  1. Hi Gerald, The reason for the searches I discovered from a source within a DCA. Was that I had been helping cost friends and particular relative with debt problems and had cost them a very considerable amount of money,and in one case compensation.
  2. Yes I was turned down for a tiny (100) overdraft by NatWest (RBS) with whom I have a long and unblemished record, and was told that it was due to searches by a DCA (Lowell & Mackenzie Hall). I used this to get compo from MH, am still fighting Equifax.
  3. Seems like they have sold it on,have you had a default notice or any other letters from the original creditor, how old is the debt and when was the last payment or acknowledgement of the debt made. If not the usual CCA letter is the first move. Do not phone them!
  4. These searches are ''supposed'' to be tracing searches but Equifax seem to do what they want. The DCA who compensated me admitted that they had no control as to where the searches are posted with Equifax, but any way both are liable as co data controllers, the more of us who complain to the ICO the better as they do seem to respond better than the other regulators. Please keep at it;)
  5. You need to send The Statute Barred letter the templates on here. Basically you tell them that nit is stat barred and you will not be making any payments or offers of payments The Office of Fair Trading Guidance states it is unfair to pursue a stat barred debt once the debtor has stated they will not pay. Send letter RD do not sign print name only.

I you believe this search is damaging for credit status please urgently get in touch with the CRA and the DCA as Equifax is notoriously slow in my case 19 working days to reply and 6 weeks to remove the search after the DCA instructed them do so, alot of damage can be done in that time. ICO has written to Equifax on my behalf but gives them 8 weeks to reply.
  7. Table 1 Searches are headed SEARCHES MADE I CONNECTION WITH CREDIT APPLICATIONS so I belive that DCA searches should not appear on that table, DCA's don't give credit!!! I am fighting a DCA and Equifax over the same thing. The explanation fro Equifax is confusing to say the least firstly they say the searches are on T1 to alert you and don't impact on credit status, then they say they may been seen by companies that use automated searching systems and may have an impact,after this statement they say that these searches are presented in a different format when accessed by potential lenders and do not have an impact on credit status!! Confused I certainly am:confused: Challenge the DCA by post for searching without authorisation and send letter RD FAO the Compliance Manager,do the same to the CRA. You will have a long wait for a reply from Equifax but they are a waste of space on t he phone. Just a point one DCA has paid me considerable compensation for this an I know of a least 1 other Cagger who has had the same.

  10. 1. Which CRA are holding the entry. 2. Under which heading is the search posted. 3. Have you sent CRA request? 4. Never talk to the creditor or a DCA by phone.
  11. If it's Equifax I wish you luck,Experian I have found can and will sort out this kind of thing with a phone call.
  12. Hi Bolndmusic, Well done grab the money!!! I am still trying to tie Equifax down to admitting any thing they have just sent the most garbled letter re Table 1 searches, in that they say in para 1 searches in T1 are ''possibly be seen in automated searches used by some of their clients and ''MAY'' have an impact on decisions. In P2 They say all T 1 searches are not seen and have no Impact on reports. Brig. the same one as before with an upgrade to 2:?

  16. Yes letters addressed to me and refer to my relative, and the particulars of the claim and we do have all the letters right from the start.
  17. Yes thanks for that. All three 1ST Crud,Connaaught,and their alleged Solicitor Judge & Priestly have corresponded only with me from receipt of their first letter.
  18. When ever I use the DD facilities I always insist on a paper trail, signed by me and posted back,causes a few days delay. I always add hand written the following. NOTICE the amount due must be claimed on and NOT before the due date, the fixed amount of this DD must not be increased without my express permission. Only one company has moaned so I cancelled the order and bought cheaper elsewhere. No one can just raid your accounts at a whimm especially the energy crooks just to make their figure look good!!!
  19. Hi, Iv'e been dealing with 1ST Credit/Connaught for a member of my family for some months,1St Credit produced 2 sets of T's & C's as an agreement which we rejected. They the issued a CC Claim via Judge and Preiestley to which a defence has been entered. We now have a letter from the notorious LCS Solicitors (next desk 1st Floor bogs 1St Credit HQ) requiring me to prove my relative has authorised me to act for her,we have had no notification from anyone regarding a change of legal representation. Also none of the companies concerned have replied to CPR requests for documents or replied in any way since the defence was entered. Please can anyone suggest what more I can do? Thanks in anticipation.
  20. Applying for a postal report shouldn't affect any thing as you are not opening an account with the CRA, although the do all say that searching reports yourself is not seen by others, it's possibly not as safe as we are led to believe.
  21. I have been having trouble with Equifax & Lowell for a few weeks over searches made on Table 1 ie searches made in connection with credit applications. The first time Lowell investigated and had the searches removed from the file with no problem,however I checked my file this week to find 3 more Table 1 Searches in the last 2 weeks,this is during the time I was in discussion with Lowell. Here is the gist of Equifax's reply. The searches that appear on table to convey to you that these searches have an impact on credit applications, searches such as Debt Collection or unpaid or outstanding debt may be taken into account as part of an automated scoring system. We would point out that the ''text'' used to describe these searches is not provided in the same format during a search made by another company and does not impact on any decision another company may make?????? Am I confused or does their 1st statement contradict the 2nd. Unusually Lowell are being quite cooperative in this :confused::confused: Has anyone any insights or opinions on this please?
