Well, like you said you will be glad when its all over, and thats what the Abbey play one, just remember one thing, its not if you get the money back its when:D I am no legal begal, but I, like most on here, will help you in any way I can. Don't be shy, ask away. If we didn't want to help we wouldn't be on here..so no need for thnx, but they are appreciated. Once your bundle is sent off you can put your feet up for a bit. and make sure you mamange to get away and have some quality time... Have a lovely evening Reka x

  4. Did you use the office excel spreadsheet from this site, and is your pc running on XP? if so make sure microsoft office/excell is closed. Then double click on the time that should be showing at the bottom right of your screen in the taskbar. Change the date to the date of your court case. Open the spreadsheet and you will see that the amount of interest has changed. you need to print off 3 copies if you want to include it. I also recommend that you make sure the it says "Thissschedule of charges will be accurate on the xx/xx/xxxx (courtdate) only" once printed off, close excel/office, then redo the steps to set the clock back to todays date. hope that helps Reka

  6. erm, i replied in PM's, didn't you get it, it looks great, everything you need. There was only one other thing i had in my bundle that i found usefull, that was a schedule of charges that would be acurate on the day of the court hearing, its a subtle reminder to the Abbey what they will have to pay if they dont settle early, and very usefull if it goes to court to have the correct figures and interest accurate for that day (save you working them out or the Judge, may even get in his/her good books so you can go for wasted costs then

Please reply om that tread if you need them as i am getting lots of requests every day for them, and posting on that thread will bump it up...maybe it should be a sticky? http://www.consumeractiongroup.co.uk/forum/abbey-bank/101308-t-cs-nov-1998-a.html As was quoted above, i did not include any T&C's in my bundle and i won in court. The Abbey say in their defence (all defences i have seen) that the charges were as a result of breach of contract. You need to agree that you did breach the contract but that the charges they imposed did not relate to actual loss by themselves. Thus making the T&C's not necessary in your court bundle as they are not in dispute, its the amount you were charged that is, and untill Abbey disclose the information showing a breakdown of how much it "actually" costs them, then they are going to keep getting hammered. The T&C's are only a few pages long, so there is no harm in putting them in the bundle, although at this moment in time its not essential to have them in there. So i still say put them in if you have them, you never know what may happen in the future! (The above is just my opinion and not necessarily matter of fact)
  8. Jeeze, i don't know what to make of your experience, but if it were me i would make an application for wasted costs anyway, you have nothing to loose. And congratulations on getting the case struck out. If you want to quote my claim for wastage costs just PM me. Regards ps. 14days to pay you, if they don't then roll on enforcement!

  10. Wooo Hoooo!!! I have just spoken to the Bayliffs Office, a warrant was issued on the 22nd of June, as yet they have had no reply from the Abbey. I have the mobile number of the bayliff and am to call him tomorrow as he is off today.

  12. No worries, and remember to try and open a basic account, Nationwide have a great basic account like has been stated. If they say no (which is very doubtfull) she may want to concider a building society (eg Britannia) (oh and Tooo much info Hedgey tee hee)

  16. LOL! That was taken after court so people would actually believe i can wear something other than trainers, jeans and T-Shirt. I may have to wear it next week when the Bayliffs go into the Abbey on my behalf next week
  17. I have statements from 1984 (William & Glyns) right up to last month, nothing says any different than Current Account. It's not a royalties account, but she changed it to an interest bearing current account last year

  19. It can vary, mine was 14 days before the hearing. You need to check what it says on the order sent to you by the court. Sometimes it states that they have to be recieved witin 14 days..... have a check and post back what it says. If its neither of them then i am sure someone else will know the answers All the best!

  22. Thanks for helping all, i have my mums statements in front of me. All the statements state "Current Account" and one print out states "Personal Current". So am i to take it that it is not a "Royalties" Account? Sorry about this, i am just very confussed as to why it shows 2 interest charges every month, and never for the same amount. And if they are claimable.

    No worries, my website is down...has been for over a week now...GRRRR! Imeant to do this along time ago.... it was a daunting task i kept putting off!
