PCN Total Parking Solutions Overstaying - POFA Compliant?

Hello all,

 

1 Date of the infringement 20/11/2016

 

2 Date on the NTK [this must have been received within 14 days from the 'offence' date] 25/11/2016

 

3 Date received 28/11/2016

 

4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? Yes (see attached)

 

5 Is there any photographic evidence of the event? Yes - ANPR.

 

6 Have you appealed? Yes - standard template to receive POPLA code. In the process of writing POPLA appeal. Not currently attached as standard text used

Have you had a response? Yes, their (the parking company) rejection also attached.

 

7 Who is the parking company? Total Parking Solutions Ltd.

 

8. Where exactly Heritage Retail Park, Crewe

 

 

So, I overstayed my welcome. I honestly did not see the signs, not about the length of stay nor about the charge - they are unclear and the writing is tiny. The store where the carpark is was closed at the time. Attached photos of the sign, one zoomed in from my car and the other standing right underneath it trying to read it.

 

My question is about POFA liability and the NTK. I can understand the legislation but from my reading of the NTK, I cannot see whether it is POFA compliant. So how do I use this? They haven't any evidence of who the driver was and the appeal has been from the keeper at all times. No liability has been admitted.

Hi your reply letter shows all of your info. You should remove it and redact

Thanks for that CraigMcK! I've removed all the attachments for now... How strange, I made sure to redact everything as I was paranoid about something slipping through how annoying!

I'm no techie livv, but it might depend on how you redacted. Did you use something like Microsoft Paint?

I used image viewer or whatever it is on a mac, and adobe. I checked it all myself as well and didn't see anything but I don't know :S I'm not techy myself evidently. Hopefully it won't put me on the back foot at all... Once I've figured things out properly I will attach my evidence again at some point later this evening.

as you are in the process of appealing to POPLA we cant do anything for the momenta nd would need to see your appeal as well as their NTK, signage and other evidence to offer an opinion on what chances the parking co have on actually having a contract with you that can stick
