  1. Hi Hoping for some help on here. I havent received tax credits since 2008 when I started working full time. I have out of the blue received.... a letter from HMRC stating I owe £484 from tax credit overpayment and need to pay or they'll pursue. The letter attached has a statement that says 2014 overpayment £484 I dont know where that has come from.... I definitely did not get tax credits in 2014, as said I last got them in 2008 as a student. I want to argue but don't want to acknowledge. Is it statute barred? I don't believe I actually owe them anything. Not sure where to start
  2. Hi no finance I bought it cash. Still waiting for the refund. It's dragging on waiting for them to recover the car and receive the key and log book. Someone's told me I should complain but not sure where it would get me at this point

  4. Thanks, the guy on the phone said well if it cant be repaired we will just refund. Obviously it can be repaired they just dont want to pay They're ringing me tomorrow with their decision Thanks again
  5. hi Long story - bought car 13/08/2018 2 weeks later lots of warning lights - car into AC who sent to Audi who advised needs ABS computer and part on back order - roughly 2k to 3.5k to fix AC have rung to say they're deciding whether they will just give me my money back. so my questions are? do they have a right to do that? I want that car, it took me ages to find it I'm in a hire car at the moment - I'm guessing will be better for them to put me in one of their vehicles so at least hire charges arent being added to their current bill Where do I stand legally - my rights. I've paid to have the car professionally polished, paid insurance, bought mats for it etc etc They're ringing me tomorrow but would love to know what rights I have Thanks in advance Gilly5001

  7. Finding your posts a little aggressive and I'm not sure why.....I have always valued posts on here. My last post asked for help with a defence and then life took over Without knowing any details I don't know why you would be so I've never taken replies for granted and appreciated people's responses - I know it's my fault I missed it, again no blame with anyone else I did read up thanks- and I asked for help I've come back to check as I remembered this was still going on - As for questions Oh rang Bygone times who said they would sort.... I don't know if they own as I haven't had any response to the request I made. He rang them as it was their car park we were on Again I'm not asking for help- I just apologised as the tone of your post. If I've a ccj I'll pay - sometimes things happen that divert your attention and suddenly a ccj for 175 quid is the very very least of your worries
  8. I'm sorry I'm not sure what I have done and not told about it? I explained in an earlier post that my OH had rang Bygone Times to complain and they had said they would sort it but that would submit anyway as can't trust Parking Eye. I've been unwell and missed the deadline to submit the defence - I did send them the letter as advised on here but didn't hear anything back thank you all for your advice - again apologies if I did something wrong:!:
  9. I haven't heard anything either from Parking Eye 're the above letter I sent or indeed after my husband spoke to the company whose land it was on who said it would be sorted. Can anyone help with the defence? It'll have to be submitted by the 25th February Thanks

PARKINGEYE LTD claimants Solicitors: NOT STATED BUT SIGNED BY ROSANNA BREAKS (CLAIMANTS LEGAL REPRESENTATIVE) Date of issue – 22 jan 2018 What is the claim for – 1.Claim for monies outstanding from the defendant, as registered keeper, in relation to a parking charge, issued 19/10/2017, for parking on private land in breach of the terms and conditions (the contract). 2.Parkingeye’s automated number plate recognition system, monitoring Bygone Times, Eccleston Main, Grove Mill, The Green, Eccleston, PR7 5Tz, captured vehicle Reg xxxxxxxxxxx entering nd leaving the car park, parking without authorisation. 3.The signage, clearly displayed the entrance to and throughout the car park, states that this is private land, is managed by Parkingeye LTD, and authorisation is required to park, along with other T & C’s by which those who park on site agree to be bound. In ccordance with the T & C’s set out in the signage, the parking charge became payable. 4.Notice under the Protection Of Freedoms Act 2012has been given under Sch 4, making the keeper liable. Thanks I will, inrewlise nit s fine but a penalty - I’ll probaby go back and check signage although I did see the sign I just didn’t read properly - it’s always been a car park for the place - a free car park. Would I be able to defend on that? It’s free but to use for the store - we used the store , just didn’t put details in the computer I’ll complete the details of claim and post up this evening
  13. Hi Three months ago we parked at Bygone Times in Chorley - there was a parking sign saying sign in at reception. At reception there was a huge queue so we bypassed mistakenly thinking you had to sign in if you werent a member. we showed our gold cards and entered the place. we bought several itsms - unfortunately don't have the receipt as it's all second hand goods/ antiques etc so tiny little till roll. week later parking eye £100 fine arrives with picture of car entering and leaving the car park - searched and ignored accordingly. have had a couple of letters since and again researched and ignored. today however a county court claim from Northampton has dropped through the door what do we do now? thanks in advance
  14. this is in their terms though Breach: This agreement can be cancelled if we are in breach of contract including if we do not provide facilities or services you may reasonably expect and we have fallen well below that standard it is this that I will be cancelling the membership under - looks like we will have to contact them

