I have been charged £25 x 2 for going overdrawn accidentally for three days (the second charge was for making a withdrawal while already overdrawn on day 2 it seems).

 

I have spoken on the customer services number to a line manager and they agreed once I pushed and mentioned about the unfair charges to refund half (which I accepted but made them aware that I wanted the other one removed too)

 

When I mentioned the Goods and Services Act the manager told me that this was not valid as the account I opened was not covered by this but by the Credit Act.

 

Also the first gentleman that I spoke to DID say to me that there was a level of profit made from these charges, which I assume he was not meant to do.

 

Whats the best course of action from here ?

I may be wrong but you can only use the Goods and Services act if they are claiming that the charges are goods/services... hence not being applicable, if anything you need to quote the Unfair Contract Terms in Consumer Contracts Regulations...

 

Of course you can try phoning them again, or popping into your local branch, if that fails then start with the typical procedure of sending letters etc as outlined in the step-by-step guide in the FAQ's 8)
