  1. Received my DSAR from CitiFinancial re; platinum credit card taken out in 2003. received copies of statements and original application form, which includes a ticked box for "Cardholder Repayment Protection" which statements show I paid an average of £20 per month , is this the same as PPI?? I cannot remember asking for this. the statements also shows numerous Late Charges and Overlimit Charges for £20 a time. Also, £5 charges for cash advances. Many advice would be welcomed.
  2. Following on after a successful request for PPI refunding from Citi Cards (hello Paralegals ) - http://www.consumeractiongroup.co.uk/forum/showthread.php?433020-Hillards-v-Citi-Cards-(PPI) They have been kind enough to send me a cheque for the PPI and a large part of that is being reserved for potential court fees as I am now moving on to reclaim charges that they made for 'Late Charges' and 'Overlimit Fee' entries on my account between 2003 and 2006. 32 entries, starting at £20 each time, increasing to £25 each time then down to £12 following the OFT report in April 2006 - https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/284445/oft842.pdf I have previously made similar claims for charges against other companies and have gone to court when they have told me to 'go away' when asking nicely. I've not had a failure yet, feel free to look at my other threads Part of my POC states "I do not accept that the Office of Fair Trading report of April 2006 deemed £12 to be an acceptable charge, as it clearly did not. Many of the charges being claimed exceed this amount. " I am at that asking nicely stage and will be sending a letter to Citi to request that they refund the charges they made, totalling £730, with interest. I fully expect them to say 'no, go away', but I have to be seen to be taking the correct steps. If/when they say 'no', or if they do not answer within the time limit they will be given then a letter before action will be sent and if they still refuse then I'm happy to go to court. £730 plus interest: the interest would be at their own rate of 31.80%, as they applied to the credit card account. This is currently just over £10,000 using a copy of CISheet v101 Obviously, this is not going to be resolved overnight so I've created this thread to keep track of progress, and so that others looking to do similar can see that it can be done, you just have to persevere and let them know that you are prepared to stand up to them.
  3. I did a SAR to Citi and they've sent the info, although they have duplicated quite a few months statements for some reason, not by accident, they have ascending page numbers. I'm about to send in a PPI claim and have taken note on other threads that Citi have refused to uphold claims on cards taken out pre 2005. Mine started in 2002 and was closed in 2006. The application form clearly shows that I was self-employed at the time and I was not told anything about suitability of the policy or alternatives, those are the grounds I'm using to make the claim. Total PPI paid was £252.76 and the StatIntSheet101 gives me a total of £200.72 at 8% so that's £453.48, of which I'll have to donate £40.14 to the taxman. I've no idea what associated interest there would be, so that's to add in yet. I'm just sending the FOS sheet to them, let them work it out and make an offer, or refusal. I noted somewhere that a letter to the CEO was required - if anyone can fill me in on the details please ? I think I may need to do the same if they play silly beggers.
  4. Hello Today I received a county court claim form from Northampton court. It is regarding an alleged debt from back in 2008/9 with Citi Financial for which Cabot was assigned the debt in 2010. I have read a lot of threads and understand I need to acknowledge the service online with the court and say I wish to dispute the whole amount asap which I will do this evening. I also understand I may need to send their solicitors Mortimer Clarke a CPR ASAP. in early 2013 I sent Cabot/Citi a CCA request and a £1 cheque. I have not heard anything back since. The cheque has been banked and the CCA was sent recorded royal mail. Considering this fact would the above still apply (CPR request). I am quite confused on what I should do next. Can anyone advise? Thank You in advance J
  5. Can anyone help me make a claim for PPI or do they like to call it CRP on a old ex Associates Citi card account whats the best thing to do where to start any help would be great i no longer have the account, got rid of the card, shredded the statements but have the 17 digit number i'm even confused about the 17 digit number do i miss the last digit off ? Jay
  6. Hi everyone it is my first time posting so I hope I am on the right forum. We have been paying a secured loan with Citi for years (2006). In 2009 it went to a suspended repossession order and since then we have never missed a payment even though it has been a struggle. A few weeks ago I received a handful of annual statements from them but did not really know why they had sent me them all in one go. On Saturday 4th January, we received the following letter: Account number is **************** Further to our recent correspondence regarding annual statements we would like to advise you that due to our failure to supply these statements in accordance with the Consumer Credit Act 1974 we have refunded all interest and fees accrued during the period of non-compliance 01/10/2009 until 30/09/2013. The breakdown of sums refunded to your account is as follows: Interest £7880.20 Fees £981.13 The current balance of your account after the refund is £211.27. Citi had a phone number that you could contact if you had any questions, my husband rang them but they have refused to deal with us, and have told us that we must deal with their solicitors (Wallers, very rude people) as that is where our account is, he rang them and we were told that the 211.27 is not our final amount and we have to request a redemption figure and it will take 7-10 days, they won't tell us how much it is, and I am very concerned that it is going to be an amount that we cannot pay in one go and we end up back in court after all this time. We rang Citi again but they will not say anything but wait for the redemption figure. Maybe I was naive to think that if we paid the 211.27 that was it, as that is all the letter says. Any advice would be appreciated. Thank you
  7. Hi guys, Following various advice gained on here I have recently received Statements and as far as I can tell other useful details of PPI payments to the above account (prior to cancelling in 2003) and also details of all charges ranging from £25 down to £12. These I understand can now be reclaimed for payment to me as the defaulted debt was sold to Cabot some time ago. There is a reasonable amount of about £1500 for both PPI payments and charges and I understand that I can claim interest on both PPi payments and charges but not sure a which rate to claim. Any advice would be much appreciated.
