Morning everyone. Still considering my approach re settlement letter from HBOS.

 

Not inclined to accept it as-

 

a) No action on default on this redeemed mortgage which is directly related to charges on BoS account. They say they will not do this. Charges applied to many of the same transactions for the mortgage payments on both BOS and Halifax accounts. Halifax have admitted to administrative errors on several transactions and are refunding these.

 

b) What advice is there re anyone getting a refund for debt counselling payment of £100 which Halifax are refusing to return?

 

c) My view on my action is that at the core of it is the actions of BOS. Their actions directly caused the situation with Halifax. The BOS claim is the standard refusal. I have 5 years statements on that account. I am awaiting statements going back to 1992.

 

I would like (yes I know all about what I would like and what I will get) some recognition of the joint impact of HBOS rather than the disjoined answers I have from an organisation which does not seem to appreciate the joint impact they have had on me.

 

I am inclined to refuse Halifax current offer.

 

Thoughts and advice would be much appreciated as I hope to write to them later today, either way. Thanks everyone!!

It is a full financial settlement from the Halifax but does not address the fact that the default was applied. In my view that was directly related to the charges imposed on the BoS account and they were both hitting me charges. I am concerned about that at a later date.

 

I have checked the 6 rejection letters and they don't seem appropriate to me.

 

I have posted elsewhere re the debt counselling fee. Unable to source info on that. But again, I feel that fee is due to charges on both accounts, ie within same so called organisation.

 

Should I just refer to FOS. Would they consider a default issue?

Update

 

Hi everyone, hope all well. Been working away trying to tackle HBOS. Yesterday was quite a day!

 

Started by focussing on lack of statements from them. Phoned Client Services Manager re my refund and lack of statements. Told statements should be through in 7 days and claim would be reassessed within same timescale.

 

Phoned central 24 hour service centre. Told staements in 7 days but would not go beyong 6 years. Complained strongly that I have paid previously and would now go the Information Commissioner. Then she said hang on there are several letters on the system which are dated today and being sent to you. Do you want to know what they say?

 

Me- Yes please.

 

Her- It seems you are to be paid 3 amounts of charges as a goodwill gesture. This took me back a bit as it did not corelate with any figures I had.

 

Back to Client Service Manager team and spoke to helpful person. He was surprised and said he would check the system. Yes someone had been on the case within his team and he could make a goodwill gesture. That amounted to half of my claim, he said. Would I accept that as agoodwill gesture. Me- what do you think? I want the full amount of my charges.

 

Him- Ok We would not normally do this, but in view of circumstances and fact you have not received your statements we will offer you full amount of 6 year charges.

 

Him-I will redraft the letters and put them in the post. Money will be lodges in 14 days.

 

Me- what about the interest. Him- you will have to pursue it. Me- don't worry, I will.

 

So waiting on letters with offer. But still no statements- none at all on 2 accounts.

 

Will update later today, hope everyone doing well.

Today I write to information commissioner.

I had not made a claim for 2 of the 3 offers made. My original SAR referred to full banking history and my actual current account. 2 of the 3 current accounts are dormant and older. But they have not provided statements yet. Still need statements back to 1992 plus interest on current goodwill of 6 years, but I don't yet know the actual dates they are working on.

I have been charged for an "availability fee". Does anyone know what this is for, please?

The availability fee charge on current account was for £20. Charge was made during June 2003. (don't know if they still call it that.)

 

Anyone know what an availability fee of £20 charged by BoS on a current account is for??

Offer letter arrived.

 

I now have the letter of 100% (according to them) on each of 3 accounts. I also have the mortgage 100% offer.

 

Told customer service team I would accept the 3 offers as an interim/ partial offer (they call it goodwill) and not as a final settlement. Told them I could not accept until I received statements and that I wanted 8% interest. Said that they could not help and they did not do that. Told him to have a look at the CAG website (but not during working hours!) I said that I had no way of knowing that their 100% payback offers were indeed that, despite the list of charges (only) supplied by them. So far, I only had their word for it and the list of charges for each account.

 

Now need to write on that basis to them and consider rejection wording carefully. (got FOS route and forms at back of my mind). They turned it around and said my offer had been increased to 100% due to the delay with the statements and non compliance. Wondering how to use that to my advantage.

 

Incidentally, their offer letters say

 

"Following our conversation, I would like to confirm that on this occassion we are prepared to increase our goodwill gesture to £x, in recognition of your dissatisfaction. Please note that this does not mean that we believe we are under any legal obligation to do so...............This offer is a goodwill gesture and is in full and final settlement of your complaint against BoS.....

 

Payment within 14 days, etc."

 

Tonight I need to write to the other Halifax customer service team (mortgage account) with the other lots BoS 100% offer letter and use that to argue that they remedy my credit records as they took £10k out of my current accounts.

 

No rest for the wicked and I am aware that lots of us do not get much rest!!! Not that any of us are wicked!! Although perhaps that relates to our sense of humour!!

 

There is no satisfaction however, just frustration, bewilderment and determination. But as MacBoy said, I can smell the money! But I also smell blood.....................:cool:

HBOS I am not going away and I am not accepting as full and final. Like Dusary, I am gunning for you and want payback. Its not only about the money. Yes that is a huge part of it, but its not the only thing.

 

Mulling things over and back to FOS. Thinking of putting all 4 cases, inc non compliance SAR, inc credit history.

Me v BofS: Charges: £13,048.10 #2a/c Statements from 08/01/01 received. Charges:£5,156.39 Information Commissioner's Office informed June 12th who wrote to BoS, June 22nd for non-compliance. #1a/c: passed to BoS Senior Review Team. Discovered 2 further a/cs, and 3 Loan accounts. "Goodwill offer" of £7,424.23 06/07/07. Accepted (partial repayment). 20/07/07 Top-up payments of £2,558.10 & £1,154.00

£11,136.33 paid back thus far.

New claim issued: 9/07/2007 for 3rd account: £500+ PRESSING ON!

I know you have quite a liking for the smileys and I will plan sometyhing suitable!!!

 

Quite confident that there will be something to celebrate before then though with your case!!!!!!!!

Any advice given by me is based solely on my experience in claiming, my experience in CAG or my opinion. I have no legal background. I want to encourage others to reclaim what is theirs.

 

Got a DCA breaking OFT guidance. Complain to the OFT about the DCA. Help put an end to these practices-
