  1. I naively filled out some PPI claim online Pemberton Associates ages ago, gave all info I had to hand. “Electronically” signed all documents. Was sent something in the post which was lengthy, eventually completed & returned. Cut a long story short but I started getting A LOT of emails from this company. Regarding all sorts of things, claims against pay day loans, claims against all sorts of things, there was that much I lost track. I was only ever really interested in PPI and I assumed everything I filled in was to do with PPI. I got a final response saying once they’ve checked my credit history there’s only two companies I could claim against - one being a mail order company (which I owe a mere £80 and the other being my current account, which at the time was overdrawn) I replied saying I didn’t really see the point in perusing a claim against these for the reasons above. To which they agreed. I then started getting emails regarding some payday loan I took out a while back, asking me to send them a copy of some letter. I had no idea what they were talking about and told them this, on top of the fact my balance was zero I didn’t understand why they were looking into it. Fast forward a few weeks and they’re now saying I’ve breached the contract and that i’m Liable for cancellation fee’s if £360 for each company they originally persued (sure there’s about 12 all together) The guy who was emailing me was horrible, very threatening, making out like I was lying, saying they’ve now realised I’ve breached the contract for a second time as I’d not returned documents (this isn’t the case - I’ve returned everything I’ve received) I was getting no where with him, ended up leaving a lengthy yet honest review on trust pilot to which he replied saying if I didn’t remove it they’d sue me for damages. Cut a long story short he reckons he’s issuing court proceedings first thing tomorrow. He’s literally not left me alone all night, threatening all sorts, telling me I am liable for court costs on top of the damages and fee’s already mentioned. Apologies for any spelling errors, currently in the middle of something & frantically trying to explain myself on my phone! Any advice greatly appreciated!
  2. I had a credit card in 2002 to 2003 with The Associates and they were later taken over by Citibank but during the Assoicates time, 2002 I had PPI on the card. Can anyone tell me please where I would send my claim for a refund on ppi. I was self employed in 2002 and was mis sold the ppi. With the letter for a refund do I have to send a copy of the financial ombudsmen questionnaire? Also can I send the form to the financial-ombudsmen on line? Appreciate any help you can give me.
  3. After lots of reading and research, I'm going to attempt to claim the PPI for a loan that I took out with The Associates, before they became a part of CitiFinancial Europe.A I was a student at the time with, two young children aged under 3 at the time. It was the first time I'd borrowed money and I took the loan out to help pay for their nursery fees after a mess-up with my Student finance. So glad those days are behind me now! They have recently paid out PPI for a credit card that I had with them. They stated that they couldn't find any details of the loan but would look at it again, if I sent them documentation relating to my account. I did - I found my credit agreement, a statement of account that showed all the payments that I had made on the account (bar the final one). I also found various letters that showed the Associates account number and the account number when Citi took over. I even have a letter informing me of the "exciting change" of their name change from Associates Capital Corporation to CitiFinancial Europe PLC, on 11 April 2003 Despite all this irrefutable evidence, they will not investigate my complaint any further as they cannot locate my account on their system. As the loan was taken out in 2000, it is out of scope for the FOS. Therefore my intention is to issue a claim through the small claims court. I'm going to need some help with calculations. This is because I have read about 4 different ways of calculating the redress and it's doing my head in! My figures are as follows Loan amount = £1050 Insurance = £400.17 Arrangement fee = 75.00 Interest rate was 3.020% APR 48.8% Any suggestions and/or help with calculations will be appreciated. I've had a stab at it and will post up what I've done shortly. Thanks in advance CAG family!
  4. Hi..... Just a quick question. I have just been going through some old bank statements trying to find an old Humber Finance payments as I'm sure I had a loan with them. I have instead come across Associates Capital loan payments....from 2002. Am I to understand that CITI financial is Associates Capital? I have already claimed back PPI from CITI from loans in 2007 but i don't know if the loan from 2002 was part of my claim. Any ideas please. Thanks.
