  1. This is interesting. We had cleared our credit cards with a secured loan approx 3 yrs back, and come to think of it, insurance was added to that too ! We never asked for this and assumed it was automatic at the time, surely thats not right is it ?? Wonder if it's too late to claim on this, as of course when we cleared these we had to pay off the insurance too to what i can remember !! Any advice/info will be gladly appreciated, and how to go about it. This was with Lloyds Tsb !! (There is possibly a forum for this on here, but just been browsing at others too), (and have not had the chance to get through them all yet). Many thanks again. Di
  2. Hi, at this present time our complaint regarding ppi in which we had a secured loan is being dealt with by the Ombudsman. We had just missed the cooling off period, and cancelled anyway as we were advised that the way our loan was dealt with it was mis sold to us. They had no problem cancelling it, but we are still paying for the full ppi in with our loan repayments, as this is added in together if you take out that loan company recommended ppi. The total of approx £8-£10K is added in with the loan. When we had the loan, we mentioned about getting the insurance elsewhere as it would be a cheaper option, but basically we were told that we must have it or borrow more to pay off the loan and insurance etc, which would work out a lot more ! There are many on these forums with the same problems or similar, and as I am no expert, I'm sure there will be some boards on here that will give you the answer and advice your looking for. We had cancelled ours, and explained that we believe we were mis sold the ppi, and for them to resolve this as it is a lot of money, so as they did not resolve this and we were not happy with the way it was dealt with we sent in a complaint with the 'financial ombudsman service'. I think you must give something like 28 days for the company you are complaining about a chance to deal with this, and if not dealt with and/or if your not happy with the outcome then you too can complain further to the 'FOS' as we did. Our complaint has been with the FOS since Nov 2006, but were recently informed it will be dealt with asap. Everyones complaint is dealt with various times, some has been resolved by the FOS within a month, ours is obviously still ongoing, and may depend if they need more info from both parties too.   3. HI KEITH MANY THANKS FOR YOUR REPLY. YES I'M SURE WE WILL HEAR SOMETHING VERY SHORTLY FROM THE OMBUDSMAN REGARDING THE COMPLAINT. WHEN WE DID COMPLAIN TO THE LOAN/INS COMPANY THAT DID NOT RESOLVE ANYTHING FOR US REGARDING OUR POLICY BEING MIS SOLD WE SENT ABSOLUTELY EVERYTHING IN EVIDENCE, EVEN COPIES OF LETTERS WE SENT TO THE FOS. ME AND MY HUBBY NOTICED THAT WHEN WE RECEIVED THE RECORDINGS OF THE TELEPHONE CALLS, MAINLY THEY WERE ALL FROM THEM, AND WERE NOT IN ANY DATED ORDER, BUT THERE WAS A GOOD ONE ON THERE THAT SHOULD HOPEFULLY HELP US OUT, AS THIS WAS PROVED TO BE PUSHED ON US WHEN WE INFORMED THEM WE COULD HAVE A CHEAPER STAND ALONE POLICY ELSEWHERE-AS THIS ONE WAS FORCED ON US, AND WAS NOT ACTUALLY GIVEN ANY CHOICE IN THE MATTER. I ACTUALLY MADE A CALL TO THE COMPANY AFTER THIS CALL THAT WAS NOT PICKED UP ON CD DISK RECORDING, I HAD QUESTIONED THE COMPANY ABOUT THE POLICY, ABOUT WHY DID WE REALLY HAVE TO ACCEPT THEIR POLICY COVER AND NOT GO ELSEWHERE AS IT WOULD BE CHEAPER ?? TO BE HONEST THEY WERE READY WITH ANSWERS. AND THERE WAS NO GETTING OUT THEN !! AT THAT TIME WE ASSUMED THEN-'AH WELL WE HAVE NO OTHER CHOICE BUT TO TAKE IT' !! I AM ANNOYED WHY THAT RECORDING WAS NOT ON THE DISK, BUT HOPEFULLY IF THE OMBUDSMAN DEPT LISTEN VERY CAREFULLY ON THAT ONE AS STATED ABOVE AS IT IS PRETTY QUIET ON THAT ACTUAL ONE, THEY WILL KNOW WHAT WE MEAN !!! WE NOTICED ON THE RECORDINGS TOO, LIKE AS IF IT WAS JUMPING AND MISSING !! WE ARE TALKING OF APPROX £8-£10K WITHOUT INTEREST OF INSURANCE !!   