  3. Could someone let me know the implications of a Court Claim for the full ballance of a CC account that has been defaulted but not terminated? I have got to the Disclosure stage and the Solicitors have listed a copy of tha CCA (no mention of any T&Cs), copy statements(various), copy of Default Notice and copy of Notice of Assignment (this account had been sold to CL Finance) as the documents that they intend to rely on for their claim. There is no mention of Letter of Termination and I have not recieved one. Can the DCA claim the whole ballance of the account, as this it what they are doing. I thought if the account was not terminated they could only claim arrears. This claim is so full of mistakes anyway I am not too concerned, but the more I can find the better! Pookey

  6. Strange how different Courts work! I have one of these Howard Cohen/Egg cases (with the wrong POC that they tried to ammend) going on at the moment. When I filled in my Allocation Questionaire I mentioned the attempt at ammending the POC, and asksd for directions that the case be struck out. Instead the Judge made a Court Order that they could ammend the POC - but gave a very short deadline! They missed the deadline for sending the ammended POC - it was posted 2nd class on the day I was supposed to have received it. Also in the Court Order they were told to supply copies of any documents that they intend to rely on. These were to be supplied within 7 days of request - they are now more than 7 days late. I will be taking a letter into Court tommorrow asking for the case to be struck out - as the Court order says I can in the event of non compliance from the other side! Wakie - Check all the paperwork they intend to rely on. What they informed me they were relying on is pretty poor as you can see below. Check your ammended POC as the one they supplied me has a digit missing (this will be plan B if I cant have the case struck out) Also my list of documents they intend to rely on does not include a set of T&Cs which makes the assignment to CL dodgy. There is no mention on the CCA about Eggs right to assign the account, it is in the T&Cs! There is also no mention in the list of documents of a Letter of Termination. I am sure I read somewhere here that without terminating the account they can only claim Arrears on the account and not the full ballance. Finally as mine is an old Egg agreement it will not state 'Credit Limit', but states 'Approved Limit' - which could refer to anything. I dont know what Howard Cohen (or Lewis, as it is probably their staff that process these claims) are up to. Fair enough I can see the effectiveness of issuing Court claims as many people will probably cave in when one lands on the doormat. But to keep persuing with little or no paperwork, making mistake after mistake is lunacy!!!!! Good luck Pookey Ps If they come up with a set of T&Cs make sure the reference number in the bottom right hand corner of the front pages of the CCA and T&Cs match. Otherwise the T&Cs are not the correct ones for your account!

  9. They have not fully complied with the CCA request, as they have not supplied a copy of the Terms and Conditions that were applicable when the account was opened. Also you seem to have one of the earlier Egg agreements that simply states 'Limit'. This could refer to any 'Limit' - such as ammount of transactions during a certain period, maximum value of a single transaction, ammount of credit or limit as to the ammount of bananas you may purchase in a single transaction:D.   10. Thats funny!! I had an Egg account that was passed to DLC, who I CCAed, and they kept sending the 'We have requested the CCA from Egg and will pass the documents on when We have recieved them' letter each month. Then, about a year later, ARC came on the scene. When I sent them the account in dispute letter their reply was that the previous DCA had sent all the relavent documents to me and so there was no dispute (funny as I was still recieving the DLC covering letters). A quick letter to ARC telling them nothing has been recieved, with a copy of one of the DLC letters and I have not heard from them for nearly a month. Pookey

