  1. £750 is a standard amount they offer, if your claim is is just over a grand or even 4k they still apear to offer £750, they try to get rid of people by doing this and im sure some people give in, personally go for the lot people, take it to them, remember Lloyds made i think it was 4.5 billion last year!
  2. sorry, bump, just want to know the answer to the above before the weekend, would be good to send this off today. Read the guide again and it does say whatever court your case is at, i have no court yet so i send it to Northampton? Would this work?
  3. Claim filed on MCOL as needed to use a credit card to pay. Claim number - 7QZ82784 Do i need to send the Charges spreadsheet now? or do i wait until i have a letter from the court? Im thinking send it now, where does it go? i read guidelines but it says change address dependant on what court you are at! Take it i send to Northampton now?

Ok im finally going to file for court action, while collating my info i noted that i had claimed two charges qhich quote "unpaid loan" now basically i missed a payment on a LTSB loan so surely its classed as Unpaid D/D which is what it really is. Can anyone confirm this is ok to claim? Doesnt add up to much anyhow, one charge was £25 the other £17.50.
  5. From what ive heard there will be no appeal as new evidence is not admissable. This means a new judge would more than likely rule in favour of the bank as did the first. I believe this case is beign passed to teh Ombudsman.

  7. Thats there way of cloaking a penalty. They claim these are fees for a service but are in fact penalties. Penalties should be charged at how much it costs the business, maybe a little more, certainly not 20 times more.

  9. Interesting but i still think the Judge has as Consumer Group commented made a mistake. A banks charge for going over your overdraft is ridiculous, you have an agreed overdraft then they let you go over it in order to make money out of you. If they didnt let you go over they would just bounce the item costing them a mere £2, thus i would hope for a successful appeal on this one. Happier now to proceed with my court claim.
  10. A dear o dear, filing my court case in 24 hours. Still we dont know what was claimed, maybe something else went wrong! Will wait for more info. Did they turn up? blimey!
  11. I'd say quite a lot, seeing as when you get to court most if not all banks pay up before having to go into court. This gives them more time to settle and saves court battles and further costs. Lloyds on the other hand will probably go as far as waiting for a court date before settling

  13. Ok no response yet, i had made a mistake in claiming 8% from the start. Question is as not to look stupid shall i send an amendment and give them 14 more days or just file the court papers?

  15. I claimed the statutory 8% from the start, surely if you wait and they settle you will be like "oh no what about the interest, maybe i should have asked them!" Definately send a schedule.
  16. Aha i probably should have checked that. They are probably made up names on initial requests anyhow. Either write them a demand requesting settlement in 7 days or im afraid its time to file for court action, my LBA has just gone overdue i am going to file in 7 days from now

  18. I have just contacted my "mole" in Lloyds. Will see if i can get a number, its doubtful they will listen to you though! We shall see.
  19. This is unfortunate timing. Did you receive a response to your initial letter? that letter usually a FOB off letter usually has a name and department on it. If you can tell us this we may be able to assist. I have to say though Lloyds tend to take the longest to settle, usually they hold out until they hear about a court appearance and then settle.
  20. 11/05/07 - Still no response, as my post is being re-directed i will give them 1 more week before filing a N1. Quick note, i got a letter from the Statement Request team, copies of my statements, i ended up getting them online as 5 years were on there anyhow. Im sure this has been mentioned before but the Department who sent me my statements said and with no nudging from me "You may now wish to reclaim yuor bank charges" this came from Lloyds TSB, they are telling us to claim so why they defend at all i dont know. Just a note - i never told them i was claiming back charges, i phones bank and aksed for statements!
  21. I will start by saying normal service charges can not be reclaimed. They are the charge for using that type of account. I am very surprised you have only been charged £7 for unauthorised borrowings, ive been through mine and couldnt find any charges below the £12. You can reclaim on - Unauthorised Overdraft Charge, Returned DD's or Standing Orders, Bounced Cheques and interest charged on charges they have taken from your account, have to be careful on that one though, as you can only claim the interest they had charged against your bank charges and not against any balance you may have withdrawn. There is lots of advice on this site, take a look around
  22. Then they will be making thousands of pounds on charging us for them! Neverless you can get 5 years online, so may be worth most claiming the five years and making another claim should they wish to go further back at a later date
  23. Oh dear, sounds like bank madness to me. Sounds like something i went through a few years back, something i am now claiming most of back due to "excessive charges". I would stick to a payment plan and then take them to court for all the charges you can find. This will probably put you back in the black and all will be happy.
  24. This appears to be a seperate issue, i wouldnt revise the amount you are claiming at all. They can show the prove of what they have paid when it gets to it. Sounds like its interest on an agreed 0% overdraft being repaid. Not apart of your claim i would suggest.
