The dealership in Lancashire has had a quick look at the engine and have found the turbo has been damaged due to lack of engine oil as it is now making a strange noise. Luckily though, they don't think there is any other damage to the engine, but they can't really tell properly without taking the engine apart. All they have done is fill the engine with new oil and made sure the oil filler cap is in its correct place and apart from being noisy it seems to run. From my initial conversation with Arnold Clark I know all they are going to do is fob me off saying its nothing to do with them I will be left with, at best, a damaged turbo that needs fixing, probably at my own expense I just think it is wrong and I am absolutely disgusted. I think Arnold Clark should own up to their error and I should be refunded the £224.96 for the service, the £61 something pence I have had to pay for the engine to be quickly inspected, refilled with oil and cleaned, plus whatever the cost of fixing the turbo and whatever else is wrong with the engine will be. Incidentally, The dealership in Lancashire turned sorted out the dashboard lights in no time. So what were Arnold Clark doing??
  12. I’m looking for some advice on a recent issue I have had with Halfords with regards to a road bike. This had started with a dispute over the quality of work done as part of a service plan, eventually resolved by taking to an independent bike repair shop. Ultimately, I accepted a refund of the cost of the additional work required, but informed them that I was still unhappy with various other issues they were unwilling to resolve. I was informed that a manager would call 4 times, which never transpired, though I believe the whole issue would have been resolved if they had taken the time to talk. The advice I’m now after is with regards to the service plan as some of the documented responses from Halfords have quoted that certain work is not covered by the Service Plan – none of the exclusions were ever outlined to me as the plan was provided as an apology for the pedal falling off when first purchased in 2014 and was renewed as a “3 year service plan” in 2015. Checking in-store, there is no clear advertising of inclusions by means of leaflets or boards. my first query is was the plan I was given ever fit for purpose for my bike and as such has it been mis-sold? Secondly, as part of the independent service I required the headset to be replaced. Checking the service document for my 2016 check, the headset was included. On the latest 2017 outline (eventually located online) the headset is only covered on a Gold Service. the second query is should I have been informed by Halfords of what seems like a change in terms and conditions of what is covered under the service plan? All advice greatly appreciated
  13. Hi there, I purchased a car from Arnold Clark around 3 months ago which included a service and MOT plan. I had no end of issues when purchasing the car. I signed 3 different order forms because the sales person entered incorrect info, I travelled 3 hours each way to collect the car to be told the car was not ready to go, as well as various other problems that complicated and confused the buying process. I feel that this service plan was not explained to me properly and if I had understood I would be paying interest for a service plan over 3 years I wouldnt have bothered . I contacted Arnold Clark customer services who have quite clearly stated i will not be getting a refund if I cancel the plan because I signed the order form and it clearly states it on there. I understand I have signed for this but they have not taken into account how confusing the sales person made the buying process. I actually received a good will gesture of £200 from the sales manager because of all the complications. my question is, do i have a right to request a refund for the service/MOT plan and if I do what are my next steps?   14. Hi all, Back in Nov 2015 i bought an Audi A5 Sports Convertible, 2012 reg, for £16,600 from a massive London based car dealer. In June this year I've decided to sell it as they worry of it devaluing in time was too much for me so i wasn't really able to enjoy the car anymore. I've tried taking it back to the same dealer but they were only able to offer me £13,000 after a quick check (this amount being subject to a thorough investigation). The guy told me the car is in a really good condition and i should have no problem selling it privately for about £14,500. So after advertising it for over a month i was lucky enough to get an offer of £15,000 but, just before paying the deposit, the potential buyer called the garage to verify the service history and was informed it's fake. As i still had a copy of the original advertisement from when i bought the car together with the six invoices, all from the same garage where presumably the services have been carried out (no service book, just invoices), I've contacted consumer rights and they advised me to get in touch with the company that financed the vehicle for me. In the meantime i got confirmation in writing from the garage that they've never serviced my vehicle so i've sent everything to the finance company who opened a dispute with the car dealer and said they will contact me in 5 working days. I am now waiting for them to get back to me but in the meantime i keep wondering what will i be entitled to?! i really don't want the car (I would have never bought it if i knew it has no service history) but i have used it in the past 7 months and added 4000 miles to its usage. i am worried they will only offer me what they did before (£13,000) but if it was as advertised by them (with 6 genuine services) I could have sold it for £15,000 privately, without a service history it's near enough impossible to sell a car of this value. Consumer rights wanted to report it to trading standards as it's a criminal offence but I've asked them to hold back for now as i feel it's my bargaining tool, I've mentioned this to the finance company and said i would like to try and resolve this matter peacefully first before getting the media and trading standards involved... Any ideas as to where i stand in terms of compensation? Many thanks, Anca