A load of Cattles shareholders (including employees) squabbling about whether Cattles will survive when they eventually post their 2008 and revised 2007 accounts.   13. They allowed them to submit a new ammended POC, but it was on a very tight deadline and they failed to get it in on time. I have written to the Court to ask for it to be struck out as they did not comply with the deadline, but from what I have seen the Courts seem very relaxed to solicitors missing deadlines. Never mind, the 'new' ammended POCs have the same mistake as the original ammended POCs (missing digit), so good luck to them trying to pass off their documents as corresponding to my alleged account. If they try to pass that off as a minor error I shall be asking what if I had a number plate similar to a car commiting an offence - is near enough good enough. And thats before I ask to see the original agreement - not a copy of a copy, and question the Egg version of prescribed terms ie 'Approved Limit' verses 'Credit Limit'. And the fact they appear to have no terms and conditions etc,etc,etc!!! Pookey
  14. I agree. I am working on a letter to be sent to the SRA detailing the argument you make above and the lack of clarity in their listing on the Law Society website. I will also go to my local Trading Standards next week to seek advice. Pookey
  15. I did exactly as you are proposing to do in post 49. I also put in a Draft order for Directions and a copy of the letter from Howard Cohen attempting to ammend the POCs pointing out that the letter was dated the same as the claim form but not franked until 3 days later (put a copy of the envelope in for good measure!) My allocation questionaire was looked at by a District Judge and they made a Court Order that amongst other things an ammended POC should be served on me and sent to the Court, that a list of all the documents they intend to rely on are sent to me and that they are to send me copies of any of these documents within 7 days of me requesting them. The Judge gave them a very short deadline, possibly as a result of their messing about with the attempt at ammending the POCs! HC did not comply with this order within the deadline so I am hoping to have the case struck out - as it said I could apply for this at the bottom of the Court Order. When I was sent the Disclosure list they do not seem to have much to support their case - A copy of a microfiche copy of the 'credit agreement' (no mention of a copy of any terms and conditions) A copy of some statements A copy of the Notice of Allocation (how can they allocate the account with no T&Cs telling me they can do this?) Now I have their address I have just found this - Howard Cohen & Co | InterSolicitors.co.uk So they are advertising themselves as solicitors, no mention of Cohen Cramer and still The Lewis Group DX No. Still no record of them at that address on The Law Society website. Also their stationary is headed 'Howard Cohen & Co. Solicitors' not just Howard Cohen & Co. Small point but surely they should be called one or the other. Still Im almost ready to put my complaint to the SRA. Pookey

They were asked by Court Order to disclose all documents that they will be relying upon only documents they have are Copy of the microfiche copy of the 'Credit agreement' copy statements 'various' copy of notice of assignment The rest is copies of letters either myself or the Court has written and I already have these. I am going to start a new thread regarding this claim as it is dragging on and should not have been allowed to get this far. All will be revealed! Pookey PS They also missed the Court Order deadline by 3 days, and sent the docs 2nd class (so they obviously dont care). I am going to ask that their claim is struck out - as the Court order said I could if they don't comply.
  20. Finally got a disclosure list through from 'Howard Cohen', fortunately this is part of a Court Order which also states that I should be allowed to inspect the documents on this list. This gave me a golden opportunity to do some more digging!!!!!!!!! So I put on my best 'confused and don't really know whats going on voice' and phoned 'Howard Cohen'. After a quick intro, which involved giving a refernce number and no security questions - not even my name! I established that the 'Credit Agreement' they are relying on is a microfiche copy and they do not have the original - but thats another story! We then proceeded on to the main purpose of my call - I said 'Can I come and have a look at the documents?' HC - quite shocked 'You want to come to the office and look at them! I can send you copies' PM - 'No thanks I would like to see them in person' HC - 'Oh ok, we are open 9.00 - 5.00 Mon - Fri' PM - 'Can I just drop in?' HC - 'No you had better make an appointment' PM - 'Ok I will see what I am up to next week and call back. By the way where are you so I know where to come?' HC - 'Our address is Lawrence House, Riverside Drive, Cleckheaton, West Yorkshire, BD19 4DH' PM - 'Thats the same address as The Lewis Group, isn't it?' HC - 'Errr yes. We have and office in the same building' PM - 'Thanks bye' Put phone down to the sound of cogs whirring as she realised she had been scammed for the information I was really after - their address. So now we know 'Howard Cohens' real address in Cleckheaton, not the PO Box they hide behind. Who would have thought it would have been the same as The Lewis Group? Pookey

  23. No he is not dead, but they have merged with another solicitor to form Cohen Cramer. As such Howard Cohen & Co are only listed with the Law Society under organisations and as having one office in Leeds, with no registered Solicitors at this address. The address they are using on stationary to collect CL Finance debts no longer exists with the Law Society and should be questioned if recieved. Complain to the SRA if they can't give a reasonable explanation.   25. Very strange!! Their website doesn't even have their usual 0870 number. I thought I would give the new number a try (after witholding my no.) and was met by a very sad answerphone message - not even any jazzy music on it. Strange as all my paperwork shows they are supposed to be open Mon-Fri 8am - 8.30 pm!!!!! This may explain why Mrs Pookey recieved a strange letter last week (possibly a disgruntled soon to be former employee) containing a copy of some Goldfish statements - the last one from 2007 showing a credit to the account bringing the ballance to zero.