  16. hi thanks she stopped going two months ago and it's £20 per month. Im trying to find a head office for gymetc - my daughter doesn't want to go direct to the gym knowing they are all mates and people she know go there etc. I think she just wanted to walk away and they canx her membership and forget about it, perils of social media too I guess that everyone knows everything I'll ignore harlands - I didn't know whether to email them advising of situation and intention to cancel
  17. hi looking for some advice - my daughter joined gymetc where she enjoyed attending until some unwelcome attention from a personal trainer has made her feel very intimidated. he messaged her and told her things he'd imagined with her when she made it clear she was not interested. He told her that ither people in the gym had mentioned how the two of them were getting along. She is a very naïve and sensitive 18year old girl and now does not want to go to the gym. I asked her to let me contact them but she doesn't want to get the PT into trouble (silly I know but she is a worrier) Her friends redcommended she canx the DD and just ignore till they go away Now we have a letter from Harlands stating she has now incurred a further £25 charge and as such is in £89.98 arrears under your memebership agreement you have promised to pay this debt. if you continue to refuse to honour that commitment we will have no option to take further steps ignoring our letters is only resulting in further charges being added if you do not contact us by 15th august your balance of 229.91 will be passed to a debt recovery company who will add fess to their account. So - do I contact the gym or Harlands? she'll pay for what she owes although I'm not sure how much that is, perhaps £25 but she isn't paying the rest and we need to formally cancel. I'm happy to detail exactly why the inappropriate actions of their employees has led to this thanks in advance
  18. Yes evidence it wasn't a gift, has asked for money since about a year after loaned. Arrangement that it was beneficial to both parties but lendee feels kept her side and job was offered but declined by lender. Maybe worth pursuing - only evidence is the original receipt of loan 12 years since
  19. hi wonder if any one can shed some light on a situation. 12 years ago a friend lent another friend some money to set up a business. the friend lending hoped to be involved in the business at a later date. the friend who lent the money later decided she wanted nothing to do in said business as had found other work/ commitments. There was a receipt detailing money being loaned for business. no terms no repayments etc. as yet no payments back have been made as verbal agreement was, by the lender working with the business would recoup money loaned, this did not happen and the business was not successful the lender now wants the money back, the lendee thinks that she was let down by the lender. where do they stand? Is it statute barred? Does the limitation act cover this type of loan? TIA
  20. I don't think we've even had a default notice and nothing about terminating. Finding it hard to even look in to it due to work. Didn't get to speak to them today to pay the £500 so will be Monday now.
  21. I'll have a look into that thanks. If we pay £500 tomorrow we will no longer be a payment in arrears but part of a payment. Would they still be able to try and repossess? I'm going to sort time order this evening but Obv will take time to go through
  22. Hi not been on here for a while but had great success in the past thanks to all the caggers. I'm posting for my other half he has finance with mallard and has fallen into difficulty making payments. Starting a new job next week but they aren't interested. Lady on phone yest said if he doesn't pay £900 by Fri they'll come and take the car. I'm trying to find the default notice but can't locate so may have to add to this post after work this eve. Def have had one but it didn't say £900 by this Friday. Payments are £500 per month we can pay one on fri and then the next one will be due end of may which we can prob meet as well with this new job. Can they take the car with less than one month outstanding? I think the arrears may actually be more as payments started at £400 then hubby struggled in September/October so payments went up to cover. arrears. If they take the car he can't get to his new job and from what I've read we will end up owing a fortune and having no car. There's No Speaking To Them On The Phone They Are So aggressive and just state pay by Fri or were coming for it Can any one help?
