The court responded in writing that the defense has been received and forwarded to Mortimer Clarke.

Now its a waiting game.

Thank you guys so much for everything this far.

I would have been up the creek without it!

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

Thanks Andy

I received a reciept from the court.

Which stated the defence had been sent to Mortimer Clarke.

On 11/10/2017 received the attached document from Mortimer Clarke.

'We have received your defence.

We enclose a copy of the Notice of Assignment for your records.

We are taking our client's instructions in relation to your defence and will come back to you as soon as we can.

In the meantime, the matter has been placed on hold.'

The documents received are attached.

  • 3 weeks later...

it has been over 30 days since i submitted the defence.

The only thing I have heard from Mortimer is the letter I received in my last post, stating that Mortimer Clarke where seeking the clients instructions.

Are there any next steps i should take?

Mortimer are no longer acting for Cabot on the claim...you should be informed of the replacement.

what do you mean by drop the debt?

exactly the same as failed CCA returns court claims are nothing to do with the collection process.

I mean, i have issues with the ownership of this debt and I have avoided county court action this time (with the help of you guys).

If there is an issue with them not having a contract or being able to provide me with the details / documents i requested in my defence,

is there a way to make them "write off" the debt?
