  1. Hi there My case in regards of Twopart ltd who went into default in September, we have been told they are on to it by the FSCS. However, we are ref number 00001 and both Deloittes and FSCS have confirmed they are dealing with it a priority case due to our personal circumstances, at least one of those reasons for serious mortgage arrears due to hubby's job loss and I care full time for my autistic son. Anyway on the 15/16 October Deloittes confirmed that our case was passed back to the FSCS for them to review it, as they completed it on their end, it was then confirmed by the 19th October by email by the FSCS that they have received our case details and that they were making a decision and reviewing our case. We decided on Tuesday just gone to ask them for an update, so hubby rang the FSCS and they told him they were still waiting for the details to come back from the FSCS, so hubby confirmed that we are aware they had already sent these on the 15 or 16th of October and also received an email from the FSCS on the 19th to confirm this. Anyway the guy from the FSCS said he was going to check it through and get back to us. Within minutes he did ring back and then confirmed that they are trying to get on with as many cases as possible and a decision will be made, and a letter will come out of the decision. Makes you wonder if they do actually check when you do ring them by being told different things, and yet someone else was told the same thing as us, and the very next day they received their cheque. The only number we had was the account number for the loan from Nemo, we had rang NU not long after taking out an advance in 2006 to cancel the PPI, as told to at first by Nemo, and told to ring NU, NU unfortunately could not help as the only policy number we had was the loan account number. Did anything come of this after? We did cancel after, after ring back Nemo, then told to put it into writing.
  3. Hi there Not sure in what happens when you have had the solicitors involved, but was this on a basis when you only pay if your successful? Like I said I don't know how this works, but if the solicitor have not been successful with the business where charges would then occur, I didn't think they could take a cut of your money, especially if you now take your case to the FSCS. Hopefully someone with more knowledge of this will post up. But if you have not done so yet, contact the FSCS to get your claim in, as they have now started paying out.   4. Thanks for all your above posts folks. I have an SAR from the lender Endeavour and have come across some useful information. I would like to confirm though, this I did ask a solicitor to have a look but it was withdrawn as it did not hit the amount on the limits of claiming, this loan is settled as well. Here I have some info from the paperwork, and how this was calculated, thought I would post it up, please tell me your thoughts on this, thanks much appreciated. An overall explanation of the loan taken out in July 2004 Settled by Nov 2005. (loan was secured over 25), and calculated using the Rule of 78. On the credit agreement Loan £21,000 PPI £2,835 Total to pay with interest future charges = £23,835.00 300mths APR 9.9% Settled at £23,646.04 that is including a rebate already deducted at £1,533.69. I have worked out £26,565.18 have been paid into this loan altogether in total, this includes the monthly repayments made until settlement, and the setttlement figure as shown as settled amount above. Worked out this going from the paperwork: 184.23 X 14 = £2579.22 (loan repayment) 24.28 X 14 = £339.92 (insurance repayment). This totals = £2919.14 They have calculated by 14 months, but loan was from July, so the first repayment was made the following month of August 04, so 14 months to October 2005 its been calculated to - to settlement. So £2919.14 (of what I already paid in without settlement) With Settlement of "£23,646.04". If you add The settlement of £23,646.04 and £2919.14, the total amount actually paid into this loan is: £26.565.18. Another way they have shown is this way = Amount borrowed in total = £23,835.00 £208.51 x 300 - £23,835.00 = £38,718 They explain that the total cost of the loan would be calculated by multplying the montly instalment by the term of the loan and deducting the original amount borrowed. Interest was not added as an upfront amount but was charged on a daily basis on the balance of total loan amount and debited to the account monthly. Also to add that found amongst underwriters paperwork, the first time we were aware of this commission, the broker was paid almost £1.7K for selling the loan an extre few hundred for selling the insurance. We have a case with the FSCS/Deloittes, but different company that were declared in default on 8th Sept 2009, my loan company was that of TWOPART, although my case have been with Deloittes since early July passed from the FSCS to them.   6. Hi there Sorry to butt in on your thread, but