  1. I was successful with a claim through Nationwide about a month ago, and now a friend is claiming from HSBC but is experiencing many problems with non-compliance. I know the financial ombudsman can be informed of a bank's non-compliance to requesting statements, but how far can this be taken? Is there a link to anywhere on this site where I can research further into non-compliance? Cheers, MF.

  3. You are not commenting on the items being discussed in the thread. By implying that I 'may not be able to understand your simple terms' as your misguided attempt to discredit me, you are dragging a thread off-topic, while disturbing your own credibility. I, on the other hand, have just completed a successful claim with the Nationwide, and my extended presence here is to help other people with their progress who are in the same situation. If anyone would like to conatact me via PM for help with a claim on a personal level, I would be more than willing to offer all the advice I can. Otherwise, I can be contacted direct by e-mail on . Please do not see this petty squabble as anything other than a member with a big post count throwing his weight around; my intentions on this forum are the same as they have always been - to find the advice from experienced claimants that will help with my own claim and then to pass the experience onto others for their benefit.
  4. Well, there are a lot of other people on this board who were claiming from Nationwide with almost exactly the same timescale as me, and ALL WERE DEALT WITH IN THE SAME MANNER. We were paid last week, by the same methods, at the same point of the court process. Refer to pitters or nines if you are still in doubt. For a lot of the information and assistance I required with my claim, I was forced to refer to the Which forum and other friends outside of the internet who are also claimants. There are a lot of people on this site who have racked up so much in lost payments that they could very easily be consider NOT be the best people to refer to for financial advice. Who said anything about an N1? I did not see a mention of an N1 in this thread. Semantics will get you nowhere, boy. Who has heard anything? Nobody I have read about on this or any other forum in the last couple of weeks has heard ANYTHING AT ALL before the 28 days deadline. You are confusing situations unnecessarily here. They are not submitting defences until after the 28 days have passed. Can you find an example of this, or are you just here for an argument? What is your point? If you are going to cut sentences up, and you are not going to read the words on the screen, how can you be of any help to anyone? Nationwide have said to a lot of people that they are defending the claim as they have explained that their charges are transparent. If they believed this, they would NOT pay up. When did you claim? What is your point? Are you here to offer advice or just to troll? Semantics will get you nowhere, dear boy. I use a lot of internet for a on a regular basis, and have done for years. On a forum where I moderate, the use of ‘@’ to indicate that you are aiming a specific post at a specific user is perfectly justifiable, but ‘txtspk’ would have ‘U’ chastised. It makes you look childish and uneducated; exactly the sort of impression you should be steering away from when you are offering people financial advice. I don’t want a fight here, but if you do, PM me and I’ll give you the URL to another forum where we can have a proper fight.
  5. I never applied for the compounded or excess overdraft interest. You've got a lot of calculations if you're going to go down that path, and a simple mistake could render the claim invalid. I wouldn't attach any interest until posting the MCOL, and then only attach the 8% to the charges.
  6. I won just shy of a grand last week and my overdraft is bigger than yours. They have done nothing about it, and to be honest I don't think they would bother doing anything as long as it is generating for them lovely, lovely interest. There is a lot of misinformation about the claim procedure going around. Just stick your MCOL in and wait the 28 days. When you click 'Judgement by default' after the 28 days, the Nationwide will apparently file a defence, but then they will pay up the full amount WITH INTEREST - IF YOU CLAIM IT within a few days. Stick in there, the money will be yours. I'll write a full account of my case (when I get time) for other people's benefit, and it won't have any annoying 'txtspk' in it. :grin:
  7. Have you had a search for tyres on the internet? I've been quoted just over £200 (delivered) for a set of Pirelli P7's, while they would cost well over £400 in ATS. Many places will fit and balance 4 tyres for about £25.
  8. I won. I have been paid the full amount + court costs + interest, and they've canceled a further missed DD charge on my account. I'm happy now, apart from the letter they sent me stating "If you misbehave again, we will be issuing a 30 day notice of closure on your account". If they charge me again, I will be claiming it back - again. Who do they think they are?
  9. My dates are the same as yours. I had exactly the same mail (AQ) from the court, with a second separate letter "case status is set (eg paid transferred etc)". Just need to get to the bank now to check my balance. I'm hoping that this is the end of it all...
  10. That looks to me like it's going to court! I have not been through this before so I'm getting lost now. I checked my bank balance last night and there has been no money deposited. I've just gone through the final stage of the Judgement by default and added a further £6-odd interest on as well. The MCOL screen now says 'Judgement requested'. Where do I go from here?
  11. Right, I've just clicked the 'Judgement by default' tab. I can't check my account balance online so I don't know if any money has been paid in. They acknowledged the claim on the 13th of March but have done nothing with it since. I don't know what I'm doing now, and I don't want to mess it all up after coming this far. HELP!!
  12. I put my claim in on the 9th of March and it was acknowledged on the 13th as well. My MCOL screen is still saying "acknowledged", and as far as I know I have not had any money appear in my account. Does anyone know what the Nationwide are playing at here? I have had no further contact from the MCOL by mail since they sent me the acknowledgement letter and the Nationwide have not contacted me once, by mail or telephone. Please! Help!
  13. BUMP! I think I'm doing the right thing here. I've sent the details of the claim to the MCOL address. Do I need to contact the Nationwide again with the revised claim details (including the interest)?
  14. Firstly @ mahharg: Thanks for the help in that post. That's been the single most useful piece of information I have received since signing up and reading on here. OK, I have just done my MCOL and the total with court costs and interest now comes to £976.46. I've prepared the letter to send to the court from the template supplied by this site - cheers again! - which I am now going to post to the address in Northampton. Have I now got to make contact the Nationwide directly to inform them?

  16. Also, I'm claiming for £764 + £130-odd contractual interest. I still have an overdraft of £1600. If they close my account, what can I do about paying that off? I can't afford to pay it at the moment...
  17. Bump! I'ts been over 14 days since I sent the LBA now. I want to move on to the next stage. I believe I should now do an MCOL? Are there any examples on the site of successful MCOL's I can refer to?

  20. Good Morning! I'll have to post this lot in a few short bursts as I'm at work at present. I applied to the Data Protection Unit in Nothampton for the repeat statements in mid December and finally sent off the claim for the return of the charges (£764) on Wednesday 24th January (issuing the standard 14 days notice). I received a standard letter yesterday stating that the the bank was operating in a transparent manner and that they were as a result refusing to pay out on my claim. I have been reading up on this site for a couple of months now and the success stories some people have documented were the inspiration for me to make my own claim. I have seen from a lot of the other threads in this section of the forum that my next course of action should be to send an LBA, an N1 or an MPOC, but I am unsure as to which I should send or what exactly these terms refer to. Can anyone help? I've done a lot of reading (in this forum) and found a lot of the information to be very informative, but I am lost at this point and don't want the bank to get the better of me. Any help would be greatly appreciated. Regards, MF.