  15. When the Tesco driver arrived, I went out to sign for the shopping and instructed him where to leave it (in an area by my side porch). He refused and informed me that he had to watch me take the shopping into my home. Under no circumstances would I find it acceptable to be "watched" as I carry my shopping into my home. I find that creepy to be honest. I explained that I was in the middle of an important call and that I wanted it leaving where I directed. He then drove off with our urgent shopping leaving us, disabled and housebound and the animals without food. I have now been charged a delivery fee for shopping that was not delivered through no fault of my own that so far Tesco is refusing to refund. We have had absolutely no problems with Asda who are always wonderful and helpful. This experience with Tesco has been awful, even throughout the complaints process. This is what I have received back from the executive complaints team today: "Our drivers are unable to leave orders in a safe place, and do require a signature. This is explained in our Terms and Conditions which you accepted when you opened your account. I’ve copied the relevant information below. “All goods must be signed for on delivery by an adult aged 18 years or over. Tesco follows a "Think 25" policy, so if the person receiving the goods looks under 25, proof of age will be requested. If proof is not available and there is no-one of that age at the address when delivery is being made, the goods may be retained by the driver. If we attempt to deliver your order to the delivery address as arranged with you but there is nobody at the delivery address to accept your order, the driver will leave notification of attempted delivery and you will need to contact our Customer Service Centre to re-arrange delivery (see below for contact details). In these circumstances, if we have to return to deliver the goods, a further charge may become payable provided that delivery is attempted at the agreed time. Whilst we make every effort to deliver all your goods in the agreed time, we will not be liable if we fail to do so in part or in full due to circumstances beyond our control. I hope this helps explain things further." There is no mistaking either of us for under 25. Any input?
  16. The services are out sourced and handled in an unprofessional way. they keep on passing you to different teams and each team says will reply within 10 days, and a query remains unresolved for ever. So far I have been moved around 3 teams and 30 days, with no resolution.
  17. My uncle has learning disabilities and has worked for a major supermarket for over 20 years. The company has now introduced minimum service levels and say he is not reaching these. One problem is getting cages out and the other is customer service. A mystery visitor gave a damning report of his interaction with my uncle who apparently blanked him. The manager says that he does know what to do but doesn't always do it. The company have offered my uncle a different job doing the trolleys but our family doesn't want him to take it. The company have also brought in an in work support advisor from a charity to help support him and given extra training. My question is can they change his hours and duties as they say he is not achieving these new criteria? There are not as many hours available to all staff as there were last year due to the supermarket not taking as much money as they did. Is it discrimination if they change his job? Thank you for any help.
  18. I took out a Service Plan agreement less than 14 days ago and want to cancel. Essentially you pay £26.99 a month for 18 months and it covers a major and minor service, fair enough. However, Ive decided to cancel and simply pay for each service in lump sums as it will in fact be better for me if I want to change cars within the timeframe as if I did then the balance is due which again is fair enough. However, I have NOT claimed on the plan at all and speaking to VW financial services they are saying ok but that it takes up to 28 days to cancel (funny how it only took 20 minutes to set up) and that the first payment is due within that period and they will take it and its non refundable. Other than cancel the direct debit, have I any recourse and is it me, or does this sound like pretty dubious practice anyway?
  19. I recently purchased a Ford Mondeo Titanium x from a dealer near Bristol. The car was advertised as having a full service history. When I got home and checked all the booklets there was not a service history booklet. the following day I phoned the dealer who stated that they would find it. Two weeks later and numerous phone calls, lots of apologies and promises still no service book. Under the trade description act would I be entitled for some compensation due to the fact I bought it because of the reassurance of having FSH. I am happy with the car but not the miss selling.

