yippee they have folded - they are now offering me £2500.00 so i am going to accept this amount.

 

also for some reason they are still saying if they get into court they will still win - lol is funny dg. even tho they have not complied with the judges direction.

 

so i have won will cancel court action after i recieve the cheque - they are saying i have to accept it and agree to their terms - which im going to politly tell them to stick that bit up their bum.

 

 

so thank you all who have helped me once i get my cash i will drop some cash to the forum.

i need an acceptance letter if anyone has one i also need the letter you send to court saying you have reached an agreement and this matter is settled and doesnt need any more intervention from courts.

 

if anyone could point me in the right direction i would appreciate it.

this was my letter thought id attempt it myself hopefully it is ok _ im a bit pedantic in it but they deserve it :D

 

Response to settlement offer.

 

 

Dear Sir/Madam

 

Thank you for your letter dated 11/07/07

 

I Accept your offer as Full settlement with regards to the above court action and request, that you send me a cheque for the amount offered £2540.51.

I still believe you are simply procrastinating and would not defend this case in an open court.

Due to me being a nice person and not wanting to waste the courts time any further. I would like to stress that I Accept this offer in settlement of Claim No: *******.

I do not agree to waive my rights in respect of any other actions, nor do I agree to a clause of confidentiality.

 

I hope to hear from you very soon so that a reasonable conclusion to this claim might be achieved. I am sure that the courts would whole heartedly approve of our settling this matter in a timely manner and without their further intervention. I look forward to hearing from you.

 

If you do accept my conditions for acceptance please could you send a cheque to the above address due to me not holding an open account with HSBC Plc.

dam postal strike - my acceptance letter arrived on monday so they wont get a cheque to me till wednesday - on my court letter it stated if i dont cancel action 7 days before court date i have to attend anyway.

 

bugger

 

will send them a letter after i get cheque anyway and attend if they dont respond

well due to dg not being very fast (just got off phone with some bloke at dg) i am having to tell the judge in person about the settlement i wont recieve the cheque till sat am or mon am

 

so i have to go into the court with my wasted cost order and be very nice to the judge and explain that hsbc did not reach an agreement with me until the morning of the hearing. ** wonderful**:o

could someone explain what i can claim for in my wasted cost order.

 

postage, printing, time, paper

 

anythin else? time i was going to go with 8hrs at £9.00ph but i may up this due to the fact that if i had worked on a sunday in work instead of compiling the bundle at home i would of been earning £24.00ph.

 

what do you think should i go for my actual hourly rate on a sunday?
