      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Despite my recollections being that I never requested any PPI on any Loans/Cards, a friend of mine suggested a few months back that I simply write to all of my Creditors demanding they repay me the PPI that had been added to my accounts.

I had very little by way of any paperwork to corroborate my claims but I simply tailored one of the template letters that are kicking around the web and sent it off to all and sundry.

I suggested that my claims were largely related to pushy salesmen/poorly explained details etc. and awaited responses.

In general the initial responses were all along the lines of "Very sorry to receive your complaint, please fill in the enclosed Questionnaire to help us with our enquiries".

I NEVER filled in these lengthy proformas, and responded that I saw them as just a cynical ploy on the parts of the Banks to put people off pursuing any further, and were designed to trip people up and provide loopholes for the Banks to exploit" I also stated that I would only involve myself in lengthy administration if pushed to pass my claims on to the FOS.

As can be seen above, I have had quite a few successes thus far, and the only losses were from Companies that produced proof that I had not had PPI attached to my Loan/Card.

I would advise anyone to chase these charlatans, because for the price of a few stamps it can be very satisfying, not to mention lucrative.

In September I successfully claimed back £4,500.76 from my RBS Credit Card, all because the person that sold me it told me I had to have it for my card application to go ahead (I already had life and critical illness cover, death in service benefit and 12 months sick pay from work)

 

This was on a card with a £2,000 limit used to varying degress over 10 years :)

Thanks to this forum and the use of templates for SAR request and my claim, I received £16,000 from Lloyds for mis-selling on loans between 1998 and 2005.

 

I received all the information within a few weeks of posting my SAR request letter. I then sent of my letter outlining my reasons for being mis-sold, and within two weeks I received a phone call following up my letter. I answered their questions and was told I would receive a decision soon.

 

10 days later I logged on to my account and was gobsmacked to find it £16,000 in credit! That same day a letter arrived in the post confirming the offer of compensation.

 

It is definitely worth spending £10 on the SAR request, as this provided me with all the account numbers for all of the loans (many of them were consolidation loans) and the printouts also showed which loan accounts had PPI.

 

I always accepted full responsibility for the loans I had and understood and agreed to the repayment plans and interest, but I resent that the bank implied that the loans would be provided on condition of me taking out PPI, even though I was working part time on a self-employed basis, raising a young family. I now feel that justice has been done and I still bank with Lloyds (better the devil you know!)