4. Hi keith, Looks like the ball is rolling on for you then, thats great. You had answered my forums recently, last time i checked out was before xmas. (maybe on a different forum) !! This was regarding my mis sold ppi, which was sent finally to the ombudsman in early Nov 2006, and we had one feedback from them in the middle of Nov to inform us that our case was being passed on then for further consideration and that they will contact us asap to inform us of the progress. That letter was then sent from the Consumer Consultant. We are aware this can take time, but as we did not hear anything after that one letter, we emailed them a few times before and after xmas to ask of the progress as we had no further updates since. Then we received a letter dated 3 January 2007 to inform us that due to the volume of cases they are dealing with at present which has meant that they have not yet been able to allocate the complaint to one of their adjudicators so that it can be assessed. However, they then stated they will do this asap and contact us again within 4 weeks to keep us updated on the progress of the complaint.This letter was sent by the Team Administrator. We know it can take 6 mths or more, but to be told in Nov 2006 that our case was being passed over then and that we will be kept informed of the progress asap, then now to be informed it has not yet been allocated we are obviously disappointed, as this is really still at the beginning of the stage-process almost 2 mths into it since our complaint has been received by them. This is putting us into difficulties financially too, so the quicker they deal with it the better as they are aware of the all the background too. They have all evidence possible including a recording disc to listen to that should help..........hopefully !! Hope all continues to go well for you, it just shows there is hope !!   6. HI THANKS FOR GETTING BACK TO ME. I HOPE ALL GOES WELL FOR YOU TOO. I DID EMAIL THE OMBUDSMAN DEPARTMENT TODAY-SO JUST WAITING FOR A REPLY FROM THEM NOW, THIS WAS TO ASK THEM IF ANY FURTHER UPDATES HAVE BEEN SENT YET AS WE HAVE HAD LOTS OF MISSING POST. SO BASICALLY SINCE OUR COMPLAINT FORM WENT IN WITH THE EVIDENCE ETC THE ONLY LETTER WE HAD BACK WAS DATED AS STATED 22 NOVEMBER 2006 TO INFORM US THIS HAS BEEN NOW PASSED ON FOR FUTHER CONSIDERATION AND THAT WE WILL BE KEPT INFORMED OF THE PROCESS. I AM AWARE THIS CAN TAKE UP TO 6 MONTHS OR SO ACCORDING TO THEIR BOOKLET/LEAFLET, BUT ISN'T THAT ONLY IF IT GOES AS FAR AS THE ACTUAL OMBUDSMAN AND NOT THE ADJUDICATOR ? FROM WHAT I CAN MAKE OUT THIS IS ALWAYS DEALT WITH BY THE ADJUDICATOR AT FIRST THEN PASSED ON FURTHER TO THE MAIN OMBUDSMAN IF THE CASE DOESN'T GET RESOLVED. Hi, Mine is also being dealt with by the ombudsman department right now, did get a letter back to inform us that our complaint was being passed onto the casework area for further investigation for further consideration and that they will write to us asap to keep us informed but nothing since. We had sent all the docs and evidence regarding a mis sold ppi with nemo loans, to the ombudsman at the beginning of Nov 2006 and we then received the letter about this from ombudsman dept 22 Nov to inform us of the above stated. When we had taken out a loan with nemo-loans they would not take no for an answer, as we did mention we can go for a cheaper alternative elsewhere (standlalone) so we were made to believe we had no choice. Then we had taken them up on this, but had some advice afterwards, thats when we were told to cancel etc and ask for full refund, and also complain about this being mis sold. We had done all this, but the company did cancel but still added the insurance on the loan with the new repayments etc, but they did not resolve this when we did ask them too, so thats why its now with the ombudsman. I do hope things work out for you !! So have you had any feedback from the ombudsman dept yet ? Cheers. x;)
  8. Hi Thank you, I will keep you informed of the process. I have been informed once the case reaches the Ombudsman staff they are very good at dealing with these issues. So fingers crossed all will go well !! !! Have a lot to deal with right now, because where my hubby works there will be redundancies this week, in which he did attend an interview last Friday just in case, and also waiting to hear if he will be successful for a local company for an interview too. We have 2 kids, and with xmas coming, its a very hard time, with one of my children under special needs where i support him full time. I just hope the company that sold us the insurance policy can see sense with the way they pressurised and sold us the insurance. As now we were informed by an adviser this sounds like a mis sold policy and to cancel and to request full refund of the insurance and interest, this was done, we put in a complaint to the firm. They had cancelled, and only reduced it by £15 and with the new loan repayments the insurance is still in with the amount as we cancelled it after the 30 days. We have since had a letter from the company that due to the rise of interest rates, they have now put up the repayments of the loan, so now we are paying a lot more than what we did in the first place with insurance, and even though we planned to remortgage, and get optional cover for this loan, we now cannot afford too, and cannot continue with the remortgage until this is resolved. !! I have also asked on the complaint form as we feel we were treated unfairly by the company we expect them to compensate us too, because of this not being resolved by them when we complained they have now put us in financial difficulties, also to the our existing mortgage deal that ended last month and where we will be paying now over £56 more a month. So the longer this goes on for the more we will be asking due to the inconvenience they have caused. I will keep you well informed.............cheers.

