  1. It seems that every time we do a SAR on one company or another we find info about other accounts we had and paid off or were paying at the time. I've turned up a couple of old Capital One accounts that the wife and myself had in the early 2000's so sent SAR requests, one has arrived today. It seems that I took a card from them in 2002 and all they have on file is a little form about a quarter of an A4 sheet headed 'Credit Card Account Agreement' and 'Credit Agreement Regulated by the Consumer Credit act 1974'. The rest was difficult to read as it's badly copied small print. I've scanned and enlarged it. It's one of those 'sign and return' things, not a full agreement and certainly no mention of PPI on it. On their archive system they have given me a screen shot of a page about PPI but it says 'no data'. However, in the list of transactions it clearly shows PPI being paid month by month. On another form, I think from them setting up the account, it shows both PPI and PPI2 as 'Y' and a rate of 89p per £100. The other figure I'll note here is shown as 'Lifetime APR' and that was 37.3% !! Between 2002 and 2006 I have a number of PPI payments listed which total £466.75, ranging from 75p to £12.88 over the months. I know it does not work quite this way but, if I apply their own rate of 37.3% the FOSCISheet V101 spreadsheet adds in £19,506.41 of interest - that would be nice I'm sending them a completed FOS questionnaire to see what they say. There are also lots of late payment and overlimit charged of £20 each, but that's a separate claim. The account went into default in 2006 and was passed to a DCA in early 2008, so is now S/B for recovery purposes.

Following on after a successful request for PPI refunding from Citi Cards (hello Paralegals ) - http://www.consumeractiongroup.co.uk/forum/showthread.php?433020-Hillards-v-Citi-Cards-(PPI) They have been kind enough to send me a cheque for the PPI and a large part of that is being reserved for potential court fees as I am now moving on to reclaim charges that they made for 'Late Charges' and 'Overlimit Fee' entries on my account between 2003 and 2006. 32 entries, starting at £20 each time, increasing to £25 each time then down to £12 following the OFT report in April 2006 - https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/284445/oft842.pdf I have previously made similar claims for charges against other companies and have gone to court when they have told me to 'go away' when asking nicely. I've not had a failure yet, feel free to look at my other threads Part of my POC states "I do not accept that the Office of Fair Trading report of April 2006 deemed £12 to be an acceptable charge, as it clearly did not. Many of the charges being claimed exceed this amount. " I am at that asking nicely stage and will be sending a letter to Citi to request that they refund the charges they made, totalling £730, with interest. I fully expect them to say 'no, go away', but I have to be seen to be taking the correct steps. If/when they say 'no', or if they do not answer within the time limit they will be given then a letter before action will be sent and if they still refuse then I'm happy to go to court. £730 plus interest: the interest would be at their own rate of 31.80%, as they applied to the credit card account. This is currently just over £10,000 using a copy of CISheet v101 Obviously, this is not going to be resolved overnight so I've created this thread to keep track of progress, and so that others looking to do similar can see that it can be done, you just have to persevere and let them know that you are prepared to stand up to them.
  3. I did a SAR to Citi and they've sent the info, although they have duplicated quite a few months statements for some reason, not by accident, they have ascending page numbers. I'm about to send in a PPI claim and have taken note on other threads that Citi have refused to uphold claims on cards taken out pre 2005. Mine started in 2002 and was closed in 2006. The application form clearly shows that I was self-employed at the time and I was not told anything about suitability of the policy or alternatives, those are the grounds I'm using to make the claim. Total PPI paid was £252.76 and the StatIntSheet101 gives me a total of £200.72 at 8% so that's £453.48, of which I'll have to donate £40.14 to the taxman. I've no idea what associated interest there would be, so that's to add in yet. I'm just sending the FOS sheet to them, let them work it out and make an offer, or refusal. I noted somewhere that a letter to the CEO was required - if anyone can fill me in on the details please ? I think I may need to do the same if they play silly beggers.
  4. My wife had an Egg card that was paid off with a consolidation loan in 2006. We know there was PPI on it and are looking to reclaim. She sent a SAR on Feb 27th to the Brierley Hill, West Midlands address but had heard nothing. I keep finding different info. Some suggesting that Egg is now Barclays, which should mean she will get her Egg info back as part of a SAR sent to Barclays, that they've acknowledged but not yet sent. There's also an address in Worthing for Canada Square that has been put forward as the place to send SAR's for Egg. What do we do now ?

