Hello guys,

Made a claim in 2012 for O/d ppi which was upheld  in 2013.  

I was not happy with refund amount and returned their cheque back.

this account had balance of £2000.

 

then again In 2017 Barclays sent me a letter which states , 

I have ppi policy with them and they tried to contact me and their letter was retuned back from my address( which is not true)

 

I need advice :

1-Should I start a new claim or just remind them about the previous outcome and details ?

2- Also there were penalty charges on this account due to over draw should I claim them as well ?( it was current account)

start a  new claim

if they want to bring up the old one, they will.

 

if any penalty charges were the result of the [wrongly] inflated OD , then they should refund those too.

 

I suspect, though with Barclays I've not seen it yet, they could refuse as you've know about the PPI for more than 6yrs and could use statute barring sadly.

Should I claim penalty charges separately ?

Can you please help with latest spread sheet and any template .

what interest rate should I apply for O/D ppi  and penalty charges ?

as I said AFAIK you cant claim Penalty fees anymore other than those caused by the inflated balance of the PPI

Ok , how would one will assess they have inflated the balance. For example if 2 or 3 penalties charged in one month ? 

Or any other way ?

if the ppi refund figure to the date of the charge made the a/c go into credit, thus they cant levy late/overlimit, there was actually nowt to pay.

basically if all penalty had been taken off /would not have been levied and rif account goes into credit after ppi refund it means they are reclaimable ?

no..

 

the PPI refund figure accumulates by date

the later the date the more is refunded

 

so say for example :

 

you had a £12 overlimit fee in 01/01/2010.

 

from the date the PPI started

to the date of the CHARGE

if the PPI refund [to that  charges date] exceeded how must you were in debt AT THAT POINT

you would not owe them anything, so the charge is invalid so must be refunded too.

Get the PPI issue sorted first as the deadline in soon.

 

Look at possible consequential penalty charge refunds after.

ok so CISHEET claim to date set to that

take the total from that and put it in the statint sheet the day after as a whole sum

you are entitled to 8% stat int once theirs stops

last interest charge date- 18/2/09

all ppi charges until last interest charged date, entered into cisheet

then  transferred into statin sheet?