just to let you know that I am in the same position as you, but am going to keep fighting on this one. We taken out a loan in July 2004, broker - Click Finance and lender Endeavour, broker unfortunatey dissolved in 2006. However, received lots of paperwork back from Endeavour and underwriters paperwork show a number of companies, Click1, Click Finance and so on, as Click Finance are still running but a a different company number and will not take any liability at all, because even though its the same director, he says there is nothing he can do. Anyway, if you have your agreement, on mine it does not say a great deal on the terms and conds that we have with that, and to ask for the paperwork, "the policy of the PPI", they send you this on request, that I find interesting. For when we taken the loan out, for the Customers complaints dept, on the insurance it states that you must contact Hamilton Insurance, if they do not resolve by 8 weeks, then write to their own chief executive, then from there if still not resolved, you can go to the FOS. Unfortunately though as informed Click finance/Endeavour were not governed in 2004, so cannot take to the FOS. In the paperwork a copy of the PPI policy, and for Customer care, requests or complaints it states Complaints concerning this policy should be sent to Customer Services Department Hamilton Insurance PO Box 4718 Birmingham B1 3RF. If your not satisfied with the handling or your complaint have not been resolved within 8 weeks please write to "our chief executive at Hamilton Insurance, North St, Winkfield, Windsor, Berkshire, SL4 4TD". After writing to the Chief Executive, and remain dissatisfied or your complaint have not been resolved within 8 weeks, you can approach the Financial Ombudsman Service.............. This is signed then from the Managing Director and Chief Executive Officer "in respect of the Unemployment Insurance and in respect of Disability insurance where the initial term is less than 5 years where you pay disability premium. Signed on behalf of Hamilton Life Assurance Company Limited In respect of Life Insurance and in respect of Disability Insurance where the initial term is 5 years. Hamilton company number: 1656838 It then states that they are authorised and regulated by the FSA, incorporated with limited liability and members of the Association of British insurers and the FOS. Endeavour personal finance and the insurers are connected as they are both members of the same group of companies. Not sure if this occurs to you and when you taken this out, but if you do not have this 3 or 4 page ppi policy paperwork write to request for this, if you need the address details let me know. Hi there Unfortunately Lloyds TSB would not even offer advice, although they did say go to a debt organisation then maybe they will help if we do this, done this with CCCS and for just missing one payment they have sent a default notice by 3 weeks of when it was due, never ever received one of these in my life and now a so called solicitors letter. The default was giving until the 9th July, or hear from the solicitors, they certainly sent the solicitors letter out too soon, but there we go. Caprice, how are things for you today? Hubby lost his job like 1000's of others in this economical climate, I'm a full time carer for my autistic son, mortgage arrears are critical of over £3K, where this is still ongoing to being sorted out, soon we hope.
  8. Hi there Sorry to hear you are going through all this with Lloyds as well. Unfortunately all of our creditors are those of Lloyds TSB and like yourself we are with the CCCS as well but do not have enough for DMP yet, we have been advised to pay directly the token payments to each creditor every month, with also enclosing copies of budget information and even copy letters of our mortgage arrears, where we are trying to sort this out as well as a matter or priority. If your like us, they have been sending letters of payment demand everyday, we only started the token payments in June 2009, before that there were no arrears as we were using the overdraft to pay it, but we had to do something as that is coming to the limit. We have also opened a new bank account elsewhere, which has nothing to do with lloyds tsb, and gradually things are starting to settle there. But am unable to completely close it because of the arrears. They so far have not accepted on anything or by freezing the interest etc. We have received 26 letters now in just a month, some to say thank you for the token payments and the others to say they will not accept them, and others to ask for payment. We received the first default notice already and today a solicitors letter asking us to pay for the full balance, but reading through different threads and sites, I found out the solicitors are those of lloyds, or used by lloyds, working for them then. I have also been told by CCCS just to carry on as we are, as we cannot pay what we have