  1. Hi Its been a while since I have been on line. I am not sure what section this query should be allocated to but here goes. I hold a U First Gold Account with Ulster Bank (part of RBS group) The main reason for having this (costs £13 per month) is the £1000 overdraft - I have had this account and overdraft for a number of years. In the meanwhile my finances deteriorated and I am using the overdraft but managing it properly. Point is if I applied now I would be turned down as credit rating is bad. Last summer the bank experienced massive IT Issues (the whole RBS System went down) and on the back of this they allowed me a temporary increase to the overdraft of £400. I asked and was told this was a 'special' circumstance where the branch could offer extensions with no credit check. I held this extra od facility till October 2012 then reduced amount from additional £400 to £200 and this has been repaid in May 2013. So I am back to within £1000. I have just received a letter to say the overdraft facility is about expire on 7th August 2013! Having spoken to the local branch they want me to come in for a review and said in defence that the overdraft can be called in at any time. That is true but I have been told it has expired not that it has been fore-closed. The girl explained that last summer (co-incidentally the date they state my Overdraft is to expire ) my account was flagged for review. So in other words they screwed up and then offered assistance, then when a year passes they 'highlight' the customers who are in most difficulty and threaten to remove the only facility which this account offers. My worry is that I have cc debt with the Ulster Bank (& others) it has lain dormant for a long time now as I have no means to pay. I told the UB Staff that I had bad cc history so I would not be able to re-apply for the full overdraft facility. I was shocked when she said she knew this as there were Credit Cards on my files with problems. I didn't ask if they did a general credit check or just looked at my personal history with Ulster Bank. Either way I gave no permission for this and I always avoid credit referencing as it does more harm than good for people like me in a bad financial situation. I am angry but also frantic that this will start a renewed barrage of letters about collection of the old CC debt. Sorry this has been long but wondered if anyone else having this experience? Is it likely that a query on personal banking could result in information found on my credit file being passed to the UB Head Office RBS Debt Collections or with any other creditors? Thanks W6

  4. Hi good to hear from you. I can hardly believe that this court business is over with. I keep lapsing back into worry mode and then have to pinch myself to remind that it has been sorted out. You really don't realise just how this overtakes every waking moment. The Housing Rights Counsellor helped me prepare the I&E Statement Tescos wanted and this has been sent off. The next DD to Tescos is due about the 1st Jan so I will let that go. If they don't agree to my proposal I will just cancel the DD and send what I can for the next few months. Thanks again for your help. You hit the nail on the head the court wanted to see that the priority debt was being attended to first and that negotiations were under way to re-structure payments to unsecured debts. The first hearing was adjourned to give me more time to do that. In fact the FP Solicitor as good as said to me that they felt the adjournment was aimed at them as well to encourage agreement before being heard again. The Judge was not interested in what was being paid to unsecured debt only that I was following advice given. Tescos were very unhelpful and it remains to be seen whether they will agree to the reduction I am looking for but the Judge was satisfied that this was how things should be done. As soon as she saw evidence of this and my improved offer she made the suspended order without another word. In fact it was done so quickly I had to take a moment to work out what had actually happened! Phew! W6

Could you tell me how to go about verifying a case has been dropped - see your comments below: "check,check and check again that your case has been dropped at your county court,dont just take their word for it whatever you do communication between creditors and theirreps and the courts can be diabolical."   10. Hi All This is my first chance to get back on line. The case went well last week and the court gave a suspended order. The negotiations with Tesco are on going. I spent a lot of time speaking with them on 20th but they would not agree to any changes prior to the court hearing I was disgusted. They asked for a new Financial Statement. So I spoke with the FP Solicitors before going into court and they accepted an offer of an additional £100 p month towards arrears with the normal payment re-instated. The Judge (a lady) was very fair. She listened to the issue over Tesco and recognised that I was doing all I could with them. She agreed to suspend the Possession Order and has given me to 28th Feb before starting payments. I will have a DD in place starting 1st February though. I just want to say a big thankyou to all of you who helped me along the way. This was the worst thing that ever happened to me and the advice and support from this site helped me get through it. I have learned a lot and hopefully I will be able to pass on what I can to help someone else. Debt will continue to loom large in my life for a while we are definately not out of the woods yet. I suspect a row brewing with Tesco but you know I think I am stronger to deal better with them. For now I want to just try and relax a bit and that takes time. Happy New Year to you all. W6

You are right I am now totaly absorbed in my side of the story and the nerves are getting in the way of everything. I'm heartened to hear you still think they will negotiate with me.   14. Thankyou for taking the trouble to come back and for your forthright comments. I have been niave about the re-negotiation of other debts especially when I had other reactions on this thread which seemed to imply that FP were out of line in their demand for me to increase my debt burden in this way. I have decided that I will contact FP Solicitors tomorrow and inform them that I have reduced payments to the unsecured debtors and try to reach an agreement before court. They have already said if the repayment proposal was increased to £300 then they would agree to suspend. Hopefully we can get to a figure that they will accept. I am not too concerned about my credit file I think it is well shot now anyway. Thanks again and I'll post tomorrow what I've managed to arrange . W6
