  1. Hi pupil, have been away for 5 days so couldn't relay the good news ...... their 14-day deadline was on Monday so I rang SC&M. Lady called Donna told me that they hadn't received the judgement from the court (surprise, surprise) but from then on she was very helpful. Actually rang me back later that day to tell me to send a fax of our copy of the judgement to her and they would get it paid. And they did! Within 24 hours. So that's it, the long journey ends in success. I thought with the OFT test case coming when it did, we had just missed the boat but as it turns out we were lucky to just sneak in. Thanks again to everyone here, definitely wouldn't have got it done without you and best of luck to everyone else.
  2. Thanks for the good wishes everyone. Hi pupil, sorry to hear you didn't get costs. I felt a little like I under-performed in front of the judge as it all went like clockwork, nobody from Lloyds attended and he ruled in our favour, very quickly. Then he commended me on my hard work in doing the bundle and was writing down what we were claiming as he said "are you claiming any other costs?", I said (as a result of my reading up on the subject on here) that I was planning to ask him if it would be OK to claim for wasted costs at a later date. He said, "well, I'm giving you the chance now" but I hadn't prepared anything and was so taken aback I didn't really say much to help my case! I didn't want to sound like I was just plucking figures out of the air and/or just making it up to take advantage of his good nature. I wish I'd have taken a schedule in like pupil described earlier. As it was he allowed us a small amount on top of what we were claiming but somebody more experienced or more professional would've got more, I'm sure. But then, it's all experience and we got the right result. Lloyds have 14 days to pay but other threads here suggest we may have trouble getting it by then. We'll see. What with pupil's words just earlier about Lloyd's not settling new rulings and appealing it still feels like the battle's not quite won yet! Wouldn't have been able to do anything without this site and most definitely will be donating 5% if we get the money. Many, many thanks to all.
  3. Thanks for the wishes guys, court on Monday morning ... just checked one last time to see if money had arrived but it hadn't so away we go I suppose!
  4. Thanks maxine ... and congratulations to you! ... I just rang them and they said they will settle no cases now due to this OFT thing. I told them that my friend rang at 11am this morning and got a settlement over the phone, describing what you said. She said that would not have been them and stuck to her guns even when I said it was you who gave me the phone number! Court said all scheduled cases will go ahead and when I told this to the lady, plus the fact we're bound to win as we have prepared properly, she said something like, "well, if you win you have to take a judgement out against us to get the money".

Still nothing here despite having identical circumstances (except a much lower claim!) ... and then there was Jeffrey62 who got the same letter as me but several days later and he got paid out a few days ago ... beginning to think they've forgotten me
  6. Would Lloyds / SC&M be allowed to apply for a stay in cases where they have already missed the 14-day deadline for submitting any documents to "all other parties". Haven't they already, by doing this, given up their right to defend?

If SC&M apply to the court for a stay, and are successful, is there anything I can say to the court regarding the fact they missed the 14 day deadline for submitting any documents to us & the court and therefore declared their unintention to defend before any mention of a test case. Otherwise it's like they've been given a most unfair second bite at the cherry.

  10. Hi pupil, glad you got that sorted! No, we've not heard anything from SC&M, no offers and no paperwork regarding their defence. I'll be following these guidelines tomorrow http://www.consumeractiongroup.co.uk/forum/lloyds-bank/58011-directions-non-compliance-letters.html just so the court are aware they are simply using the court process as a way to delay paying and they have no intention of defending on the day. Can only help. Haven't heard of any results at Bristol but an old BBC report did suggest that ours were one of a number of courts that were getting fed up with the banks and their conduct. This coupled with the fact we are in a block booking - and told the case should take no more than five minutes - tells me the court are fully expecting them to not turn up and want to go through the formalities wasting as little time as possible before ruling in our favour.

  12. Oh dear pupil, I hope that was a joke :o ... what happens if SC&M don't get it by Monday? Barty, thanks for the reply but I am not getting on with consumerwiki. Gives me the front page mixed with several lines of stuff like: Warning: Cannot modify header information - headers already sent by (output started at /home/cag/wiki/AuthPlugin_vBulletin.php:200) in /home/cag/wiki/includes/OutputPage.php on line 450 or it tells me to log in, which I can't and it won't let me go to another page.
  13. Ah yeah, we're in the 10am block booking too. Got our bundle finished yesterday (many thanks to zootscoot for help) and finally delivered it 1) by hand to court and 2) by special delivery to SC&M, which they received this morning. Does anyone know .... if, as one must presume will be the case, we don't receive their bundle from them on Monday, what is the best course of action? Phone them, phone the court, or sit and wait?
  14. As with the guys on this thread, we had this letter. Keep hoping the money will turn up in the account but hasn't happened yet. Sent the reply recorded delivery and it was received by them on 5th July, so 10 days ago [7 working days]. Will let you know if they do settle soon, may be you'd be on the same sort of timescale ... we have three weeks to court date.
  15. Thanks Barty Wife been in hospital for a while, will be for several days yet, two young boys to look after, bundle not ready with only a week to go, desperate to see the money appear in the account to save me the trouble!!