not got, and things will eventually settle. I will also keep an eye on your post if you don't mind.   9. Hi folks Hope all are well. Sorry I have not posted lately, been waiting for response from both the DWP and Chelt&Glos (LLOYDS). So far, the update is that the DWP sent us out a questionaire in regards of helping towards the mortgage, not sure for definate if this can be done yet, as hubby does have pinnacle protection (income protection) which only covers half of that amount of the mortgage, and C&G (lloyds) have stated if the DWP helps, it can be arranged to pay £575 a month for the interest from repayment, as our normal payments are that of £745.98 a month, and that we still have to find the funds for the arrears. We are still paying what we can when the pinnacle ins comes through which will end shortly anyway. We are now just waiting for a response from both the DWP and C&G. Despite that, as many of you know it has been arranged through the CCCS for us to make token payments to the unsecured creditors which are all Lloyds, for 2 unsecured loans, 1 credit card and the overdraft. We paid the token payments at the end of last month ready for them to take for the repayments due at the beginning of this month. Anway, with the token payments we sent the letters as sorted out by the CCCS with also copies of our expenditure, so they will be aware of the arrears. We opened a new standard bank account with Co op, but to move everything like the priority Direct Debits it's taken time and will not come into affect until 26 June. I cancelled the loans by DD at the end of last month. Received the autmated response a few days after the loans were due where they should have received the token payments and letters by then, these letters we received were the ones to state they are aware the DD have been cancelled, they send mandates. However, yesterday both myself and hubby received letters to say "thank you for the token payments we have credited them towards the loans, so we thought, great they have accepted our payments and letting us know they have taken the token payments. Anyhow, I decided to go online banking to check what is what as I do regularly to keep a check on DD's. And noticed they also taken out my hubby's loan repayment, the full normal amount minus his token payment they already taken. So, as this is way into the overdraft the money paid in the same day until it takes affect at the new bank from pinnacle went in where we arranged to make a bigger payment towards the mortgage, but because lloyds taken advantage we were stuffed. They taken it as soon as it was paid in !! Hubby rang Lloyds at Peterlee where the letters came from in regards of the token payments, and we have nothing against foreign people but she was unfortunately hard to understand. Hubby explained about 8 times the situation and they taken the token payments and also the loan from the bank which was cancelled for the time being while he is out of work, she kept saying, from what he could make out "its not enough", hubby did get a bit stroppy and said "you want us to lose our house do you"? She first said they never received any letters from us, hubby then said, well you must have because the token payments were enclosed with them, then she said, "okay I will refund you £34", hubby said "no way", you refund that all that money of £228 straight into the account like you taken it, its towards the arrears on the mortgage", she then said, but a token payment you made is not enough. Hubby then asked to speak to the manager, she said "sorry he is not available" hubby said "how do you know that though, you have not checked", she was stumped. Hubby then said, "I've had enough, I'm going to complain and if this is not resolved, its going further with the FOS", she then said "the full repayment of £228 will be refunded straight into the account", but so far its nowhere to be seen !! I did yesterday afternoon decide to write to the department and told them if this is not resolved it will be taken further. Sorry this is sooooooooooo long, just want to give you an update. Do you know if there is anything we can actually do about this, now I have a feeling that they are going to take £111 for my loan, but have to leave some money in the account just for the next 2 weeks for priority payments, until its all over at Co op?   11. I would like to thank all of you, your all amazing, so a BIG THANKS to all. Almost all my new banking details are through with Co op, just wait for the pin number now. And as I sent the letter Ell-Enn sorted out for me in regards of the mortgage to both Chelt & Glos and Lloyds as they are working together on this, I am yet to wait for a written response, one thing I have noticed though they have not rang to harass me like they were since receiving these letters. Ell-Enn thank you so much. I must when I have some spare dough donate to this amazing site, how do I do this? I can't thank you all enough.

