Hi all got abit of a problem with lha. Been in reciept of it since march for a private rented flat. Was on JSA SINCE NOVEMBER last year, 5th of may dr signed me off so put in claim for ESA, claim awarded, attended medical 21st july and failed. First i haer of failing medical was 25th august when i recieved a letter from DWP, saying i was not allowed ESA feom 5th august. Took 20 days to get the letter to me, last payment recieved from ESA on 18th august, i had originally planned to appeal but my appeal was not allowed so went back to JSA. Signed on ,on the 30th August, rapid reclaim, informed local council they said everything was fine. I then recieve a letter from council about a week or so later asking me what i had been living on since 4th august, as DWP had told them i wasnt claiming any benefit. Filled a form in and returned it, they then sent last week a ltter asking for bank statements, which i sent aong with letter from DWP stating i wasnt getting ESA and a letter confiming i was going to get JSA. I also sent in letter detailing i had to get a crisi loan on the 1st september as i had no money from the 18th of august. I am still waiting to hear the outcome of this, i have made my landlord aware and he says if they say they decide they wont pay me for those weeks he said i have to pay him instead, which i cant afford to do. Im getting worried about and over payment of lha although i still havent heard, but i dont understand how it took 20 days to send a letter to me to inform me, the date on the actual letter says 22nd august.

I have gone back to signing on, and when i had my interview on 30/8 this work programe was mentioned to me, have they been scrapped? Im in scotland and was told ingeus would be running it?

You need to start by ringing the CRB people and speak to someone there, they will be able to advise you what to do,seeing as her sisters info should not be on there. Then you could find out when,where what police station processed it, seeing as most police stations take pictures as well. You could also go to your local police station and ask for there help

Thanks Erika for that, i am going to ring for a crisis loan in the morning before i go to the job centre. I did today recieve a letter regarding my appeal and there wasnt enough info for the appeal, so i am thinking about things before i decide what i am going to, as i still would like to start my own buisness so for now i think i will go back on JSA , have been back to dr's today, and have been referred for physio and given me stronger pain relief, as what i had wasn't touching the pain. She feels the need to have my back investigated more if physio does not solve the problem, which i don not think it will.

I have read that tread with intrest, but i am wondering according to the jobcentre this morning, ATOS had decided 5/8/11 that i was no longer entitled to claim ESA. I only recieved notification last thursday of this decsion, but i had continued to be paid my assessment rate. Is this because my sick note is still current and does not expire for another 2 weeks? If that is the case am i still owed money? This is all confusing and is so not helping my stress and anxiety .

very true, its a nightmare just come back from jobcentre and they told me to wait until thursday to apply for a crisis loan, best bit is im still signed off until 15/9 so even though i am no longer being paid esa, do they still have to pay me until my sick note runs out?

Have just got of the phone from speaking to dwp, to be told that my appeal paperwork i have sent in has failed? He cant tell me why, just that something is in the post for me, refused to make me an appointment at local jobcentre so i can fax the appeal again so i wont get any payment this week . What do i do next?

Thanks speed freak, i did ring the local council last week and told them what had happeneed, she said if there were any changes they would write to me, but going to give them a ring first thing in the morning, as it's stressing me out abit.

how long does it take to get your payments reinstated after you have sent in your GL24? I'm due a payment on thursday and worried it will not be there.

UPDATE: Have just got off the phone to BDC in Aberdeen, have asked for a copy of my medical the lady i spoke to was very helpful, and has booked me an appointment for tomorrow at 9.30am at my local jobcentre to get my GL24 faxed over to BDC. She said to put in the appeal a request for my notes from my medical which i have done, have been told to ring back tuesday and ask if they have recieved my appeal,and then make sure i sort my payments out as i am due to be paid on thursday. Once i know more i will keep you updated , cant do much more until i get my medical report back but judging by the notes they have sent which are wrong already i cant wait to read the report!

Hi sorry to hear your having problems, i had same problem a couple of years ago with my landlord, i indeed changed my own locks, which didnt go down well, but my lawyer said i was within my rights to do so. IS it just a simple yale lock you need changing? D o you have a friend or neighbour who could od it, only takes 10 mins from start to finish.

still no news on my medical, i was hoping to have heard by now. Was back at the drs yesterday as its stressing me out, with plenty of sleepless nights, my meds have been upped to help me cope and she signed me off again to go back and see her in 6 weeks times,now the question lol, i was on JSA before becoming ill, and although i want to work, and infact become self employed i cant until my dr says im fit, she has stated i need to be on my meds until next summer at least. If i have failed my medical but my dr continues to sign me off, can i just continue on the assesment rate with out going to appeal, as i hadnt planned on staying on ESA for a length of time, i know alot of people are long term sick, so i can understand appealing against the decision. Any help will be good.

They can take up to 3 mths to be processed depends how busy they are, as they are sent to a central processing centre, and then checks are made by the police authourity for your area, and any other areas you have lived, to link all your addresses, could be lucky and get it back in in 4 weeks.

All cautions do show up on enhanced CRB's, but also on the application forms there is a bit about declaring anything, i would just explain to employer before filling in the form, at least they know that there could be aproblem.
