  1. this is what i was referring to There is a clear requirement for your client to produce the correct document that is not signed by myself but that also contains the prescribed terms per section 61(a) and section 127(3) of the Act; and I am sure you are aware that when an agreement fails to include the prescribed terms as per section 61(a) of the Act and is signed by the Debtor, then the agreement will be irredeemably unenforceable. In this regard, I refer you to the decision in Wilson v Hurstanger (2007) EWCA Civ 299: some one on a thread wrote a great letter including this i cannot find it
  2. hi i read a thread a few days ago there was a great letter quoting the above case and other stuff to send to credit card companies who insist that the agreement is enforceable. i have looked for ages today and cannot find it if anyone knows where it is could they please let me know

  15. hi requested cca from lloyds after 20 days sent reminder lletter, received back a letter ' sorry re your complaint we aim to deal with this in 28 days blah blah. you can complain to FOS blah blah If i complain do they get fined or just told to get on with it

  19. I would like to send a reminder letter giving say 14 days to reply If i dont get a reply than i would like to make a full and final offer. so i want enough evidence to show that they had plenty of time to produce this.

  21. Just to say been going through old paperwork and have come across card carriers. Not the first one ever, but the one posted up in an earlier post from a replacement card Its different mine is interspersed with info on card insurance etc, theirs seems to be missing this bit Do you think they were trying to hoodwink me into believing it was complient, surly if it has info regarding insurance then would this not make it unenforceable due to having stuff other than just prescribed terms? Obviously i know the card carrier makes no difference anyway, but it does make you wonder
