Hi, Am wanting to send of SAR to mint for statements but I also want to include in this letter a request for the true signed copy of the agreement under the CCA 1974 contained within s.78 (1) CCA but the s.77 (1) that I have quoted when writing to my loan Co British Gas refers to fixed sum credit - this isn't fixed term credit ( is it) ? So does anyone know how I should word it or what sections of the CCA I need to refer to in the case of Credit Cards when requesting a true signed copy of the agreement? Thanks.

Can't answer your question I'm afraid. You might be better posting it in the General forum aswell, as there seem to be more Moderators & Site helpers in there. When I was claiming against Mint there weren't many moderators about in this forum (no offence meant to anyone as you all do a fab job on this site!:D )

I require you to supply the following documentation.

1. You must supply me with a true copy of the original loan agreement I took out. This is my right under your obligation to supply a copy of the agreement under the legislation contained within s.78 (1) Consumer Credit Act 1974 (s.77 (1) for fixed sum credit) - your obligation also extends to providing a statement of account. I enclose a £1 postal order in payment of the statutory fee, PO Serial Number

 

2. A signed true copy of the deed of assignment of the above referenced agreement that exists.

 

3. You are notified that you are obliged to supply these documents, whether you are the original creditor or not.

 

Non-compliance with my request is a criminal offence under the above Act and will result in a report being submitted to the relevant statutory authorities.

Thanks villafan and paulwlton for your reply's. So it is actually the same wether its a loan company or a credit card - thanks for that paul.

 

A section 77 request is for fixed loan credit, section 78 running account credit eg- credit card, sec 79 request is for hire purchase.

 

The earlier post above will cover you for fixed loan and running account credit.
