I have a Mortgage account with the Nationwide.

 

The first ever payment didnt go out and so Nationwide charged me:

 

i) £25 Direct Debit Failure

ii) £15/month for each month that the amount was not paid

 

Are these charges also illegal as per current account charges?

 

Any help here most appreciated

They are unlawful provided that they represent a disproportionate penalty. What you have to be aware of is that there may well be moire manual intervention in a mortgage account than a current account.

 

Even if you know what your charges are you should send the DPA request as this asks for details and notes of manual intervention for your account. If it's clear that they've had to do a lot of work, it may be more difficult to make a succesful claim.

 

I'm in the middle of a battle with my old mortgage company and it's very likely that this is going to court. There is going to be a real argument about the amount of work that the mortgage company had to do and whether the charges reflected trur cost.

I have filed a claim via moneyclaim, received a full defence disputing the full amount of the claim.

 

A couple of questions here for anyone who can help (and I need it).

 

1) Can I claim the 8% interest on the original debit fee and on the monthly arrars charges?

 

2) I have asked for a history of any manual interventions on my account (see pev message in this thread) BUT I have done this with other banks too and they have refused to give that information! Could or Should I ask for this in the 'other information' part of the Allocation questionnaire?

 

3) Does any one know of any other claims like mine?

 

4) Finally, can anyone offer advice on filling out the Allocation questionnaire!
