if you want to add daily rate - you need to put it in your particulars

total of claim xxxx+ xxxinterest + xxp/day until settled.

and you figure the daily rate like this:

claim figure x 0.00022 = daily rate

so, for example claim is £2222.. daily rate would be: 49p/day

Thanks nima - so ie my claim is 4313 + 86.00 interest [the 8% interest at present is 1521 on penalties and 15.00 on interest] = 5935 total so if i just use the 4313 + 86 then the .00022 per day applied by the courst will arrive at the same figure i.e. 5935 [i'm assuming 365 days x 6 years x .00022] is that correct??:|

actually its charges alone -not the 8% interest - so 4313 + 86 = 4399x0.00022= 97p per day from the day you file until the day it is settled.

so your charges are 4399 + 1566 int + 120 court filing fee + .97 per day from the date filed to the date settled (add the first three for your breakdown) then put the last sentence "plus daily rate....."

if you want daily rate you need to squeeze it into the particulars.

mcol submitted saturday so showing requested 5/5/07 - do I PM a mod now? and also send 2 copies of schedule plus charges to the courts [do I include the 8% one?] at what stage do I send schedule and charges to DG? Any help - thanks in advance ..charliedog:rolleyes:

you should post 2 copies of your schedule to the Northampton Bulk Processing Centre the day you issue your claim, so that the schedules can be served with the court papers.

and yes, include the interest.

Send DG a copy also.:)

Thanku freaky - its just that when u read various threads some say don't send anything to DG until Notice of Issue or Acknowledgement so was bit confused....have just posted - recorded two copies of schedules of charges inc 8% upto date of filing - cos from then on the courts will apply the [x] 0.00022 p d to the charges approx .95p a day won't they? But I don't suppose it hurts to let DG know by letter and schedule that action is underway...hey hey hey !!! Thanks freaky .... charliedog:p [Linda]

you're right - we usually wait until the acknowledgment to send dg a copy - they say they are defending and give an address on page 2 - so we respond by sending a breakdown.

on the breakdown - to save doing a new figure everytime - just put:

charges xxxx

8% int. xxx

court fee xxx

TOTAL: xxxx plus xxp/day from xx/xx/xx (date you filed the claim) until settled.

well you've got your letters to the court & dg sorted so now you can just sit back & wait for them to put a defence in. they usually do it at the last moment so you can relax for a bit. this bit will seem to drag but remember good things come to all who wait :)

I can see you're gonna be restless

just checking though as I just readback through this thread- a letter and copy of SOC needs to go to DG once you receive your notice of acknowledgement from the courts (address on p.2) have you done this yet?
