hi,

can anyone shed some light on rbs credit card charges? I have looked through the site but only seem to see advice on rbs bank accounts.

 

I have sent off the first letter requesting refund of the charges (around £260) my account ended up over the limit by less than £10. the rbs charged me £20 for this and then deducted the minimum payment from my account, this failed to bring the account within the set limit so they charged me another £20 and deducted the minimum payment again and this continued for a few months and so here I am.

 

Its almost time for me to send the second letter (14day notice) and if no contact is made i am happy to proceed to court. Could you also shed some light on making a claim, Is it as simple as goin along to the Sheriff Court (I am in Scotland) and filling out a claim form or is there maybe a way I can start the process on-line?

 

Any advice or clarification you can give would be gratefully received.

Q. I have been charged (£20, £25, £35 etc...) by my bank/credit card company for going over my agreed overdraught limit. This was entirely my own fault. Do I still have grounds to start legal proceedings against them for recovery?

A. The law is very clear on this. If you have been penalised for breach of contract by means of disproportionate penalties regardless of how the breach came about then you may have grounds to recover your money

 

Where did you look to miss this? This is the very 1st question in the FAQs!

 

Yes, you need to fill the form and take it to Sheriff's court. I don't think they have an online system there yet.

I filled in and printed off the form at home on my compter then just handed them in at the court scott8040, I used the templates from here
