  1. no problem. i went through all the anxieties and sleepless nights and i guess most people do.after all you are taking on a bloody great big financial institution. but believe me you will get your money , and if i can do it anyone with a bit of common sense can do it. like i said your almost there:wink:
  2. weekends and bank holidays are included , and it's 33 days in total. 5 days for it to be served. 14 days for them to acknowledge . 14 days for them to defend. and they will enter a defence on the 33rd day believe me. just sick back relax and wait for the allocation questionnaire to arrive.
  3. that is all correct rainy . here is a number to ring closer to your date. 020 7116 5634. just ask to speak to whoever is dealing with your claim and ask if they want to settle before the court date. it's nearly over matey.

  6. it is a bit unusual.did you send everything recorded delivery so you have proof of delivery , and did you keep a copy of all your letters just in case.
  7. are they dumb or what.if they don't get their evidence in etc you have won. they have ignored the judges directions and you will be able to obtain judgement by default. phone the court on the 12th and if they haven't got their bundle in take the form into the court by hand if you can (thats what i did , it's quicker than posting)and wait till you get a judgement from the court (takes about a week). then ring barclays and politely tell them you have obtained judgement by default as they should have heard from the court as well , and listen to them cringe with embarrassment:-D
  8. you have given them plenty of time to respond and the ball is in your court. if you send them another letter and give them even more time there is virtually no chance of them making a full offer they will know something is wrong. when i made my claim i went over the overdraft and got charged for it. so i am claiming that back as well:-D
  9. excellent , you are right on track , just the AQ to fill in if you get one. you might just get a court date straight away.
  10. you do tend to check MCOL every day but nothing ever happens. best to just wait till you get their defence and AQ through , and they will enter a defence at the last minute.
  11. that's exactly what happened to me. phone them tomorrow and tell them you have requested and obtained a judgement. they will then crap themselves and pay you out as fast as possible and send you a form to sign to set aside the judgement. i bet the money is in your account by wednesday;)
  12. it's 33 days including bank holidays and weekend. we are off to florida in may and the money has come in really useful. try not to worry too much because you will get your money. try and get your bundle sorted asap so you can sit back and relax and study the holiday brochures.

  14. but barclays haven't submitted a defence to the court so you have won. give them a ring and explain this and they will pay out believe me. the number is 020 7116 4753. just quote your claim number and ask to speak to whoever is dealing with your case.
  15. the same thing happened to me , they never got their bundle in by the time stated in the directions. i then requested judgement by filling in a n225 form(think thats the number)which i downloaded from the internet. when the form went in i phoned barclays to tell them i had requested judgement by default , they realised what had happened and paid up straight away. i suggest you phone them and tell them you are requesting judgement today.
  16. bozzie , like you i was full of trepidation and thought what the hell am i doing. but i persevered and won back my money (over 4,000) and so can you. the hard part is over , all you do now is wait till about a week before your court date and bingo you have won.
  17. wot me clever nah . lol. i just know a bully when i see one so i smacked em on the nose and told em to give me my money back. so they did. i am sick of them intimidating people so get your boxing gloves on ready to kick ass.hehe.
  18. there is no new ruling , only for credit cards . but people are still claiming those back and winning. just another scare tactic by the sound of things. take it all the way and let the judge decide (you will win the banks dare not go to court)

  20. you need to ring the bank and ask them when it was converted to an additions account. if you never agreed to the account you can request all the payments backdated to the time it was converted. good luck.
  21. caz you are doing the right thing.stick to the instructions and stick to your timeframe and you can't go wrong. i think if you try to take short cuts you could possibly jeapordise your claim. it takes ages and i should know , it took me exactly six months , but you will get there in the end . oh and try not to worry too much as i also know it is damned nerve wracking at times. just think of the interest mounting up. good luck.

  23. yeah so am i . won first one and just started second one for £150 charges since feb this year. if they want to close my account go ahead before i bloody well do it.
