Hi,

 

Business went bust about 2 years ago resulting in my paypal business account being charged back a large amount of money. The business account was in my name and not the companies (stupidly)

 

With such a large debt is it best to make a payment plan with westcott as they are on my case or ignore them?

Hi,

As the business went bust it was for chargebacks as we couldn't fulfil some orders that had already been paid for.

Yeah, I've removed any details from PP etc.

No I haven't moved. Still at the same address.

nothing they nor anyone can do to you.

wetcloths are a DCA.

who are their stated client

is this debt showing on your credit file?

 

a DCA is NOT A BAILIFF

and have

ZERO powers on ANY debt - no matter what it's type.

Hi

No this debt does not show on my credit report at all. It was POST brexit, was at the end of 2020. I had set up a payment plan with westcott for £20 a month for the debt when they first contacted me about it. However, changed bank and got a letter through today saying a payment on it was missed and call them to set up an alternative plan.

So was really wandering what would happen if i just ignore them. I don't want a CCJ against me but also hate paying these guys.

good well no original creditor ever does court so put that out your head totally.

were these chargebacks? had you removed your funding source so PP couldn't complete the CB to your bank then?

They were chargebacks from customers yes so the PP balance just went into negative.

I'm not sure they even attempted to take money back from the company bank account attached to the account.

If they did, they didn't do it instantly because there was a small amount of funds left in that bank account but nowhere near enough to cover the debt.

They (PP) rang me and asked if i could pay it back and i told them no not right away and they closed the account pretty much straight away and passed it on to westcot.

tough luck on them then.

i would be looking at what type of contract you sign up too.

check its PP UK, as i bet it's an sarl Luxembourg agreement.

I'm not sure how I would obtain that information.

However, just looking at one of the emails that was sent to me from PP when a buyer requested a refund and PP rules in their favour.

The bottom of the email states:

not under uk jurisdiction then.

stop paying.

ignore until/unless you ever get a letter of claim from a UK debt buyer after you have received their Notice of Appropriation that they have bought the debt from PP EU
