Sorry to post again but I am just starting out on taking on barclays and intend to request my 6 years worth of statements , any advice form seasoned ,experienced members would be apprecited

Hi there,

Have you used the simple spreadsheet from this site to calculate your charges? If so it automatically calculates the 8% interest but you can't actually claim this til court stage. Send a copy of the S.O.C with your prelim but hide columns E & F. Be prepared for a long haul.

make sure you only enter the details for

Description of Charge ['In Respect Of']

The Amount [Amount you were charged]

The Date the amount was charged [must be in format dd/mm/yyyy]

 

The rest will calculate for you.

 

At the prelim stage as Mog says, you are simply requesting the 'charges' back

You need to wait 14 days between each letter as per the step by step instructions.

I have now received a 'WE BELEIVE THE CHARGES ARE LEGAL, and due to the Oft case we will request a stay if you take us to court.

 

Do I go ahead and lodge my claim adding the 8% plus 2 further charges they have added since this started, another £60. I requested to be refunded at Barclay call and was refused.

 

Please advise my next steps

Absolutely. Add any further charges that you've incurred to your Schedule of Charges and use this for your N1 POC. You can indeed finally unleash your 8% Statutory Interest! :)

You fill in the N1 http://www.consumeractiongroup.co.uk/forum/bank-templates-library/844-n1-claims-form-pdf.html you cant save this on your pc so you will need to print off 3 copies then take them along with 3 schedules of charges ( spreadsheets) to your local county court :)

Any typos spelling mistakes are due to leprechauns in my keyboard they move the letters around sometimes (amended just for Bookie)

Hello I got my reply from the =court today saying barclays will defend the claim(as I thought) but the original, papers said they had to reply by 26/10 and the repsonse is stamped on the 29/10, can I ask for this to be paid due to them being too late, if not what do I do next

unfortunatly the banks seem to get away with filing late acknowledgements .... they now have 28 days from when the notice was deemed served which by my reckoning is around the 9th of this month ........ this is when they have to have their defence into the court.

Hiya

 

yes you will need to inform the court of your new address. Write to the court

with your claim number on,explaining you are changing your address. If you

post it make sure you send it recorded delivery and keep a copy.