  21. Hello All, I would request someone's help on how to proceed my case in the court. I have made overseas funds transfer from my HSBC account to one of my Indian friend account on Sep 1st 2016. I have received the confirmation from HSBC about my debits to my address but the transfer did not happen from their end. I understand there are some processes they have to follow it, but I feel which is not properly streamlined and it’s really putting the customer into frustration. It was an emergency situation that I need to support financially through this fund, but because of the issue and delay made by HSBC bank, I was pushed into very worst situation. I had come across lots of confusions and lost my reputation around my family and friends in my native place. The beneficiary did not receive my payment for more than a week, wherein I have received the confirmation papers from HSBC about my debits. I thought it’s a problem with beneficiary account and was in confusion. I waited for few more days but the situation was same, beneficiary lost the trust on me which I promised them to help on his emergency. They thought I did not do any transfer and I am just saying. I thought they have received the payment and they are kidding me. Later the situation went worst with multiple arguments between us. And I was really ****ed off and called HSBC on 8th September and I got to know my payment was kept on hold for some review. And I was completely upset and disappointed because of the bank issue it had created lots of problem in my personnel life. I explained them the situation, also I have questioned them why it was not informed to the customer when they keep their transaction on hold and there was no proper response from them for my queries. The customer executive promised me someone will call from payments team within 24 hours as this is an emergency transfer. But nobody had called me within 24 hours from the time I called them. I hope they tried to reach me after the timelines that they have promised to me but I couldn’t pick that call. Later no call back from them and emails from them. By this time I have lost my peace and my reputation was already spoiled with my people, as I couldn’t help the emergency situation; I couldn’t keep up my words and promise, Moreover my relationship bond with the beneficiary was broke because of this. I was completely upset, mentally stressed and hurt. Even after a week later there was no update from bank, I called them again on 13th Sep the situation was still the same, and they collected some information to proceed with the transfer. I have given all the information they wanted from me. That time my only intension is to prove the beneficiary that I really tried helping them. After providing all the information to the bank I requested them to release the funds as quick as possible. But no luck with that calls as well. I have called the bank again on 16th Sep (not sure on this date) to check the status and it was told by them the information’s that they collected from me was not good enough to release the funds, which made me mad. I questioned them then why did they collect those and when they feel it’s not good enough why can’t they collect the required information, but again no response. Later I told them to cancel the fund and put the money back into HSBC Advance account which got credited on 20th September. In between I launched a complaint also in HSBC around 13th Sep and I got a response for that complaint on 6th October 2016 almost a month later… Meanwhile I have arranged the funds in India through different source by paying the extra excess interest. And for almost a month I was mentally stressed because of the problems I had with the beneficiary as they are very close relation with me. I was fully upset and couldn’t concentrate on work or anything, which could have led me to life damaging event. And to solve these issues I have travelled to India on November by taking leaves.. And I have filed complaint with Ombudsman in November regarding this. After collecting all these information and multiple reviews they have come up with saying 250 GBP can be paid as compensation. But before even filing with Ombudsman, HSBC staff called me and tried to convince me with the compensation of 30GBP, for the situation that I have been put through because of their mistake. I detailed him because of the bank mistake what all issues I have faced and moreover I have arranged the fund in my native to help the beneficiary by paying extra interest money along with the principal fund. Then he tried to convince me by increasing the compensation by equalising with the extra interest I paid in my native, which is 120 GBP. I did not accept. But Ombudsman Took almost 9 months to drive and finalised 250 GBP, which is not fair. Here no body has considered because of bank mistake how much it impacted one personnel and professional life which has put them on mental stress, loss of relationship, loss of reputation, more I have spent extra amount on arranging funds in India, I have travelled to India on my own cost, I have used my vacation leaves for this purpose, I feel all the above factors to be considered for compensation. I have spent almost 350 pounds for my air tickets, 242 pounds as extra interest in India, ten days of salary 1000 GBP, so total of 1592 Pounds I have spent for fixing the issue, But the pain I went through for that duration, which damaged my life with loss of reputation, loss in relation, mental stress, all these are to be considered. Please advice on this

  24. I bought a car from stoneacre in 2014, i have 3 year warranty with vauxhall until september this year. My engine has failed on the motorway with no warning at all. We have had the car serviced and the book is stamped. However we lost our invoice, the garage cannot provide an invoice due to not having it on their computer system. genuine parts and oil was used. Now vauxhall are telling me that the engine wont be repaired under warranty due to not having an invoice however the book is stamped. can anybody advise me on what to do? thanks!!
