  1. try not to worry too much about the court thing (easier said than done i know) as far as i am aware it's not the same as a normal court , you know juries etc , just you the judge and their representative , if they turn up. the guy who lost his case is a one off , there must have been something wrong with the way he presented his case because the same judge has settled other claims in favour of the claimant. also if people use the new draft order for directions the banks must produce a court bundle by a certain date , if they don't the judge may award a judgement as in my case. good luck.

  6. lspight hello, the same thing happened to me . i phoned barclays and spoke to krysta who was dealing with my case , she rang me back ten minutes later after i explained what had happened and she told me that they had made a mistake and i had won . next day i recieved a letter to sign to release the money to my account and a form to sign to get the judgement set aside. you need to phone them urgently cos it looks like you have been overlooked , here is the number 020 7116 5634 , just ask who is dealing with your case and quote your claim number and tell them you have a judgement , the money will be in your account saturday or monday guaranteed unless you want to send in the bailiffs that is. and don't worry about phoning cos they are really nice. good luck.
  7. if i were you i wouldn't contact the bank , they are so snowed under they forget about things like this as in my case. if you bring it to their attention they will apply to get it set aside and will probably succeed. stick it out for one or two more weeks if you don't hear anything and try and secure a judgement , after all you have waited this long so a few more weeks is nothing. as ever good luck and lets hope they slip up.
  8. just a quick question i need some advice on. i am helping out a mate in work who has all his statements going back to 2004 and he has worked out that they were charging him £90 a month till now and it comes to about £3500 and he wants the rest of his statements from 2001 so i have printed him off the SAR. then he told me ha has all his statements going back from 2000 to 1990 with dozens of charges highlighted. question is can he claim these charges as well and will it still be allocated to the small claims court if he decides to go to court that is. this could turn out to be a monster claim and i want to get everything spot on for him so any advice would be really appreciated as usual.

  10. i had charges added before i started court proceedings and just sent them an updated spreadsheet each time with a letter just to let them know.
  11. hey KA don't worry too much , i made a few cock ups with my claim and was worried sick at times but they paid up in the end. even if the interest is wrong it's in the banks favour if it needs amending.guess where i am on the 23rd may . on me hols , no not athens bloody america. i missed the last one cos i was in disneyland meeting mickey mouse this time i have found a nice british pub that shows footy so mickey can sod off this time.
  12. cases that get decided in the small claims court cannot set a precedent , that would only happen if it went to high court. that's what i have read on this site elsewhere.
  13. yeah sounds a bit dubious. barclays will admit to nothing in my experience. check and check again before you/we celebrate.

  18. oops forgot , if you are claiming for say two thousand put it in as £2000 not £2000.00 as once again more characters.
  19. try and leave out any commas ,question marks etc stuff like that cos they are classed as characters as well. hope that helps mate.

  21. i reckon they don't defend about 99.9% of the claims on MCOL so put your feet up and relax for a few weeks cos they will defend.
  22. once you have started a claim with MCOL you can change your particulars i.e. add on more charges etc but it will cost you £35. otherwise you will have to start a new claim.
