Another quick question, should I address my reply to the name on the reply I recevived (A Customer Service chap) or back to the Solicitor, Mr Bacon?

OK, just about to submit my MCOL, does this sound OK?

 

Particulars of Claim

 

1. The Claimant has an account 25###1756 with

the Defendant, opened October 2003.

2. Since 17/02/04 the Defendant debited

charges and interest in respect of purported

breaches of contract.

3. Defendant is aware of all details as a

list of charges has already been supplied.

Another copy will be sent.

4. Claimant contends: (a) The charges exceed

the Defendant's losses caused by the

breaches; (b) The Term permitting the

Defendant to levy such charges is

unenforceable under the Unfair Terms in

Consumer Contracts Regulations 1999, Unfair

Contract Terms Act 1977 and at Common Law.

5. Claimant claims: the return of the amounts

debited of £1462.36;

6. Alternatively, if the charges are a fee

for a service, then they must be reasonable

under S.15 of the Supply of Goods and

Services Act 1982.

7. Costs allowed by the Court.

 

 

And for the lettering covering the Schedule of Charges...

Please find enclosed a schedule of penalty charges taken from me by the defendant. The charges equates to the total amount of my claim, namely £1462.36.

 

I respectfully request that the enclosed schedule should be attached to the particulars of my claim.

 

If someone gives me the go ahead I'll be clicking Submit this afternoon, all very exciting! :)

hi lewlar, it seems fine to me ...i have just filed with mcol two weeks ago and it is the same as mine .x