  5. Hi everyone, Please can anyone advise how I might make contact with this firm (which I think has been "taken over") and claim for mis-sold PPI, as I took out a £14,000 loan from them a good few years back and was told I had to pay for PPI or the loan would not be granted (they said they wanted to be sure they would be repaid, whatever happened to me and/or my circumstances). Also, I was self-employed so probably couldn't have claimed, anyway. But I have no paperwork, anymore. Thank you. Jib
  6. My partner took out a associates credit card in 1997 when he was self employed. He has received a refusal letter today saying that whilst we do not accept all of your allegations we do acknowledge that there may have been flaws in our sales process. However, despite this I am not persuaded that any of these sales failings would have affected your decision to take out the PPI policy. This is because taking into account your circumstances at the time of the sale which are disclosed in your questionnaire, it is clear that you had no means at the time of protecting your card repayments. You also stated that you did not have any other means of making your repayments if you were unable to work through sickness, accident or unemployment, as a result I am not in a position to uphold your complaint and it has now been closed. Anybody any ideas where i go from here? Any thoughts would be appreciated
  7. Hi, Here's one for you. I work as a freelancer. In June last year I agreed to work with a business, the deal was that I would sell my services through their brand and receive 60% on my billings, for months when I did not bill, I would receive a cash payment to tide me over. I signed an acceptance of offer letter with them and started working with them at the beginning of July. All went well and I quickly secured an opportunity to deliver some highly complex services to a large business I know well. I was concerned at my associates capability to support me with delivery and asked them if they wished to be involved. As the business would be worth several million over a 5 year period they readily reassured me. at this stage I pointed out that if we were going to bid for the work, it would have a significant impact on my short term sales. They told me not to worry. By Mid October, I had spent 6 weeks preparing the initial bid, the timescale with the client had slipped to early 2015 and I informed my associates, this time I offered them the choice of backing out of our relationship if they no longer wished to take the risk of supporting me whilst I bid for it. Again, they reassured me that they were very keen to remain involved and supported me 100% as well as thanking me for my excellent work. Despite this I was beginning to get some pressure to generate short term income so I started to work on a few smaller projects. This pressure increased and I began to have concerns around their capability to deal with a large and complex project especially from the financial perspective as the concerns seemed to indicate that cash flow may be an issue. On 30th November my invoice for October's work was due for payment. 3 days later the money had still not arrived so I wrote to them asking if they had processed the payment and received a cryptic reply along the lines of 'what was due to be paid has been paid'. a week later still nothing. At this point they started to demand information about my clients which was above an beyond the call of detail. I said i wold be happy to share it once their outstanding invoice had been paid. I chased it on two further occasions and was told by them that it was due to be paid and in the process. Again they asked for the detailed information, again I told them that once the outstanding invoice was paid, they would get this information. At this point they showed their true colours. I received a very aggressive email from a the other owner of their business stating that he had 'blocked the payment' because he was unhappy that I had not provided details that I was 'contractually obliged to provide' he then went onto libel me saying he had received information 'concerning me and my character' from 'anonymous individuals' . This email was shared with e 3rd party. I immediately wrote back stating that I did not respond to threats and that the email was libelous as he had not provided the information that he was party to nor had he identified the source - merely implied that it was negative and that he also shared the email with a 3rd party (which he did). I also pointed out that until Monday this week they had not shown any concerns over the quality of the work I had done to date, quite the contrary I had emails from them as well as two telephone conversations (recorded) where they praised my work to date and thanked me for it. I also pointed out that they had accepted the invoice and had been asked on 3 separate occasions where the money was and had on all those occasions been either directly reassured or reassured by implication that all was in hand. The response to this was to send me a copy of some terms of business which I had never seen and which were dated July (I had signed in June). They stated that I was in breach of contract because I had - a/ set up another similar business outwith their arrangement with the intention of 'cutting them out' (this business predates the relationship with this company and I have always been public about its existence, on twitter and on Linkedin and the business offers services that are in a similar field but completely unrelated to the business I had with the associate. Additionally the associates were well aware of the existence of the business and had never raised it as an issue in the past.) b/ in witholding the detailed client information they required I was in breach of their contract (the terms of business that I had not seen before). These state nothing about information and only state that if they deem that (unspecified) work is no carried out to their satisfaction, they can pursue me for all money paid to me prior to the date. I wrote to them informing them that I had never seen these terms before and on top of that had never been given any previous indication that my work had been substandard, in fact I had received plaudits for the quality of the work. The reply I got was to 'stop playing games' and that I had 'signed the contract and the terms in July (I actually signed it in June) and that I was bound by it. He also directly accused me of lying and shared