Consumer consultant. ..................................................................................................... ok, case not resolved as yet, but another step taken. It can take upto 6 mths or so, but hopefully if this can be resolved sooner all the better. I really cannot see a problem due to the recordings taken, but i suppose this may depend on how the case worker see's it. Hopefully it will go our way. I am not going to give up, we were forced into keeping this on or borrow a further £7-£8k extra on top of the advance loan to pay for the existing ins cover, yet classed as a new loan and ins etc. Will keep you informed. In the meantime, all you fighting for anything, the best of luck.
  10. Hi Well at this present time, I have sent complaint forms back to the ombudsman, really dont't know how long this will take as such, but i do know it can take up to 6 mths in total. When i complained by letter dated 24th Sept 2006 to my loan provider of Nemo-loans regarding the mis-sold insurance policy it had taken last week for me to receive their final decision, nothing resolved, so with that decision they sent they also provided a leaflet if i wanted to take this further to the ombudsman. I had emailed the ombudsman anyway whilst i was waiting for the decision, and was sent forms by them last week, I had sent them back with as much evidence as possible to help support the complaint. I had also asked nemo-loans on cancellation for a full refund plus any interest added, but like yourself they had deducted off the payments. My loan is secured, and this was on the loan advance, as we already had insurance added with the first loan we had from them last Nov 2005, they automatically added this to the advance, when asked for a quote, when we asked for a quote without one, (as to our knowledge-new loan and optional insurance as stated in policy booklet and documents), they did not advise it, even when we did mention we would get it covered with a standalone cheaper one, but they would not hear of it, and said if we did not continue with the insurance we would have to borrow a further approx £8k to the loan advance to cover of costs of the first one !! Weird considering they stated as a new loan they to end the last one, they recalculate it as the first loan ended earlier. This was also recorded in which i am surprised when nemo sent the decision they had sent this Disk, but when adding it into the CD tower it came up on screen that the recordings were not in any particular order of dates, very jumpy too, and parts of conversation were definately missing. The main one with the quote lasted approx over 20 mins, in which that was the loan adviser and my hubby, but mine was not found, i had really questioned into this to the loan adviser about the insurance, i dug deep, but as it was only within a few days of when my hubby was talking to her, mine should of been on the recording too !!! When the ombudsman will hopefully listen to this, they will have to really listen to the part with the quote when my hubby asked for a quote without insurance, as she was cutting in on my hubby, but i could hear it, the loan adviser was saying we would really have to continue with this or borrow more again, and look what we would get back in 5 years if we kept it going and not claim !!! She was pushy and we didnt end up with a quote without, but there was definately parts missing of the conversation too that i really hope the ombudsman will pick up. we then assumed we had no choice down to our circumstances of the first loan insurance. I was going to also contact my phone provider to ask if they could send statements of all incoming and outgoing calls made to us and nemo from when it all started to see if they mins add up, as all calls recorded were made by them and not us !! If i were you, try to get as much evidence as possible. How long ago did you take the loan/ins ? Was that your final decision you received, or have you actually sent off a letter of complaint to your loan