  8. HELLO ALL, TWO OF MY DEBTS (FROM CITI AND EGG) WERE BOUGHT BY DLC. I TOOK ADVANTAGE OF THEIR 90% DISCOUNT ON CITI DEBT AND SETTLED ACCORDINGLY. WHILE THE EGG ONE IS STILL UNDUE, THEY MADE ME AN OFFER OF 75% ON EGG BUT I DO NOT HAVE THAT MONEY SO I AM STILL PAYING THEM £1 PER MONTH. I STARTED DEFAULTING ON THEM IN 2006. I AM NOT SURE WHETHER I ASKED for a CCA file or not but all of their correspondence mention the original creditor name. So far I have been advised by DX to send them a CRA file. Which I shall do as soon as my printer is fixed. A new development is that none of these appear on my Equifax credit file any more. Do they still have enforcement powers as I have been paying them a statutory payment for each account. They have offered discounts in the past. What should I be doing meanwhile, apart from the CCA file? And while I am asking for CCA file, should I keep paying? Thanking you in anticipation. P.S: BTW ARE DLC, ROBINSONWAY, BRYAN CARTER, LOWELL SUBSIDIARIES OF THE SAME COMPANY? ARE THEY CLOSELY CONNECTED ANYWAY?
  9. Just wondering how I would go about making a claim regarding the PPI on a loan I took with the above. We took out a loan probably 7 years ago (we're on a repayment plan at the minute so no SB) and there is PPI on the loan. We needed the loan as we were quite desperate as we needed some things in preparation for our 1st child. The reason I'm not sure on how to go about it is because it was sold to us when the woman doing the loan told us that it would increase our chances of getting the loan as the providers would know we have it in place if we ran into trouble. As we needed the loan we agreed to it. How do we prove this? Just to give you an idea of the people that worked at the branch, when I ran into trouble the same woman would ring me quite a lot trying to make me take on a loan with someone else to pay the debt off and the branch manager made an unannounced visit to my address whilst I had visitors and spoke quite loudly so that the others would hear my details. He was quite intimidating to be honest. Sorry if there are similar threads, I did try to search, but I don't use this section often as this is the only loan I am 100% certain they have mis-sold the PPI on. Thanks, Lee.
  10. I opened a credit card with The Associates some 10 years or so ago. Subsequently they were taken over by Citi Financial and more recently by OPUS. I have contacted CPP to request a fee reclaim but they told me that it was nothing to do with them as I was referred to them by The Associates! They are no longer in existence so I contacted OPUS to reclaim and they said it ws nothing to do with them and I was to contact CPP! I'm being passed pillar to post here - has anyone got any ideas as to who should take ownership of my request/claim?? Thanks in advance.
  11. Hi, Can someone give me some advice please. I had a Citi credit card up to about the end of 2005 and I owed about £3800 before getting into difficulty. In 2006 It was passed to Cabot. I have been paying about £40 - £60 per month up until 2007 via CCCS and then £20 directly to them from 2011 to now. According to the CCCS the interest was frozen and I estimate that I have paid back approx £2500 - 2800 (I will work this out more accurately in due course). I have just had a statement from cabot (1st one ever!) saying that I owe £3800!!! What should I do? Thanks SBG
  12. Hi all, I have today received my second SAR out of the 12 that I have requested from various companies (not good seeing as I started back in March!) Anyway, this one form Citi is very vague, only statements and a sheet showing application information, no agreement. It says on there that i requested PPI which is bizarre because I wouldn't have and also on my statements I had 6 months interest free and that is the only months I have been charges PPI for! once I started paying interest the PPI stops. Second question is as this SAR is so limited I am unsure if I ever attempted to reclaim the bank charges from them. Shall I: A) write and say SAR is inadequate (although I have everything I need for PPI bar my agreement but I know I wouldn't have asked for it anyway and the interest free period is a good indicator that they forced it upon me for that period anyway to make up for loss of interest) or B) just whack in another claim for charges seperately and let them figure it out if I already had a refund?? Not sure which is best route to go down, I genuinely don't know if I did or not! Thanks
  13. Hi everyone. I have cabot chasing me for £750 from a Citi credit card and I have no idea of where it has come from. they would not give me any details, so I have reported them to the FO, but they say that Cabots records show that i paid money up to 2009. I have asked Cabot for proof (signed agreements etc) but they have ignored me. They have even ignored letters that I sent saying that i have lived at my present address for over 6yrs and never seem anything to with Citi until they started writing to me 18 months ago. The FO have just sent me a statement from Citi which cabot sent them as "Proof" but it looks like my grandson could have done it and it also has my parents address (I haven't lived there for 28yrs!!). The FO are saying that unless i have any other proof that it is not my debt then the won't stop them bothering me. I did have some paperwork from debts from my 1st marriage but they went a long time ago so i can't even check through them. I did pay off a couple early and got a discount. I know that Cabot buy these things in bulk and i am worried that one of these has found its way to them. There is nothing on my credit file about this at all. Cabot say that they have the account number that monthly payments were made by but haven't shown them. Does anyone have a copy of a 2004 citi statement this i could see please? I am at a loss for what to do as i don't really want to just hand over £750 regards JB
