    Yes they acknowledged and defended - we are one of the untimely few where, at the time, Lloyds went to the wire before settling. There are quite a few of us about. They have since become like Nationwide were - as soon as you file, they pay. As for deleting the posts, I did so after I got a barrage of abuse via PM's from a certain poster on here. And finally, as for getting help from someone more experienced - I have been on this forum since practically the beginning and was a site helper for quite a long time before ill health forced me to take a back role. I have also had 3 other claims settled so I do know what I am doing. No offence taken though!

    Well I filed 6mths ago and still have not got anything. With the test case, it may be at least another 6mths before I get anything.

  14. We got the same.....taking out a judgement for the money would be no problems I would imagine I plan to ask for the case to be struck out if they don't supply the court bundle to me. They have until next Wednesday as our case is on 22nd August.
  15. It's a load of rubbish - the NatWest episode yesterday was really nothing to do with the charges as such...he was claiming damages for the stress etc that these charges caused. Barrister loses legal fight against 'unfair' Natwest charges - Times Online So yes, the advice is to still file.
  16. No joy for me with SC&M either but the court are going ahead with hearings and the banks shouldn't just assume they will get a stay. Hopefully Lloyds will change their mind in the next 3 weeks and give us the money!!

Just called my local court (hearing on 22nd August with Lloyds) where they said that the judge has been in discussion with judges from many other courts and will not be staying the case before hearings simply because of the Test Case. If the bank wants a stay they will have to put up a legal argument for it and should not automatically assume they will get it. Hopeful
  18. Yes - you will get your case number from the court when papers are issued. If you had issued via MCOL, you would have had it straight away.

  21. Great news Maxine - our hearing is 22nd August (filed in March!) so it is worth a try, I guess. Not hopeful but you never know. Edited to add, just called the court and ours are still going ahead - judge will not stay the claim before the hearing just because of the test case.

Court date came and despite having the letter, and proof that SCM signed for it, the case was stayed. Seriously hope this was a one off but I would not count on anything until that money was safely in the account. And make sure you send the settlement letter so that they have to sign for it.
  23. Well I have seen VERY few cases where Lloyds get nasty if your accounts are fine, even with overdrafts. Many people with overdrafts have claimed and not had them removed in the process. I can only remember a couple off the top of my head and that is in 8mths of following the Lloyds forum. That said, you can't rule it out entirely but I would say it is very unlikely. They might ask you to pay back your overdraft on settlement, no-one really ever seems to mention that but it is not in the usual T&C's of settlement. You have read the recent threads on the OFT Test Case though, haven't you, which will put a hold on any payouts until it is settled?