company regarding your insurance ? If not do that first, make sure you have copies to keep for yourself, and anything they send back keep as your evidence and send off with your complaint form from the ombudsman if it goes this far. Hopefully your issue will be resolved after you complain to your provider. There are many people on these forums with same problems, they will also advise you what to do, in the meantime i am hoping mine will be resolved soon too, as this insurance is over £10k, they are still adding this cover to my loan even though i cancelled the insurance !! Hi, We received our forms from the ombudsman in which we will be sending this off Monday-by special delivery post as we also have a recorded CD disk that was sent from Nemo-loans-when we played this on our disc on PC the dates were in no particular order-quite jumpy too as if there's bits of conversation missing regarding the loan quote. The main part was 21 April which that call lasted just over 20mins in which we were advised to continue with the insurance or we would have to borrow more, instead of £55,000 it would then have to be £63,000 to cover costs of the existing insurance of the first loan !! We were then informed if you also keep this going imagine what we would get back in 5 years so so !! We were confused on this and thought we had no option we would just have to keep this going or we would have no choice and to borrow more, so we accepted the insurance or otherwise borrow more. My husband stated 'buts its optional and its a new loan' and the loan adviser said, 'yes its optional but really as its an advance and a new loan if we dont go ahead and keep the insurance we would be paying out more a month and losing as we would have to borrow more' it goes on and on with no other options even when we said there are cheaper options, but she was not having it. We know this can take up to six months, but as we have all evidence with the CD, could this be resolved quicker ? We have now got to pay a higher mortgage payment a month too:confused: , as our deal ends this month and we were going through the process of a new mortgage deal. We unfortunately cannot go ahead with the new mortgage now as this has to be resolved first. (any info/advice will be a great help-thankyou).
  12. We received the final decision from Nemo-loans regarding the mis-sold ppi in which they fully deny of this being mis sold. They even sent the CD recording of telephone calls which are dated from approx April 2006 onwards even though we applied for the advance in January 2006. The recordings were not in a particular order and yet i have not come across mine when i asked about the insurance for a quote without too !! My husband who then dealt with the quote was recorded which lasted over 20 mins and he asked for a quote without the insurance. The sales adviser said if she was him was to carry the insurance on as we had one with the first loan, or we would have to borrow a further £8k on top of the loan advance to cover the costs of the first loan insurance. She was very pushy and then we didnt think we had any alternative, even though we were curious what the quote would be without. She kept saying if we didnt take it on we would be paying out more for the loan anyway as we would have to borrow that extra, and our home would be at risk. You can also hear the part when my hubby is saying 'but its optional and there are other cheaper options' ! She was not having it and then stated if we kept it on imagine in 5 yrs we get a lump sum back in return. In the letter the loan company have stated there was plenty of time to think about not taking the insurance on as we did not proceed with it for a while after, so as we were already existing customers to these anyway we thought 'oh well no mattter what we do even if we did shop around elsewhere it would still work out costly if not more, so we continued in July this year with the advance and accepted the insurance as we didnt think we had any choice although the policy states it optionl. My hubby tried his best to get a quote without and she just would not give one, she just kept going back about 'but if we didnt take it' !! In the meantime we are waiting for a form to come through from the ombudsman. Also on the recordings there were 3 missed calls and everyone call was them ringing us to ask about when we were sending in the documents as they were worried that they hadn't received them yet. (please could someone inform us.....being pressurised to continue with this and if we didnt continue with the insurance-would this be classed as mis-sold)? Many thanks.
