  3. its an application form no presscribed terms whatsoever have asked for further clarification ie anything on back of for nothing sent

I have today received a letter in response to my CPR request This states We do not consider this account to be in dispute as we have fully complied with your request under the CCAs78 and our position remains as advise in our previous letter dated xxx We do not consider this account to be in dispute or void and your indebtedness on this account remains due and payable and we will be persuing for the full payment. Any non payment will be recorded on your credit file as will a default if non payment continues. In the circumstances, it is my rresponsibility to provide you with the banks final response letter. This is our final response. this now gives you the option to complain to the FOS blah blah blah also received a default sum notice and a letter telling me i have missed a payment

  9. hi should i SAR before CPR as then it shows that i have tried to get info and they have not been helpful 42 mans route looks a bit scary at the moment
  10. they say they are trying to locate a copy but they are sure it isfully enforceable and will not enter into further corespondance
  11. thanks Lilly White So are you telling me that some of the contents of the letter are against OFT guidlines ie the one we would not have opened an acc without a signed agreement

  13. No In the olden days when you opened a bank account you sort off automatically got sent a credit card. It may have guarenteed cheques at first, but i closed my bank accounts with TSB in about 1986

  15. thanks for the response have an excellent marriage, will not tell my husband as he is a complete angel and very sensible. Unfortunatley i have not been sensible in predicting rainy days and wish to sort this without burdening my husband as he has worries since credit crunch. i would not want to add to his stress. i did offer a F & F but they refuse to discuss the matter further. My husband would help if i told him but as i said he is a very good man, and i would hate to disapoint him.

Hi they do go on in the letter to say Compliance with section 78 is achieved by sending you a current version of your agreement but we understand that some customers wrongly believe that they are entitled to an original signed copy of the agreement. you will note that section 78 refers to the requirement to provide a copy of the executed agreement. The executed agreement is the document which has been signed by or on behalf of both parties or, in other words, the original signed agreement - see section 189(1). the copy of the executed agreement, however, is the copy required to be sent by vertue of section 63 of the CCA

  19. letter states i write in response to your request of your CCA under section 78 of CCa1974 As your agreement was made before 19th May 1985 we have no obligation to suppy you with a copy of your execucted agreement. Despite this i enclose A copy of your current terms and conditions and a signed statement of your account. Despite the fact that we have no obligation to provide you with a copy of the original signed agreement, we are endeaevouring to locate a copy, but pleased be assured that we would not have opened a credit card account without having sight of a signed agreement. ( yeh right!) to summerise, the agreement you have with us is fully enforceable and we shall continue to treat it as such. We will not be entering into any further correspondance with you regarding the provision of a agreements. if you are using a claims management company we would like to remind you of recent warnings issued by the Ministry of Justice. it does go on about what is required of them due to s78 anyone go any advice
