D&G asked for breakdown - should I add in charges since claim started?

Hi there,

 

I have been trying to get my charges back since my first letter in Dec 06!!

 

I had to go down the route of MCOL and pay my £120 and to cut a long story short I had till the 16th May to talk with HSBC and agree a settlement... obviously I sent in a letter by recorded delivery..... and then got DG solicitors asking me for a full breakdown 2 weeks later..... well past the date stipulated by the court.

The court letter also states that we are to send details of how discussions went by the 2nd July for them to look into.

 

My Questions

1 - Should I give them a date that I need to get a settlement by? i.e. "I would need to have some sort of settlement in place with you 7 days before the court asks for the information, in order that I can comply with their wishes and get the relevant information to them if no settlement has been made."

 

2 - Should I ask for the additional charges made since Dec 06 to be added to the claim?

Welcome to the site.

You can claim for anything on the claimform.

They are not obliged to pay further charges,you can either try and negotiate they pay them,submit an ammendment to your claim POCS which will cost you 35.00 or else file another claim later.

If there are a lot of charges then I would file an ammendment to change the amount being claimed if DG make it clear they will not be paying them.

 

Make sure you comply with and directions the Court has ordered and if they fail to do so then you should apply to have the defence struck out.

Thanks Martin,

 

I think I will do a separate claim after this one as I don't want to confuse the issue with them (i suspect any excuse will do!)

 

I have to send all my letters nd evidence of conversations by the 2nd July....

 

Can you tell me if this is the same as the court bundle and also can I ask for their case to be struck out at this stage as they made no attempt to contact me by the original court instructions of the 18th May?
