hi.

 

my bank has today made me an offer i did have to put in a claim against them for this but still at least they are now playing ball. HOWEVER i made a claim for just under £2000 and they say they worked it out to be more like £850 plus £460 interest and have offered me £760 settlement. is it me or this a massive difference!!! does the fact they have made an offer effect my online claim now?? any help much much appreciated. rach x

No it does not effect your claim, it is just a tactic to try and tempt you as Christmas is approaching. As long as you are sure your figures are correct stick to them. Which bank are you with and please stick to one thread I will get this moved and changed. They will pay the full amount in the end. :D

Welcome Rach.

Only you will know if the figures stack up,but one thing is certain its not the full amount.

If you have already launched an online claim then it will not affect that,indeed nor will it affect it if you start one.

You should re-check your figures though.

Send them the rejection of offer letter which you will find in the bank temps library.

Meantime take some more time to go through your figures and make sure they add up !!

the bank is hsbc. iv checked my figures and there right. the bank has made me the offer but not as yet logged a defence for my claim, doesnt this seem odd? because in 8 days i win the full amount by default unless they log a defence or does having made me a settlement offer change that?

well they given me ten working days to accept the offer which i dont want to because its so low. so am i right in thinking that if they dont log a defence within the remaining 8 days of my claim then i get the full amount by default despite them making me an offer? that doesnt seem correct somehow??

Hi Rach, I think that they can offer to settle out of court at more or less at anytime by agreement with you, right up until the actual court appearance, and even then it could be settled out of court on the day, if you agree. You will probably find that they will enter their defence with a day or two to spare (or actually on the final day in my case). Hope this helps, Keep on at 'em! Dodderhill:)

bank has acknowledged my claim and their solicitor has written to say they have been passed my complaint to deal with. REALLY NERVOUS NOW!! is it true that they haevnt taken anyone to court yet??? and is it it true i wont have to pay their fees if i lose??

Hi Rach.

 

Don't be nervous.....Be elated. You've got the upper hand over the bank at last.

The bank won't take you to court....You're taking THEM.:D

 

Provided your claim is less than £5000 (£750 in Scotland) then it will be allocated to the small claims court, which means that you basically pay your own costs.

Incidentally, when you win, you can add the court costs to your claim.

thanks for advice. the letter they sent me says that they believe they can justify there charges and pretty much that they can defend it in court and will do if i dont accept the offer, its all got very scary the idea of fighting a bank in court.

Hi Rach.

 

Standard response from the bank.

Don't worry about it. The last thing that the bank wants is to go to court....They have too much to lose. In the unlikely instance that you did find yourself going to court we have counters for every defence that the banks have thrown up.

hi all, i know i never really got the whole thread thing right!!!! but my bank today changed their offer from £800 to £1600 and iv decided to accept just wanted any newbys to know its very worth sticking to your guns and for asking the forum for help when you feel lost. xx