the email with two 3rd parties. at this point I had had enough and informed them that our business relationship was over due to non payment of invoice and that I was handing the matter over to a debt collector. They wrote back again telling me to 'stop playing games' and accusing me of breach of contract and demanding that I repay them all money paid to date and returned a laptop by tomorrow (friday) or they would report me to the police for theft. - Since then (tuesday) I have received several emails asking me what I intend to do. I have not replied. - Now I did some checking up on these guys and don't like what I hear. The partner I appear to have fallen out with fancies himself as an amateur lawyer and his emails are full of faux legalese that doesn't make much sense at all. (My late father was a judge and I have a pretty good understanding of what this looks like). It appears he spends most of his time logging online claims through the small claims court so I am concerned that he is going to attempt this tomorrow. Now my reason for posting here is to get a 3rd party perspective on this. I intend to do the following: 1/ hand the debt to a debt collection business and instruct them to pursue it in writing as well as verbally 2/ I have written down the entire sorry saga as best as I can recall and tomorrow I intend to visit a commissioner of oaths and swear an oath on it and post it to myself recorded delivery 3/ pay my lawyer to write a cease and desist letter to the individual who has libeled me threatening him with action if he does it again. 4/ I am considering reporting them for fraud over the 'terms of business' which I had neither seen nor signed My main concern is 2 fold - 1/ to ensure that should he attempt an online small claims bid his claim will run into deep water quickly due to the defence I have and the counter claim. 2/ to make sure I can prove to the police (should he report me for theft) that the matter is civil, that return of the computer in question has been given an unreasonable timescale especially at this time of year (48 hrs) and that as it is a civil case and I am owed money by this business, I have a right to hold it for security and have indeed informed them that I would return it once the invoice was paid. Are my tactics sound and is there anything else I can do? I have limited funds for a fight? Research and having spoken to several people who have carried out the work I have done for them in the past shows that they are not to be trusted and I have heard similar stories. They are very foolish in acting in this way because I am very well known in the industry they work in and could make life very difficult for them in the future. I have not done so yet nor have I threatened them. thanks in advance
  8. Hi I was wondering if someone can help please. I have been trying to claim PPI refunds for my loans that I have with the Associates (Capital) Jersey Ltd. They date back as far as December 1999. I have 2 original agreements, and the rest are R62 forms on Associates Capital letter head. The R62 forms were requirements for tax returns in Jersey. They quote the associates account number and the amount of interest paid for that year. I have been sending letters for the past 2 years and have had no luck whatsoever. I believe The Associates were taken over in 2001 by Citi Financial Europe PLC, and therefore would have taken over their loan book at this date. I even have a letter from CitiFinancial (Jersey) Ltd which quotes the associates account number. This was dated February 2004 Citi Financial say they can't find my details. On several occasions I have sent them passports, bank statements etc proving my name and address. I have also requested information from them about my accounts by providing all of my addresses I lived at in Jersey. I have rung the only number that seems to be provided and end up talking to a call centre in the Philippines who say they can't put me through to anyone and to write a letter. I have written several and I am just not getting a conclusive outcome. I have also tried emailing the crt email address, and even though the email doesn't bounce back I never get a response I have also tried the Financial ombudsmen and they say they can't help as the loan originated in Jersey even though it was taken over by Citi Financial it is out of their jurisdiction.. I now live in New Zealand so it is now proving a lot harder to communicate. I am thinking about sending a courier to the CEO of Citi Financial because apparently registered delivery you can't trace. It will cost me about GBP30 so I hope this works Any suggestions would be greatly appreciated many thanks Sharon

  10. Hello, Today I checked my credit report with noddle (it's free) and I noticed I have one default account which has been registered with PRA. Concerned I checked Experian and there is same information. Both of them are relating to my old debt with QQ which has been taken over by Mackenzie Hall. I settled this debt in 2011 and I've requested a confirmation letter from MH, which I still have a copy of. I was working really hard over last 3 years to build my credit score once again. Could you please help me what should I do and how should I deal with PRA. Dates and ammount on the letter and credit report are exactly same. Also I am 100% sure I've settled all my debts from the past. Thank you
  11. Portfolio Recovery Associates contact me by telephone every few days. Most days it's an abandoned call with up to 45 seconds of silence before the recorded message kicks in (that's been reported to OFCOM) but today I spoke to an actual person, something that happens maybe once a week. Every time I talk to someone there, I do the usual refusal to go through the security questions and advise them to put it in writing. I have as yet, received nothing in the post from them. I asked the caller to have a look at my file on her screen and tell me how many times they've written to me. Once, was the answer, in March. I didn't receive this. I asked why they hadn't written since, when I had asked every operator I spoke to to put it in writing. She claimed that they are unable to send me any contact by post until I confirm my address, postcode and date of birth by telephone. I asked her to confirm that this is correct and reminded her that, according to her, the call was being recorded for training and monitoring purposes. She got quite flustered but repeated that they are unable to do this. This can't be right surely?