  13. Thank you. Yes your right, and so glad hubby continued to stay with these, they also reduced the union monthly repayments until Dai finds a new job. Forgot to add on an earlier post, we opened the new standard bank account with Co Op, most helpful as well and we should receive the banking details tomorrow. I don't think these are linked to lloyds are they? I hope not now lol..... Cheers so much X

And a bit of news from hubby's union, they said if Chelt & Glos/Lloyds can agree to take this to interest only, the union will consider paying the arrears for us, unfortunately it stands now at £2K, we received a letter through this post this morning. LLoyds still continue to ring and if we missed the calls, such as when they leave messages, we have never failed to call back, anyway, the union said we must practically BEG lloyds on the phone about the interest and about the arrangements ,he also told us to pass on his contact details for them to call and make these arrangements. We think its a fantastic suggestion, so lloyds did not quite know what to do about this, but passed us on to Chelt and Glos, believe it or not the guy we spoke to there was probably the most nicest of them all so far and even said he felt sorry for us in our current situation, as he notes that we asked for this (as seen on the system) when hubby first lost his job when then there were no arrears at first, we asked about the interest payments. Anyway, the guy said he will contact lloyds to tell them to stop calling and block ringing us for about a fortnight whilst this matter is being sorted out. It has been suggested now to request the union manager to write to them as its in Black and White, where they will then crack on with this and then put an arrangement in place. Soooooo follks, all looking hopeful, I will post again tomorrow if any news. Thanks for all your help and my hubby said the letter is fantastic Ell, we both are very grateful for this.

However with the unsecured loans we have been advised to pay token payments to the creditors (not behind with any of these yet), but this is to find more money for the mortgage sort of thing), so I taken it them meant by postal orders??? We have 2 unsecured loans with lloyds Hubby has 1 credit card And then the overdraft. =4 lots of token payments and they are all with lloyds lol Over the counter slips, great idea, I should have thought about that one lol, silly me.   16. Forgot to ask, I am about to also request a Mortgage payment booklet, does anyone know if providers do these and especially Chelt&Glos? lol. Not have a cheque book anymore and do not want to pay over the phone and give new banking details really, due to going with CCCS for token payments arranged for all lloyds unsecured loan creditors. While waiting for the payment book if they do this, is postal orders okay to pay the mortgage for now? Cheers again.

Not a bad union overall, so far so good, in fact the guy from the fund we applied for yesterday said he will get on to this straight away and see what they can do to help altogether, he was the adjudicator-manager/Boss from the union, he said to hubby "he understood" and more must be done, so fingers crossed, he is supposed to be ringing early part of next week, every penny helps for the mortgage. Can't remember if I said before, but where my hubby worked, the steel plant went into administration, due to this himself and about 399 other workers are due for compensation which has been won at courts last year, and its only now a matter of time when they will receive this, the union guy from Cardiff confirmed this the other day. The guy that rang yesterday was the one from London........what you call the BIG Boss.:grin:

  23. Hi there and cheers for asking. Account all sorted. Appointment went pretty well with CCCS on Thursday, but unfortunately a DMP could not be made at this current time until the finances improve, they sent us the letters by email attachment to send to the 4 creditors about token payments only, where we would have more left to pay on the mortgage. We have since been in touch with Chelt&Glos (lloyds team) and for once a nice guy who my hubby spoken to said, obviously try to pay all we can, and as soon as he returns to new employment (with a bit of luck it should be soon), they will make more official arrangement, but meanwhile keep paying what we can, it helps but its not actually going to stop the letters. I thought Chelt-Glos (lloyds) had started the scheme, but they have said not yet. Anyhow, nothing has actually been signed with CCCS as its not an official plan, but hubby heard from his union, where he still pays a small amount for every month (as has been with this steel union) Community of life union for a number of years, but whilst unemployed due to the plant going into administration he now pays the reduced payments for this. Anyhow the union said they can also help, we completed a "Bens fund" form, this is for hardship, where we might have some funding, this was completed over a week or so ago, but anyway the guy from the union rang yesterday to ask how the CCCS appointment went, we explained there is not enough left for a plan and the union dept are supposed to be calling back early part of next week to see if they can help even further, especially due to the mortgage arrears. I will keep you updated, thanks so much.

  25. Cheers. I was checking through the case studies on the site also. Not sure the amounts to enclose on the form though, as they don't state a limit. We are almost 3 months in mortgage arrears until something is sorted out with CCCS, even though we are making token payments of up to £60 each week or less. Overdraft limit coming to an end and with a child with autism/disabilities, we should add that as well. Would you class that as severe hardship though? Not had repossession letters yet but am expecting them anytime. Thank you.
