i sent a letter to them asking for £602.82 back for late payments at a rate of 62p per day charge and letter charges to be paid back to me, we used a template from the library, they sent a reply stating that the letter charges ect stand and that the laws stated and the oft statements only relate to credit cards not finance companies, am i right in thinking they are wrong and can i claim the letter charges and late payment charges back when they are fully automated.

any help please

I think this is what you are after:

Look at paragraph 1.19 of the OFT's April 2006 statement.

that is very interesting reading and am now printing off for my records, but its still unclear if this applies to finance companies on such things as car finance or maybe i missed it

"default charges in consumer contracts"

That seems clear enough to me.

Yes it does. I claimed the charges on an old HP agreement I had with Capital Bank - they paid up in full as soon as I issued proceedings and it was nearly £1000

Don't be shy - JDI (just do it) !! :)
