  2. Hi, Can you list these debts with the following information? 1. The name of the original creditor and type of account. 2. Name of DCA if relevant. 3. Date started 4. Date defaulted. 5. Amount outstanding. Any information as to what action is been taken by creditors and/or DCAs in each case.
  3. Reconstituted agreements do Not need to have signatures, but Must have the following constituent parts to be compliant: 1. Your name & address at the inception of the account. 2. The creditors name and address at inception (if an account has been "taken over" by another provider the Ts& Cs of the original account. 3. The Terms & Conditions as at the inception of the account. 4.The Ts & Cs at closure. 5. Any material changes/amendments made to the Ts & Cs during the life of the agreement and any other document mentioned in the body of the Ts & Cs. If one point fails the recon fails entirely.

  5. Hi CC, From what dept. of New Day is this letter coming? I suggest escalating this as a formal compliant to James Corcorran the CEO at New Day. Point out to him that the documents provide to support their claim in regard to the " Debenhams Store Card" are not those that would have existed at the inception of the account as is required for a " reconstituted" agreement and therefore the document does not satisfy the CCA request under section 77/78 of the CCA 1974. Amend to suit.

  16. I'm once a complaint was made to CISAS and VM were informed they have to wait for them to respond.
  17. It is a Must to exhaust the creditors complaints procedure prior to taking a matter to a body such as CISAS, let's hope VM now respond.

DNs are a generic notice giving a debtor 14 days to remedy the status of delinquent account, if a " negotiation" is entered into or a payment is made the creditor may not ( in fact does not have to place the default) if such a plan of payment is entered into and fails the creditor can send another default notice.

  20. It's not the CRA system it's The Limitations Act, The DPA/ICO/FCA laws and regulations. Jotty I cannot see why or what it is you want to achieve, as dx100 has said quite succinctly " it's nowt to do with MMF". The CRA file is accurate it seem and up to date and your " dislike" of it will not assist you or change the facts.
