  2. hi, I'm wondering if its still possible to reclaim mortgage fees as of September 2013. Have things changed? I'm now coming across PPI reclaim firms offering to reclaim mortgage arrears. I had a mortgage with the evil GMAC. They repossessed 3 years ago and Paratus AMC are still after me for £4,777.91. I've written to them and told them that they owe me £5504.73. AMC Paratus wrote back in reply and said that I still owe this money and that I am to repay it and failure to repay it would result in alternative actions to recover the debt. Is it still possible to reclaim the charges they levied against me? Should I proceed through the FSO or the courts? Does anyone have recent experience of dealing with AMC?   3. Hi all I'm wondering if any one can help: in dec '04 I purchased a leather suite from scs for £2513, I was asked by the salesman if I wanted it over 12, 24, or 36 months. I took the 36 month option, it should end in january '08. I have missed a few payments over the life of the agreement but I have managed to catch up. I calle Blackhorse the other day to see how much I owed and they said that it still £745, plus there are collection activity charges of £205. I have received a copy statement now. I objected on the phone and the operator confirmed that I have made 32 payments, and told me that the 36 months on the agreement was just an estimate. Now when I look I do see, "Estimated Number of Monthly Repayments." I truely thought that the agreement was for 36 months and that most of the debt was paid. What on earth has happened and is there anything that I can do about this? What advice can you give me? kindest regards
  4. Hi I'm in a similar situatin with this group. I recieved the letter from Connaught and CCa'd them. I had a letter this morning telling me "our files have been closed and returned to first credit." Do I have to CCa 1st Credit now? Very interesting thread Regards
  5. --funny thing: the cheque and letter was dated the day after the decision about the January hearing! I must have slipped through the net at the last moment, I feel like the "one who got away." A few days later I had a letter from the court telling about the stay of all cases in Cardiff. I'm after GMAC no and a few others. thanks for the help from CAG

  7. Hi can someone tell me where to access the letter which I should send to a dca requesting that they prove that I actually owe the debt. I think its a letter to request the cca, but I can't seem to find it in the templates or anywhere else. many thanks
  8. Hi Guys thanks for your help. I have called OFCOM but to be honest I don't think they were a lot of use as they said they don't respond to any individual cases like this. They took my details and said there is nothing they can do but told me to call the Information Officers department. I did that and they weren't sounding as if they could do anything, although they were quite sympathetic. In fact they didn't know of Cabot and suggested they were phishing, which isn't the case. My next step is the Trading Standards, I think they may be more use and I will call the police if need be and report a case of harrasment and insist that something is investigated. Thanks
  9. Hi Could some one tell me where to find the script to stop calls from a debt collection agency. We keep getting calls from Cabot saying we owe on a Barclay Card, we've never had one. We've told them to deal in writting. There're calling back later today and I would really like to put a stop to these calls. Many Thanks
  10. Amazing letter this morning, my case which was transfered from Swansea to Cardiff was due for a hearing on 14the August. The letter, frm TSB lawyers, states that they have refunded my money in full, including costs and interest. They also asked me to phone the court to cancel the hearing. Thank Youuuuuuuuuuuuuuuuuuuuuuuu!!! Well I called the court and they said that all the cases have been stayed untill after the January High Court hearing. Well I'm chuffed! The case has been stayed for a while now, and yet the bank still payed up. GMAC are next in my sights. Can anyone adivise me about arrears charges with GMAC? Can I reclaim? Thnaks
  11. Can someone please advise me? I am being charged £50 a per month for being in arrears with my mortgage - GMAC - am I able to make a claim to get this paid back to me or is the attempt futile? Many thnaks Peter
  12. I'm hoping that someone can help me with this development: My claim was issued in Swansea CC and I recieved notice that it has been transfered to Cardiff. When I called the Swansea court I was told that all these cases were now being transfered so that one judge could deal witt them all. This morning I have recieved a "General Form of Judgement or Order" it is form N24. This is what it says: Upon the courts own motion. The court has made this order of its own initiative without a hearing. If you object to this order, you must make and application to have it set aside, varied or stayed within 7 days of receiving it. IT IS ORDER THAT 1. Directions will be given in this case by the Designated Civil Judge, His Honour Judge G Hickinbottom, on the 14th August at ... the court address 2. The parties may appear in person or make written representations as to how the case should proceed provided a copy of the representations is sent to the court and the other side at least 7 working adys prior tothe hearing. What does it mean and what do I do now? many thanks
  13. just recieved, this morning: Notice of Transfer of Proceedings to Swansea CC; Allocation Questionaire (No. N150); Copy of TSB defense (N9B) It seems I have to complete the Allocation Questionaire (No. N150); and return it. Any tips for this section? How long does the matter take to conclusion from this stage? thanks