  12. I had a loan with Wonga, which as far as I am concerned,it is paid off.I have the receipts of payments made. But last November,I made my payment into Wonga's HSBC account, only to find out at a later date, they had changed to Barclays. After numerous emails to them (not replied to) and phone calls, they could not find the payment. So I sent them the computer print out of the transaction in the beginning of May, which HSBC gave me. My last payment to them was in February. I have just checked my Wonga account out of curiosity,to find this ........ IMPORTANT: YOUR DEBT HAS BEEN LEGALLY ASSIGNED TO PORTFOLIO RECOVERY ASSOCIATES U.K. LTD Then, there was something about payments to be made to this company and a letter will be sent to me. Do I email or phone Wonga, or do I wait until Portfolio contact me, then send them the computer print out. Regards,John.
  13. Hello all, I recently paid for my girlfriend to go on a counselling course starting this September with Karen Grant Assosiates Ltd of Brighton. After paying the money a month or so ago and recieving a receipt, my girlfriend recently decided the course wasn't for her and decided to cancel and asked for her money back. Her email went unanswered for a week or so, and so she phoned. She spoke to Karen Grant herself and Karen brushed her off by saying she had read the email and merely forgot and that she would refund the money. So we waited another week and still no refund. My girlfriend then phoned again and was told by an apologetic Karen that her business had gone into liquidation and that we would have to wait 2 or 3 months before getting our money back. Now their website has gone offline... 1. Can we believe her? 2. What guarantees/assurances can/should we seek? 3. What are our rights to legal recourse? Many thanks for your time and help, Colin and Izzy
  14. Hi, I am trying to help a family member to sort out old PPI on AVCO (associates) loan. I did send for SAR and they say there is nothing (the loan was paid in 2000). I have all the bank statements showing payments to AVCO and closing account statement with a small PPI rebate. I need to figure out what was the ppi amount on the agreement. I believe that the amount of PPI was pretty much a standard percentage of the loan amount. May be someone had the loan at the same time and have an agreement with figures? The APR interest at the time (loan taken in 1994, another one in 1998) would also be very helpful. Thanks in advance
  15. Hi in 1999 i needed a new car not having a brill credit rating we went to associates capital after producing reams of paperwork and waiting ages we got a car apparently within our budget we were there for hours and totally fleeced into signing for an agreement with associates agreement in joint names with ppi ( in one name only) and mechanical breakdown. The agreement ran for 30 payments roughly £180 per month about £70 a month was just the insurances plus the interest we eventually voluntarily terminated the agreement. I have the account number, details off credit report and have done abit of research and am i right in thinking that i need to address my claim to the citigroup at canary wharf is this account too old to claim on as i can remember lots of details about the sale to put on the form and i have the total amount of the agreement from the credit report. TTS
  16. Both my husband and I had old Associates card's which were later taken over by CitiFinancial in April 2003. Both accounts have Unfair charges applied to them throughout the duration of the accounts and both accounts are over 6 years old. FOS have accepted there is no case to answer to due to the time limit but I have decided to take them to court for them having had success with our PPI claim with them at the end of last year. I have gone through the website with fine tooth comb to locate an upto date version of PoC suitable for the purpose but cannot find one. Would someone kindly point me in the direction please? Appreciate your help