  14. I had a credit card with Citi Cards for a few years, no great problem - low balances no great issues on payments etc. I was informed by Opus that they were taking over the account from Citi and all payments and contact had to be directed to them. My first payment was due in December 2010 and was a few days late because I had to set up the payment details with my bank however they did not make any charges for this 'late payment'. My second payment was due on the Bank Holiday Monday for New Years Day which was the 3rd January 2011, I made a 'Faster Payment' via my online banking on Sunday 2nd and I was advised that the payment had been received by Opus' bank, however my payment was not credited to my account until 4th January - a day late and of course they presented me with a £12 late fee. I contacted them shortly after receiving my next statement detailing the fees and spent close to 30 minutes on my mobile 'phone talking to several undesirables about this and they all refused to budge. My bank, Halifax, has confirmed to me in writing that the payment was made successfully. Ironically both Halifax and Opus are within the HBOS group! Subsequently, I have made all my minimum payments to them LESS the £12 fee and LESS the £12 below minimum payment fees they have given me every month since! I have put my case to the FOS and they have responded that OPUS is not required to refund the charges, with no explanation of their decision whatsoever. I plan to take this matter further, but how? How do I stand on this one guys?? Any advice is appreciated.
  15. Well, took out a loan with CTI as they were in 2003. They made us take out PPI which we didn't want so I contacted them this year to say that it was missold. They did not get back to me so took it to FOS and they have just written to us to say that CITI are willing to send us a goodwill offer. However, the FOS did say that they have not looked yet to see if this policy was missold! CITI sent me a letter offering a max refund of £8037, which sounds good but want to check with people on here who know what I should do. CITI say it is a max refund of upto that amount but they want to see the paperwork first! So, is there a chance that they will offer me less? The policy itself was £6189 and it was paid off when we finished the loan in 2004 when we remortgaged. There is small print which says that they PPI premium must be paid in full when the loan is finished early, which it was. Should I take CITI's offer even though it may be less than the max they have stated. Also, according to FOS guidlelines, they should be adding on interest of 8% for each year so surely I should get the policy premium back plus the extra 8% interest on the premium which would be for 12years. I am really confused and don't know what to do so if anyone could help I would really appreciate it. Thanks x
  16. sent request on 15 May to Citicards for an ex-Associates card i used to have. received standard reply dated 24 May that they will look into it and get back to me. passed to FOS on 13 June who said they will allow Citicards 8 weeks. Corrected this as i'd sent my request on 15 May and 8 weeks expired 7 July. received letter from FOS on 17 Aug that it's being allocated. received letter from FOS on 5 Sept that the adjudicator has written to Citicards. received letter dated 13 Sept from Citicards solicitor which basically says : they disagree with the OFT's interpretation of 6 April 2006, that the OFT stated the fees were not unlawful, just unfair, that they were, and are, entitled to levy a default fee, just not one in excess of £12 (they charged me £25 each time). they say i am suggesting their client owes me money, but the account was charged off, that i owed more to their client than i am asking, so to refund me would allow me to profit from my default, if i have paid a third party (debt agency) then i have no claim with their client (i am not claiming that i want charges paid to a third party), that in over 2 dozen cases Citicards has successfully argued the fairness of £12 (forgets that they charged me £25), that the court has endorsed their view that you cannot claim charges from a debt that has been charged off, that they will ask for the case to be heard in Salford (no problem, i drive and can add costs), as a background, the account was sold to Cabot who say they are not the creditor. any advice please as i have not dealt with Citicards before.
  17. Hi,Hopefully someone can shed some light on this. After reading many posts on here I decided to take the plunge and try and reclaim my ppi from CitiFinancial. The loan finished around 6 years ago and was originally with another firm (currently I can’t remember the name. Maybe Associates??). It was then consolidated into a Citi loan. I think the loan amount was for around £7000 and at the time I had bad credit and I remember paying a ridiculous rate of ppi.I have no account numbers so I decided to send them a SAR using the template on here. After weeks of waiting for a reply they responded with a letter stating that I needed to prove who I was. I sent them copies of the required documents and waited……………. After nearly 4 weeks they sent all the info they had on me (allegedly). All they sent back was the letters I had recently sent and what looked like a hand produced spreadsheet containing the last 10 payment on the loan. They also stated on the letter that they couldn’t find the application form linked to this account number!!Is this the end of the road for me? Or just simply another stalling tactic??Any advice appreciated,Dylan
