Update:

 

letter from Howard Cohen. Dated 03032020 (yet still no sign of the "requested docs")

 

We acknowledge  receipt ..................CPR 31:14......docs mentioned in our POC

 

We are currently in the process of retrieving the documents requested.

Therefore, please accept this letter as our agreement to a general extension of time.

Once we have provided you with the documents requested we will grant a further 14 days for you to respond to the Claim Form as you feel appropriate.

Do they have the authority to grant such extensions to the due process.

 

Checked MCOL: Nothing to this effect posted there.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Update:

Just copied this from MCOL

 

A claim was issued against you on 30/01/2020

Your acknowledgment of service was submitted on 16/02/2020 at 20:27:47

Your acknowledgment of service was received on 17/02/2020 at 08:05:17

Your defence was submitted on 28/02/2020 at 13:39:51

Your defence was received on 28/02/2020 at 14:28:29

 

Solicitors wrote on the 31st March. (Howard Cohen) Stating that their client (Hoist Finance) wishes to proceed with the Claim. Going on to say that "You will receive a Directions questionaire from  the Court in due course for you to complete and return to the court "  It then goes on to say that: In the meantime if you wish to settle blah blah blah.

 

within the last hour phoned the court for any updates, to be told that the case was "Stayed" on 2nd April.

 

Question: Where does that leave us??

But dont be surprised if you do receive a Proposed Notice of Allocation and DQ due to the current climate and courts being closed and behind on process.

That seems to be what has just happened.

 

Proposed Notice of Allocation and DQ  received, dated 24th April.

 

So far, no response to CPR/CAA so no paperwork, nor copy of signed credit agreement.

DQ to be returned by 11th May.

 

Is it possible to delay until they complete CPR/CAA request?

they don't have to complete CCA/CPR, read other ex Barclaycard threads 100's here already as post 18

but they will have to disclose them id it get to the witness statement stage,

is he a fulltime resident there?

He was in Spain for a while when all this started (4-6weeks), returned to UK when Covid struck. So back home at his UK address locked down.

Went on to MCOL simply to view any updates:

This is what we found:

DQ sent to you on 24/04/2020

Notification that the claim against you was discontinued was received on 04/05/2020 at 19:20:56

 

Looks good.

YES/NO ??

 

Looked at similar threads, some report that other DCA's sometimes try to get involved later. At which I guess we ask them to go for a dance??
