Hello

Someone was renting my flat and then left.

He believes that I have withheld all his deposit (which I did not, only part of it was withheld for damages).

He applied to the County Court to recover the monies but the mail was sent to the flat where I no longer live.

Consequently I did not receive the letter from the Courts, or I would have challenged the claim.

I have just received a Notice of Enforcement followed by a further letter stating that their Enforcement Officer attended my new flat but was unable to meet up with me to discuss payment.

They state that as they were unable to recover the full amount, the enforcement of the Writ has escalated to Stage 2.

Apparently this is over £3k.

I do not even know how this amount has been arrived at as the rent was under £600 per month.

What are the options now open to me?

Any advice would be greatly appreciated.

Cal

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

right so they've crossed courts.

they cant force entry and can be for want of a better word ignored

the trouble is you'll get or have already gotten £325 fees added

but that's all they can add.

it'll cost you £255 to fill out an 244 to get it set aside

but you'll also need a defence for the claim.

have you got one?

and whos the HCEO company

Fortunately I do have a robust defence and I am good at record keeping.. So it is not too late to fill in a 244. I understand that there is a fee associated with this. Will I get a refund on the fee if I am proved to be in the right?

The original CCj was under £600 and now it has escalated to over £3k.

Did the enforcement agent provide any details of the precise fees that have been added to your account?

I notice that you state that you live in a flat. Would there have been a car belonging to you outside?

Hi I have not been given the precise details other than they add on more money and interest as the debt remains unpaid.

I do not own a car and live in a rented shared furnished flat.

Is my best option to go to a local county court or have dialogue with the HCEO?

Being brutally honest, the enforcement agent cannot charge any further fees and given that you live in a furnished flat and do not own a car, this is a debt that is going to be difficult to enforce.

As to the way forward, that does depend a great deal on whether you wish to have the CCJ removed from your records and defend the action.