  17. Hi guys I took a loan out with Wonga last year and then came out of work after i paid at least 40% of the loan back as that's all i could afford after i got my redundancy pay with other commitments. So they referred my debt to Mckenzie Hall DCA and they did nothing but hassle me with letters and bombard me with phone calls until i downloaded an app and blocked there calls full stop. Then i started receiving about 3 or 4 letters a fortnight with court action blah blah. So i emailed McKenzie Hall and told them im out of work here is a copy of my JSA Agreement all your getting is £1 a month until i return to work, sadly i am still out of work and kept up the payments until something comes along then ill increase my payment to clear the loan. I heard nothing for about 9 months until 22nd November 2013 with a letter now from Portfolio Recovery Associates so again now im going through all this hassle of chasing there sort code and account number as they have told me to continue paying the payment plan, i shouldnt have to mess around like this as now this is the 3rd time Wonga has gave this debt to someone else to recover and im getting sick and tired of it. Also 9 months ago Wonga offered me a £500 settlement figure which i said was fine and asked if they could reduce the debt to that and id continue to make payments and i would settle it once obtained employment they basically shrugged off my email and when i went higher up to the CEO they said they had no records of this email being sent to me sadly i lost my email account after cancelling my virgin media services so had no solid evidence to support it what is the purpose of these Payday Firms keep changing there recovery companies do i sense something fishy ?
  18. Hi guys, Following various advice gained on here I have recently received Statements and as far as I can tell other useful details of PPI payments to the above account (prior to cancelling in 2003) and also details of all charges ranging from £25 down to £12. These I understand can now be reclaimed for payment to me as the defaulted debt was sold to Cabot some time ago. There is a reasonable amount of about £1500 for both PPI payments and charges and I understand that I can claim interest on both PPi payments and charges but not sure a which rate to claim. Any advice would be much appreciated.
  19. Can anybody tell me who is 'Associates Capital Corporation and if possible the address please. Thanks
  20. Would anyone have an uptodate address for the Associates Credit Card please.
  21. This is a weird one. Some years ago I applied for a ACC credit card. I sent off the info and months later I had a cheque book land on my doorstep addressed to me at some address in North London. But strangely it had had my address at the time written on the envelope. I telephoned ACC who told me that the card had also gone to this address. I was very concerned and asked them to cancel the card as I had never received it and had never lived in North London. They said they would cancel the card. This was way before I had dealings with CAG. I have never had a statement nor a letter from them, nothing. I now have a DCA chasing me for one unenforcable with Halifax which, because I have moved, I have to confirm I live here to do a prove it letter. And now I have them chasing me for £1113.58 of debt I never, ever used. Obviously I did sign an agreement to take out the card, but as I never had the card nor any statements, I wasn't aware the card was even active. It's one thing getting into trouble with debt, but completely another when the debt is in my name but not mine. Where on earth do I go from here? As a mute point the unenforcable Halifax debt is the second one listed dated 17/04/07 and I never had a CA and is no doubt statute barred, as I would think the ACC card is.
  22. Hi all, Can anyone help with this one? I had an old Ass card which I squared up in January 2003. I have contacted Citi, Opus, Citi, Opus, Citi, Opus.... you get my drift yeah... I am sure there were penalty charges on the account. How do I get the information back that far???? If it is a SAR... who and where do I address it???? Do I include any case law to force them to provide the information??? Thanks in advance Vaz.
  23. Hi there Does anybody know anything about these jokers. They called me today and stated that they had "confidential mail" for me and wanted to confirm my address. I told them to go forth and multiply. There is very little known about this so called firm on the web, they are supposedly based in Kettering but there is no info for them on Companies House, they have no Consumer Credit Licence or registered with OFT. There is another firm called Clear Associates Limited based in Slough, this is an auditing firm, so will probably have nothing to do with this outfit. The most distrubing thing is that they had got hold of my mobile number (which I never advertise but only to family and a close circle of friends) so they are allegedly using questionable practices to get hold of peoples details. I have behaved myself over the past six years and the only debt I have is to Welcome Finance which is due to become statute barred next month. Does anybody know anything about this operation? Many thanks jb000