  13. Hi Over the years we have had loans with Lloyds Tsb, we have been customers with them for approx 14 yrs or more. When we have had loans they have automatically added the insurance. Last year we finally paid off the loan a few years earlier, then the loan/insurance was calculated to the settlement figure. We had informed them we were paying the loan/ins off in full by the following Monday when we had the funds in which we asked for a settlement figure. They gave us the settlement figure the Friday before but stated it may change the following Monday due to the interest. And it did by a few hundred. When it was fully paid we didnt actually receive anything back as such yet we had paid 6 yrs earlier to a 7 yr loan. Should we have had anything back, or is it just recalculated into a lower sum ? (by removing the ins) ? A few years back we are certain we did have cash back in the bank when paying the first loan off early ! We are totally confused on this. We are also interested in finding out about bank charges too. We are platinum customers to Lloyds. Any info will be a great help-many thanks. Di ;-) xx
  14. I am also seeking as much info as possible regarding a mis sold insurance policy. Our comment is also on Financial News, City News, Mortgages, Loans, Savings, Pensions, Market Reports | This is Money where it states 'too late for millions ppi' !! Added in late Oct 2006. We had a secured loan with nemoloans last Nov 2005 in which the insurance was added automatically then going through the process for an advance we received in July this year, we had realised about stand alone far cheapers insurance and asked for a quote without insurance. They would not do this and said we would really have to carry on the insurance (although classed as a new loan etc) as if we didnt then we would have to borrow more on top of the advance to cover costs for the existing ins cover !!!! We have since had some advice and was informed we should cancel and ask for a full refund immediately, in which we did. We sent a letter dated 24th Sept 2006 to inform them we discovered that we have been mis sold with the insurance and that we would like this cancelled within 7 days and to refund in full. We received a letter back from Nemoloans on the 3rd Oct 2006 to inform us they received our letter on the 27th Sept 2006 which is being investigated and will get back to us within 28 days, and that the insurance is now cancelled. Anyhow in the meantime we were sent the new loan repayments in which the calculations still show the added insurance premiums that we will still be paying for = £10K added on the loan. As we never had a quote without the insurance we worked it out ourselves how much extra of the insurance we were paying a month on top of the loan. The extra without the loan is just under £90 a month. Since the calculation they have only knocked off £15 a month, so instead of paying £514 and the odds a month we will be paying over £498 a month !! In the meantime this is still being investigated. We received the last letter from Nemoloans last week (letter dated 25th Oct 2006) to inform us has 28 days have passed we are entitled to a further 28 days going by the FSA Rules, but will anticipate to send us final decision by next week-which was this week just gone. We have not heard a thing from them about this. We refuse to speak to them by telephone as we have asked for all correspondence in writing for our records. The loan company have also has us to visit them to resolve this, but stepping on their soil we will be pushed in the back seat on this and will not do this. Please any information and/or advice will be a great help. We were supposed to be dealing with out new mortgage too as our existing deal ends this month in which nemo are aware but we cannot do anything until this is resolved, which means now we will be paying a higher mortgage !!   15. Hi Not sure if anyone can help me and advise me, will be very grateful. We have been customers to Lloyds TSB approx 14 yrs, and over the time have been charged hefty charges. How do you actually go about putting in a claim from your bank ?? Thank you all info/advice will be a great help, thanks again.
