Friend Worried as Car failed MOT but it is still Insured

I am here to ask for a friend who has a car that is taxed and insured, fully comp.

The car recently failed MOT and friend atm can not afford to fix it but car is too good to scrap. 

The car is on private land near where they live and in a cul de sac, they want to know if haveing no MOT invalidates their insurance?

 

The car has not been moved since MOT ran out  which was September but the insurance and road tax is still in place, they are not sure what to do, they  are trying to get the money to sort the car but finding it hard

 

Friend has not asked their insurance company as they have no phone or internet!

 

I said I would ask here as I have no idea,   

do not have or own a car lol

What coverage are you worried about?

 

If it has failed its MOT, it shouldn’t be driven on a public highway (unless going for a booked re-test, having been made roadworthy). It can still be insured, though : for example to protect against risk of loss e.g. from theft.

it has not been driven anywhere since it failed MOT Bazza :)

Quite right!

As if not roadworthy, the insurers might try and disclaim a claim arising from an accident, if the accident was caused / contributed to by the reason the MOT failed.

 

Yet, that wouldn’t necessarily invalidate a claim for e.g. theft

the car is in good condition         but friend took it to garage known to fail cars  on lots things, was told not take it there but as car needed a service and the garage were doing  have a service and MOT is 1p they went there, several people have said take it elsewhere to see if it does fail on the items stated but friend  has said no as now car has no MOT they not risk it

just book it in for a new MOT at another garage 

he is quite legal to drive it there.

 

the garage doing the MOT will see the failure on the MOT system and check it over

there is nothing wrong with stating the previous test station are know to fail cars for no reason.

 

do you know what it failed on?

The car is going for another MOT once it can be arrange, the list from what been told is long! I am not sure exactly what the failures were but a couple were classed as Major?

I will try and find out but do not really see the person car belongs too

If the list of issues is long, it might be worth getting estimates for the repairs, assuming that they are real issues that would be found by another test centre.

 

Then weigh up repair costs against the current value of the car.  A local independant garage might be interested in buying the car at its current value, as they could do the repairs more cheaply and sell the car.  So just because a car has failed an MOT, does not mean it is only worth scrap value. Depends on the car and what faults it has.

 

Any vehicle sitting for a long time will deteriorate, so they should not wait too long before making a decision about what they need to do.

This question (whether an MoT failure invalidates insurance) is raised time and again and the answer is it doesn't. Leaving aside other reasons (such as the Road Traffic Act which does not allow insurers to avoid cover for such a reason) there is a much simpler explanation: if cover was voided by a car failing its MoT, a car doing so could never be driven again, not even away from the testing station!

car is a Subaru Forester with Boxer engine, 2010 reg, was valued at over £6k but that was before MOT failure, it is on finance

update, friend said Kam ( garage car was taken to for MOT ) HAVE QUOTED THEM  THE PRICE BE ANYTHING FROM £1500 to £2000 to put everything right! 😮
