  1. For the majority of customers, the image of the instruments in the pack would be simply to show the odometer reading in confirmation of the advertised mileage. The fact that the Rev counter is showing '0' would simply mean that the ignition was on, but the engine had not been started. It is disingenuous of them to imply otherwise.
  2. To answer the other part of your question, no, a letter of claim or letter before claim, does not need to come from a solicitor. Any claimant can issue one in their own right.

It is an excellent document but to be nit-picking, you might like to change November 25th 2021 - I was served court papers at an address I was no longer living at to simply court papers were served at an address etc as they were not actually served on you Also in point 6 you have missed out 'when' in the second sentence. Not only was I no longer at the address the claim forms were issued,
  4. It is good that you came to the forum so quickly. It is a self help site contributed to by volunteer members, so it is important that you view similar private parking threads here so as to familiarise yourself with how these fleecers work and avoid making simple mistakes when dealing them. It also helps avoid asking question which have been asked myriad times before. Although the advice at this stage is to ignore their demands, please keep safe all of the paperwork that you receive as unfortunately they do have 6 years to institute a County Court claim. Alongside ignoring their demands, also never admit to who was driving, or provide an email address to them. (free means of harassing you)
  5. I think that the sentence I will first be obtaining an unreasonable costs order under CPR 27.14(2)(g). should actually be I will first be seeking an unreasonable etc as actually obtaining is subject to the will of the Judge and tells the fleecer that you understand the procedure.

  7. In some circumstances a court not local to you may be preferred, such as if you are working away from home all week, or you have a disability and your local court has not yet entered the 21st century etc.
  8. Dear BankFodder, I think you are misunderstanding what the OP is saying. The 'friend ' to which they refer, I imagine is the mechanic who examined the vehicle, so no need for them to post the story on their own thread. The vehicle was purchased by the OP's partner.

  10. Correction Bazooka Boo, you are correct that PPC's cannot issue a Fine, but neither police, nor local authority can issue a fine either. It is only a Criminal Court that can. The Police can issue Fixed Penalty Notices and local authorities Penalty Charge Notices. These do have the force of law as failure to pay can result in court appearance.
  11. Perhaps the more knowledgeable of you can advise on the point in the Agreement that gives Amtrac the right/obligation to 'sue for trespass 'etc (3 c) rather than for breach of contract?
  12. There is little point asking questions if, when given a direction such as that by FTMDave above, you decide that instead of reading a thread from post #39, you read from #63 and think that it will give you answers. This Forum is self help, so it is incumbent on you to do just that .
  13. May I firstly offer my condolences on your recent loss. Whilst Andyorch is correct in essence, I would suggest that you contact a local insurance agent (preferably face to face) as they will have a wider range of Insurers able to help in this instance than online comparison sites who deal mainly with straightforward cases. If your partner was with the same company for several years, you could approach them with a view to an enhanced initial discount as they will have a record of your history as named driver (one assumes that this good?)
  14. In no post have you stated whether or not you recognise the VIN to which these orders refer. Also it would help if you could confirm if you were/were not in the UK in March 2021 when these alleged contraventions occurred?
  15. And you would have a blatantly obvious claim for seeking a costs order for unreasonable behaviour. £750 in your pocket me thinks.

There is a loser (or rather eventually losers) in this situation. a) The provider of the overnight parking are not receiving the payment due for the facility. b) The current situation with driver shortages, which is affecting delivery of goods to everyone, is due in part to poor overnight facilities putting off drivers continuing in the job and difficulty in recruiting new drivers to replace European drivers no longer working here since Brexit.. Facilities, including secure parking, showers etc., can only be paid for out of the income stream from those drivers paying their nightly charge. Irrespective of any criminality, there is an ethical question here. I make no apology if this sounds 'po-faced'.
  17. There has been and will be, no investigation by POPLA into the alleged wrong doing. They have a very narrow remit, slanted firmly towards the benefit of the PPC.
  18. dx, you keep getting it wrong.Police can only issue Fixed Penalty Notices, Council can only issue Penalty Charge Notices, DVLA can only issue Penalty Notices. Only a court can fine an offender - period
  19. Do you have any evidence other than the verbal claim by the dealer such as report from a mechanic, that a fault has developed,? It is not unheard of a dealer chancing their arm to make more profit! If you have no independent evidence, I personally would adjust Banfodders letter in the third paragraph Since then I understand that a defect has manifested itself with the Jaguar to something like ' since then you claim that a defect has manifested itself with the jaguar' Of course it makes no difference to your position, except that down the line the dealer cannot use the letter to suggest that you knew that he had discovered the fault early on.