Following on from my PPI claim against CapOne: http://www.consumeractiongroup.co.uk/forum/showthread.php?432249-Hillards-v-Capital-One-PPI When I did the SAR they sent copies of statements showing charges for late payment and overlimit fees. These were from 2002/6 and started at £18 per item, went up to £20 and the last couple (post OFT) were £12. As advised on many threads, these are all unlawful penalties and I am now looking to reclaim them. The total amount of charges is £822.00. The interest rate they applied to my account was 37.30%. I've used FosCISheet v101 to individually enter all the charges taken over the lifetime of the account, put in the interest percentage and it shows me £18,884.16 Compound Interest as at todays date. That's rising by a daily rate of 0.1022%, which is currently £17.15 a day. I've read several threads on here about reclaiming charges but so many of them seem to tail off into nothingness where no action was taken. In my case the court costs to lodge a claim are £610, should CapOne refuse to enter into an agreement when asked to repay, as I fully expect. As CapOne saw fit to use an APR of 37.3% on my former account I am happy to use that in my claim against them. I have seen notes on other claims that 'Interest in Restitution' should be 29.9%, but can find no information as to why that should be, other than an estimate of how the finanicial institution involved would have benfited from the use of the money in the time they had it. As I have that APR figure in writing, from the SAR, I think it's reasonable that I use it. My formal request for repayment is on it's way to CapOne today, giving them 21 working days in which to respond before issue of a LBA. I've learned that it's best to set a deadline, rather than let these companies decide their own timescales. ;-) If anyone has any pointers to threads about similar claims, Capital One only please, I'd appreciate links. I've tried to find some but got bogged down in the sheer number of accounts with DCA's or where PPI claims are being made.
  6. I think this is going to be an interesting one. Over the years my wife has had various accounts with mail order catalogues and we recently did a SAR for Ambrose Wilson. JD Williams replied today to say they can confirm "...there has never been any payment protection insurance on your account...". It goes on to say they are sorting out the accountn info. The SAR said, as we always do, that she wanted details of ANY account she had had with their company. The Ambrose Wilson account was paid off in 2003 but I know she had Simply Be after that, and that one ended up with charges she disagreed with. I can remember having issues with (un)Reliable Collections.

This is all part of the same agreement, but needs to be dealt with away from the PPI it seems. Welcome tagged on a Mortgage Indemnity Fee and various insurance policies that I feel were unwarranted and certainly not explained to us at the time. Now we know the situation about PPI mis-selling, they could have slapped anything on and just told us to sign at the bottom. We were naive back then... So, in November 2003 we took out a loan of £12,000 at the local Welcome Finance office. The lady who saw us did all the form filling and ticking of boxes, we were just asked to sign at the bottom of the agreement. The loan was paid off in March 2006, so no debt involved to cloud the issue. We were charged £125.00 'Old Homecare', £175.00 'Old Lifecare' and a second £175 'Old Lifecare', plus £1,320 'Mortgage Indemnity Fee' On the 'Customer Declaration Form' the lady from their office had written at the top that the first named should be 'Mrs Hillards' NOT 'Mr Hillards' - Please send new form. They never did, and the SAR we sent resulted in them sending a copy of that form, complete with the notes that nobody actioned. !!! At the time I was self-employed so the 'insurances' were no good to me, they should have all been in my wife's name, PPI as well. Halfway down the form changes to the insurances where it shows we had 0 units of medicare, lifecare was ticked and a note '1st & 2nd app' at the side, homecare was also ticked. We did not sign this form, we were waiting for a replacement, they never sent it. That alone tells me the documentation does not support their side of things, if we didn't sign for it, why did they take it ? On another page of the documentation they show the insurances, with them all in my name - yes, both 'Familycare' policies are in one name, not '1st & 2nd app' as requested. So, I am about to create a new spreadsheet to detail these items, with the percentage of monthly payments and the final settlement payment - and send in a claim. Someone commented in my PPI thread, with regard to the MIF "Why anyone thinks the OP would be entitled to it back escapes me." - quite simply, we never agreed to it on the paperwork that Welcome still have on file. The form is not signed by us, but marked that it needed to be re-issued, which they clearly failed to do. On that basis I think we have a claim, if not for mis-selling then simply 'getting it wrong' and not sorting it out, as well as the form not being signed.
  8. Over the course of the years we've taken out a couple of consolidation loans to pay off old debts. Through doing a SAR on the loan we've discovered that we had had PPI on old credit cards. First we found one that was Monument and then an earlier one from Providian. Both of which are now under control of Barclaycard. Both accounts had been paid off in full and were mid 4-figure amounts, so not insignificant. We made contact with Barclays in January this year and they gave us complaint reference numbers, one for the original PPI claim and one for reclaim of unfair charges. On Feb 1st we sent a SAR with the cheque etc. to get the account details and statements, if possible, so we could see what we were claiming. We put their complaint reference numbers in the letter and made it very clear why we wanted the SAR. They wrote back to say they thought there was some mistake and we should contact them about reclaiming the PPI - this, despite spelling it out in the letter! It's now March 15th, allowing the couple of days for post to arrive, they've exceed the 40 days! J ust sending another letter to point this out, giving them only 7 more days before we take action. Amazing how quickly they wrote back, even returned the cheque, but then have dragged their heels like this... Yes, we did send the cheque again, with the original letter and lodged a complaint about being messed about. It was as though they'd not even read the letter. So, new thread created to follow the progress of this matter.
